APPLICANT'S RESPONSE TO OFFICE ACTION

The following is the response of Applicant, Dependable Partners, LLC, by Counsel, to

the Office Action sent via email on April 13, 2010, by Examining Attorney April A. Hesik.
INFORMATION REQUIREMENT
In response to the Examining Attorney’s requirement that Applicant provide additional
information regarding its services, Applicant has attached, as Exhibit A, fact sheets from its
website explaining Applicant’s services, how they are rendered, their salient features, and their
prospective customers and channels of trade.
RECITATION OF SERVICES
Applicant amends the Recitation of Services to read as follows:
CLASS 035: Real estate advertising services, namely, advertising properties for rental;
real estate advertising services, namely, providing a website featuring property rental
advertisements
DISCLAIMER REQUIREMENT
The Examining Attorney has required that Applicant disclaim all wording in SPEEDY
TENANTS pursuant to Trademark Act Section 6(a), 15 U.S.C. §1056(a), on the grounds that the
wording merely describes Applicant’s services. For the following reasons, the Applicant
respectfully disagrees with the findings and requests that the Examining Attorney reconsider this
disclaimer requirement and allow registration of Applicant’s mark without such a disclaimer.
Applicant’s Mark Should Be Allowed to Register Without Any Disclaimer
A mark is merely descriptive if it describes an ingredient, quality, characteristic, function,
feature, purpose or use of the specified goods or services. See In re Gyulay, 820 F.2d 1216, 3
USPQ2d 1009 (Fed. Cir. 1987). In contrast, a mark is suggestive when it fails to immediately
convey such information, but rather, when used in conjunction with specified goods or services,
requires that a potential purchaser use his or her “imagination, thought or perception to reach a
conclusion as to the nature of [the] goods or services.” TMEP § 1209.01(a).
I. SPEEDY TENANTS is Not Descriptive of Applicant’s Services
The Examining Attorney has required the disclaimer of all wording in Applicant’s mark
on the grounds that it “conveys an immediate idea of one of the purposes of applicant’s services,
which is to swiftly procure tenants.” Office Action of April 13, 2010. However, the wording at
issue, when read literally, does not immediately convey this idea. SPEEDY is defined as
“marked by swiftness of motion or action”; See Exhibit A, while TENANT is defined as “one
who holds or possesses real estate…by any kind of right”. See Exhibit B. Taken together,
SPEEDY TENANTS conveys the image of possessors of real estate engaged in some type of
swift motion or action; that is, SPEEDY modifies TENANTS rather than the act of procuring
tenants.
However, the Examining Attorney is arguing that the relevant consumer would
immediately read SPEEDY TENANTS to mean SPEEDILY PROCURING TENANTS. This
meaning is not implicit in Applicant’s mark, and an additional mental step would be necessary
before a consumer would reach such a conclusion. More specifically, a consumer would require
additional thought or perception, upon encountering Applicant’s mark, before attributing
SPEEDY to the procurement of TENANTS, rather than to the TENANTS themselves. Such
thought or perception is the hallmark of a suggestive mark.
II. SPEEDY TENANT is Not a Term Recognized as Descriptive within Applicant’s
Industry
The Examining Attorney has also argued that SPEEDY TENANT is used as a term by
real estate rental services. Office Action of April 13, 2010. However, the two examples provided
by the Examining Attorney use the term SPEEDY TENANT as part of a larger descriptive
phrase, in which SPEEDY is used to modify something other than merely the word TENANT.
The Examining Attorney’s first example reads “[w]e specialize in…speedy tenant placement
services”. Id. The second example reads “[c]ore business is in speedy tenant finding”. Id. In each
of these examples, SPEEDY is clearly used to describe the method by which tenants are
procured – SPEEDY modifies ‘tenant placement services’ and ‘tenant finding’, respectively –
rather than merely the word TENANT on its own. Contrary to the Examining Attorney’s
assertion, the examples cited above do not establish that SPEEDY TENANT is common term
recognized as descriptive within the rental services industry.
An internet search of the phrase SPEEDY TENANTS further establishes that the term is
not used descriptively within by rental services. A recent Google search yielded only 22 pages
featuring the phrase. See Exhibit C. The majority of these pages were either on Applicant’s
website or otherwise referencing Applicant’s business. Only one result used the phrase SPEEDY
TENANTS in the descriptive manner alleged by the Examining Attorney – and that sole result
was part of a work of fiction featured on Google Books. Id.
III. Conclusion
Because SPEEDY TENANTS is not immediately descriptive of “an ingredient, quality,
characteristic, function, feature, purpose or use of the specified…services. In re Gyulay, 820
F.2d 1216, and there is no evidence that SPEEDY TENANTS is a phrase used descriptively
within the real estate rental industry, the wording in Applicant’s mark is not descriptive, and no
disclaimer is necessary.
In the Alternative, Applicant Should not be Required to Disclaim SPEEDY
Applicant contends that its proposed mark is not merely descriptive of Applicant’s
services, and that no disclaimer should be required. However, assuming arguendo that
TENANTS is merely descriptive of Applicant’s services and needs to be disclaimed, Applicant
should not be required to disclaim SPEEDY. For the reasons cited above, SPEEDY TENANTS
is not merely descriptive of Applicant’s services. Likewise, the word SPEEDY, on its own, is not
merely descriptive of Applicant’s services. Applicant seeks to register the mark for real estate
rental advertisement services, and there is no evidence that SPEEDY immediately conveys an
“an ingredient, quality, characteristic, function, feature, purpose or use of the
specified…services.” See In re Gyulay, 820 F.2d 1216.
 The Examining Attorney asserts that speed is descriptive of Applicant’s services merely
because Applicant seeks to facilitate the speedy procurement of tenants for its clients. However,
SPEEDY is no more descriptive of Applicant’s services than it is of most other commercial
services. Taken to its logical conclusion, the Examining Attorney’s assertion would mean that
SPEEDY is merely descriptive of any good or service which seeks to accomplish a result more
quickly than an individual client would be able to do in the absence of that good or service. A
search of live marks on the Principal Register reveals that the USPTO does not impute such
descriptive value to the word SPEEDY. See Figure 1, below, Exhibit D.

In each of these examples, the mark contains the word SPEEDY, along with at least one
other word which arguably describes the Registrant’s goods and/or services. In each case, it
could be said that the Registrant’s goods or services seek to deliver a product or result more
quickly than a client would be able to without the aid of that good or service, precisely as the
Examining Attorney has characterized Applicant’s services. However, in none of these cases did
the USPTO require the disclaimer of the word SPEEDY – in fact, in many of these cases no
disclaimer was required whatsoever. The fact that this appears to be a regular practice of the
USPTO indicates that the Office does not view SPEEDY as merely descriptive in the manner
asserted by the Examining Attorney.
Because SPEEDY is not used in a way which describes “an ingredient, quality,
characteristic, function, feature, purpose or use of the specified…services”, and the USPTO
regularly allows registration of marks containing but not disclaiming SPEEDY as discussed
above, no disclaimer of the word SPEEDY is necessary.

CONCLUSION
Even when doubts exist as to whether a term is descriptive as applied to the goods or
services for which registration is sought, it is the practice of the USPTO to resolve those doubts
in favor of the Applicant, and allow the mark to register. In re Grand Metropolitan Foodservice,
Inc., 30 USPQ2d 1974 (TTAB 1994). Therefore, Applicant respectfully requests that the
disclaimer requirement be withdrawn.
