21, 2018 of the Honorable Court, respectfully states:

Valenzuela City ;

2. That in compliance with the Order of the Honorable Court , petitioner is

COMPLIANCE

PETITIONER, through counsel, and in compliance with the Order dated May
11, 2018 of the Honorable Court, respectfully states:

1.Petitioner is a resident of No. 5 Maganda Street, Lena Subdivision,


Dalandanan, Valenzuela City;

2. That petitioner, in her petition, used the address at No. 6, Maganda Street,
Lena Subdivision, Dalandanan, Valenzuela City, the address of her sister and
mother located just beside her house due to the fact that she is presently
working abroad and instances might arise that no one would receive the
summons and legal processes emanating from the Honorable Court;

3. That in compliance with the Order of the Honorable Court , petitioner is


submitting herewith a Barangay Clearance from the Office of the Punong
Barangay, Hon. Danilo Padrinao stating that she is a resident of No. 5 Maganda
Street, lena Subdivision, Dalandanan, Valenzuela City and Meralco Electric Bill
as proof of her billing address and residency;

4. That hereto attached are copies of LBC Receipt as proof of submission of


copies of the petition together with the annexes to the Office of the Solicitor
General and the Office of the City Prosecutor of Valenzuela City.

PETITION

PETITIONER, through counsel, to this Honorable Court, respectfully states:

1. Petitioner is of legal age, Filipino, residing at No. 6 Maganda Street,


Dalandanan, Valenzuela City, Respondent is likewise of legal age, Filipino, residing at
No. 3 King Fisher Street, St. Francis Subdivision, Meycauayan, Bulacan where he may
be served with summons and other court processes;

2. Petitioner came to know respondent sometime in 1998. At that time, she


was already married to Yasuhiko Ito, a Japanese national. A copy of her Certificate of
Marriage with Yasuhiko Ito is hereto attached as ANNEX “A” and a copy of CRS Form
No. 5- Advisory on Marriages is hereto attached as ANNEX “B”

3. Respondent started courting petitioner so the latter informed him that she
is already married and actually came back to the Philippines to heal her broken heart
after her failed marriage with Yasuhiko Ito;

4. Despite his knowledge of petitioner’s earlier marriage with Yasuhiko Ito,


respondent continued courting petitioner, professed his undying love to her and
later proposed marriage with her;

5. Petitioner refused to get married to respondent but the latter explained


and assured her that since her husband is a Japanese national and is a resident of
Japan, they can lawfully get married here in the Philippines. He promised to attend
to everything and all that petitioner has to do was to be present on the date of their
marriage;

6. Believing respondent’s representation, petitioner married respondent on


March 16, 2000 in Quezon City. A copy of their Marriage Contract is hereto attached
as ANNEX “C”. A copy of the Advisory on Marriage dated December 15, 2017, issued
by the Philippine Statistics Authority is hereto attached as ANNEX “D’;
7. Copy of CRS Form No. 5- Advisory on Marriages dated December 15, 2017
showing the 2 marriages is hereto attached as ANNEX “E”

7. That a few months after her marriage with respondent, petitioner came to
know that the representation made to her by respondent is false and that their
marriage was unlawful and bigamous because her earlier marriage with Yasuhiko Ito
is valid and subsisting;

8. Petitioner refused to further live with respondent and since the year 2011,
she has been living in Dalandanan, Valenzuela City whereas respondent has been
living in Meycauayan, Bulacan;

9. The marriage between petitioner and respondent is void from the


beginning because of the existence of a prior marriage between petitioner and
Yasuhiko Ito;

10. It is submitted that based upon the foregoing, the marriage between
petitioner and respondent should be declared null and void from the beginning.

11. Petitioner and respondent were not able to acquire any property;

12. That the best interest of the parties will be better served if petitioner’s
marriage with respondent will be declared null and void.

WHEREFORE, it is most respectfully prayed of this Honorable Court that the


marriage between petitioner and respondent be declared null and void.

Petitioner further prays for such other relief and remedies just and equitable
under the premises.
