AFFIDAVIT OF DESISTANCE

I, CARLEEN M. DONATO, Filipino citizen, of legal age, a

resident of No. 006 National Highway, Gosi Sur, Tuguegarao City,
Cagayan, after having been duly sworn to in accordance with law,
do hereby depose and state:

1. I am the Complainant/Plaintiff and witness in the instant

case;

2. That the case arose in an incident that transpired sometime

ago in Quezon City;

3. That after a thorough examination and reflection on the

circumstances that transpired on the said incident, I
realized that it was purely accidental and a
misunderstanding of the parties involved in the incident,
and that nobody should be blamed;

4. Since I could not state with certainty and without doubt

the liability of the accused GRACE MATEA LUGARES, I feel
compelled to withdraw my complaint against him and I
clear him of whatever responsibility or liability in the said
case;

5. That in view of the foregoing, I am now retracting the

testimony I have given before this Honorable Court;

6. That in view of the foregoing, I manifest that I now

completely and absolutely exonerate the accused GRACE
MATEA LUGARES, from any liability in connection with the
above-mentioned criminal case and that I am no longer

 interested, and I hereby desist, in prosecuting the said
criminal case;

7. That I am aware that if the said case would be dismissed by

the Honorable Court, it could no longer be revived or
refilled;

8. That I execute this Affidavit of Desistance so that the

above-mentioned criminal case be immediately dismissed
and considered finally closed;

9. As such, I respectfully pray that the aforementioned case

against the Accused GRACE MATEA LUGARES be
dismissed and finally closed.
