STATEMENT OF RELATED CASES AND PROCEEDINGS

This case has previously been before this Court under the Case

Number 09-3403. Appeal was filed by the Plaintiffs’/Appellees’ in this case.

When an order to show cause was issued on the Plaintiffs, why they never

provided the transcripts on 08.07.09 hearing, they hastily withdrew their

appeal.

STANDARD & SCOPE OF REVIEW

The district court determined legal issues, not facts, on the motion

filed under Federal Rules of Civil Procedure Rule 12 challenging

jurisdiction under 28 USC § 1332. Appellant contends the District Court

erred in the formulation and application of legal precepts, and therefore

review in this case is primarily plenary. Appellants submit to this court, that

the district court erred in its decisions, showed bias and abuse of judicial

discretion.

was issued against him.”
