validis peritiis, confirmatis et factis et circumstantiis. Quare, nobis

videtur, sententia appellata confirmari potest.
9. – Denique quoad incapacitatem mulieris et viri sententia
appellata clara est ubi adfirmat: "With regard to the inability of
the bride and groom to assume the fundamental
responsibilities of marriage for reasons of a psychic nature...
Since the bridegroom claimed to have consulted the father of
the bride who advised him to let his daughter take a
medicine, Zyprexa Velotab 10mg, justifying this with the fact
that the daughter took it before the marriage, stopping her
recruitment later at the wedding, and that this influenced his
psychology negatively... Since the bridegroom counseling
with a psychiatrist has learned that this drug is administered
to patients with schizophrenia and bipolar personalities
(Schizophrénie-Bipolaire)... As the bridegroom stated in the
reconciliation session of January 28, 2014, that the duration
of the marriage was only six months, during which time the
bride did not take on the family responsibilities, also
behaving in a continually equivocal manner... given that the
bridegroom discovered in the last period of their common
life, following the confession of the father, that his wife is
psychologically ill and that it was already before the marriage
and that the father advised him to administer without her
knowledge Drug Zyprexa Velotab 10mg in water, a drug that
she refused to take to help her keep her ailments at bay
"(page 70).
Enim Ipsa sententia sublinet: "The accusations of the
bridegroom found echo in the report of the expertise drawn
up by Dr. Tahan... Dr. Tahan has inserted these
characteristics of the personality of the bride within the
context of the bipolar disorder (Trouble bipolaire) "(p. 78).
10. – Quoad incapacitatem viri bene sublineat sententia appellata:
"On the other hand, since it is evident from the bride's
opposed libel that she accuses her husband of being
insistent in wanting to set up a marriage of three; and that
the marriage for the bridegroom was only a social cover to
remove suspects from his sexual relationship with Mr. M ...
And since, the bride has again summarized her problems
with her husband before the Court in the following manner:
"At the beginning of our marriage we took care of arranging
and beautifying the house, but the problem we faced was the
presence of a third person in our life, that is the friend of my
spouse, who is called MJ, who He never separated from us,
spending the vast majority of his time with us, and the
strange thing was that Paul wanted his friend to accompany
us during our honeymoon "(Acts page 32, answer 5).
11. - Igitur saententia appellata adnotat: "That the bride's
accusations have been echoed in the report of the psychic
expertise presented by Dr. Tahan that illustrates the
characteristics of the groom's personality ... Dr. Tahan has
placed these characteristics of the groom's personality in the
context of perfectionist personality disorders (Trouble de
persormalité perfectionniste) with traits of anxious addictions.
Etiam "the bride's accusations also found correspondence in
the relationship of the opposing psychic expertise drawn up
by Dr. Haddad ... and that Dr. Haddad inserted these
characteristics of the personality of the groom in the context
of obsessive personality disorders (Trouble de personalité
obsessionnelle" (p.88).
Periti concludunt: "The personality disorders of the two
spouses go back to the period of the beginning of childhood
and therefore long before marriage ... And that the ailments
that the two spouses suffer affect their way of dealing with
each other and with the surrounding world; disorders that
have prevented them from entering into an interpersonal
relationship based on understanding and reciprocity on all
areas, emotional, moral, intellectual, as they lack the
affective psychic maturity required in this situation ".
Bene concludit sententia appellata: "The Court has reached
moral certainty in identifying psychic disorders that have
limited the will of both spouses in expressing their consent
correctly and therefore it is necessary to give a judgment
declaring the nullity of the marriage contracted between the
two parties because of inability of the spouse and of the
bride to assume the essential obligations of marriage for
reasons of a psychic nature ".
12. - Qualitatem quod spectat, de qua mentio fint in can. 1087, 8
nor trivial," et, insuper, quod "the terms used by the
legislators are not allowed to attribute a foreign significance
to the canonical tradition", sed oportet sit gravis ac seria,
scilicet, ut "as effectively stated by the rotal jurisprudence,"
prae persona intendatur” (cf. Allocutionem, dici 29 ianuarii a. 1993
ad R.R.T., in L'Osservatore Romano, 30 gennaio 1993, p. 1, n. 7).
13. - Meritum causae ingredientes, contendit actor se ob gravem
errorem circa mulieris conventae qualitates, in qua directe et
principaliter suum matrimonialem consensum direxerat invalide
contraxisse.
Indubium est actorem matrimonium inire statuisse
tantummodo ob singulares qualitates morales, quas exstare in
muliere putabat et prae omnibus exigebat.
Vir in gravem errorem incidisse circa qualitates in conventa
celavit.
Inito coniugio, apparuit defectus qualitatum, quas vir in
conventa exigebat. Mulier statim vitam impossibilem viro reddidit,
omnino diversum se ostendens a persona perdurante sponsalium
tempore ab actore cognita.
Ex tabulis processualibus incunctanter deprehenditur conventam
esse mulierem valde diversam quoad indolem et moralitatem a
sponsam quam vir noverat et ducere intenderat.
Actor ideo in gravem errorem incidit et tantum post nuptias
detegit conventam prorsus carere qualitatibus quas ipse ante
cognovisset.
Defectus qualitatum in muliere in peculiaribus rerum adiunctis, in
quibus actor versabatur, consortium vitae coniugalis haud dubie
graviter perturbare valuit et revera graviter perturbavit. De facto
vir, detecto errore, quam celere, communionem coniugalem
abrupit.
Error a muliere inductus, id est capacitas procreationis, in
matrimonium irritum reddit, quia qualitates a viro postulatae,
tamquam ad substantiam pacti matrimonialis pertinentes, omnino
in muliere defuerunt.
Vir actor directe et principaliter suum consensum in
qualitates morales conventae dirigere intendebat et indirecte et
subordinate in personam. In casu obiectum contractus, in quo
voluntas viri serio et principaliter directa fuerat, desideratur et ideo
ipsum matrimonium, ob consensus defectum, irritum evasit.

14. – Sententia appellata quod dolum bene sublineat:

"Regarding the malice that led to the error about a quality in
the person of the bride, it is clear from the book presented by
the groom that he accuses his bride of having deceived and
cheated causing him to fall into error about a quality that for
his nature makes the common marital life seriously
disturbed, having the wife hidden from her husband her
psychic illness that forced her to take the drug by the name,
Zyprexa Velotab 10mg, leading her to suffer from a situation
of hyperprolactinemia (Hyperprolactinémie) that prevents
procreation. All of this made him convinced that he had
fallen into error about a quality in the person of his bride
because his fundamental intention before marriage was to
form a family and have children ... So, it is necessary to
declare the nullity of this marriage because of the malice that
led to the error about a quality in the person of the
bridegroom "(pp. 56-57).

Igitur, in actis omnia elementa ad sententiam primi iudicii

gradus confirmandam certo certius inveniunt.
