: HOUSING SESSION

NYRIEL SMITH, et al., : J.D OF NEW HAVEN

Plaintiffs :
v. :

CITY OF NEW HAVEN, et al., :

Defendants : JULY 16, 2019

MOTION TO DISMISS

Defendants move pursuant to section 52-45a of the Connecticut General Statutes

and Practice Book §§ 8-1(a) and 10-30(a)(1) to dismiss the Complaint on grounds of lack

of personal jurisdiction. Plaintiffs’ Writ, Summons and Complaint fail to identify a return

date, creating an “unforgivable” defect in violation of Connecticut law, which deprives this

Court of jurisdiction over them.

A memorandum of law in support of this motion is attached hereto.
