In responding to a FOIA request, the Criminal Division’s search will include responsive
records in its control on the date the search began, Our search began on June 16, 2010.
As our December 13, 2010, letter explained, the Criminal Division located responsive
information that we determined originated ftom, or was of primary interest to, the Office of
Public Affairs (OPA). Consequently, we referred that information to the Office of Information
Policy (OIP) for processing and a direct response to you, OIP has reviewed the information and
determined that although it has equities in the information, the Criminal Division holds primary
equity in the information, Accordingly, OIP returned the information to the Criminal Division
for a direct response to you.
Enclosed, please find five e-mail messages (two pages) of information responsive to your
request. Three messages are being released to you in full; two messages are being released to
you in part. ‘The Criminal Division relied on the following FOIA exemptions to withhold the
‘e-mail address of Criminal Division employee and the name of a third party
Exemption 6, which permits withholding personnel and medical files and similar
files where disclosure would constitute a clearly unwarranted invasion of personal
privacy. 5 U.S.C. § 552(b)(6).Exemption 7(C), which permits withholding records or information compiled for law
enforcement purposes where disclosure of such records or information could reasonably
be expected to constitute an unwarranted invasion of personal privacy. 5 U.S.C.
§ 552(6)(7)(C).
