DEFENDANT’S UNOPPOSED MOTION FOR EXTENSION OF


TIME TO FILE REPLY BRIEF UNTIL AUGUST 14, 2006

Plaintiff filed its Opposition to Defendant’s Renewed Motion for Summary Judgment on

July 28, 2006. Defendant’s Reply Brief is currently due on August 9, 2006.

Defendant respectfully requests that the Court extends Defendant’s time to reply until

August 14, 2006, because Defendant’s counsel will be unable to work on this matter during the

week of July 31, 2006 due to previously planned annual leave.

Plaintiff’s counsel has informed Defendant’s counsel that Plaintiff does not oppose this

extension.
