User Guidelines for Daimler AG
Archive
The Daimler AG Archive is a
private archive. It is categorised
into four areas:
• Company archive
• Product archive
• Media archive
• Library
The archive can be accessed by the
general public on condition that
the following user guidelines are
observed:
The papers and documents archived
at the Daimler AG are available for
use by any person who can
demonstrate legitimate interest and
undertakes to observe the established
guidelines.
The formal user relationship shall
begin when Daimler AG has notified
the user of its permission to use the
archives.
Applications to use the Daimler AG
Archive must be made in writing,
with stated reference to the field of
work and disclosure of the expected
duration of such use.
Permission to use the archive applies
only to the stated field of work and
the confirmed period of use. If the
user changes its field of work, or
requires a longer period,
this must be indicated to the Daimler
AG Archive in writing.
If a user requires assistance or wishes
to use the services of a representa-
tive, a separate application must be
submitted.
User authorisation can be made
conditional upon meeting certain
conditions in the event that
the information in the application
does not apply or no longer applies,
the user breaches the
user guidelines,
a suspicion arises that the archives
are being exploited to the detriment
of Daimler AG.
Archived material is excluded from
use in the following cases:
if its exploitation is counter to
statutory legislation,
if it is subject to confidentiality
provisions,
if conflicting agreements have been
made with owners of borrowed
documents or with previous owners
(e.g. inherited estates, family
archives, incident and experience
reports, documentation in private
ownership).
Inspection of archived materials
containing confidential matter and
personal documents may be granted
following approval by the Archive
Management.
The media archive and the library
are not subject to embargo periods.
The technical archive and the
company archive are subject to an
embargo period of 40 years after
closure of the particular activity,
calculated from the date of the most
recent document or the most recent
registration of an archived item.
If an archived item was subject to
confidentiality provisions it can only
be viewed upon the expiration of at
least 60 years since the documents
were produced. If the purpose of the
research relates to a natural person,
the material may be used at the
earliest ten years after that person’s
death.
In making use of information
obtained from the archives, the user
is solely responsible for ensuring that
any copyright and privacy rights and
the legitimate interests of third parties
are upheld. Upon request, the user
must submit the relevant declaration
in writing.
Permission to use the archives in
which rights and/or the legitimate
interests of certain persons are
affected can be made dependent upon
the agreement of the affected party or
its successor in title and which must
be obtained by the user.
Paragraphs 1 and 2 also apply to
search aids and reproductions of any
type.
The presentation of archives and
search aids may be refused when
the high value, condition of
preservation, or state of order would
make this unadvisable,
the provision or procurement of an
archived item would require an
unreasonable cost outlay,
faulty information provided by the
user makes it considerably more
difficult to provide,
the archives are required temporarily
for the purposes of Daimler AG,
the purpose of the research can be
achieved sufficiently well by
inspection of printed matter or
reproductions held at the Daimler
AG Archive.
Daimler AG endeavours to ensure
that the descriptions and
identification of the archived items
and written material are accurate;
however, it accepts no liability for
any consequences arising from a
mistake in the presentation of
archived items and reproductions.
Daimler AG, its legal representa-
tives and its employees are liable for
any damages that may arise to users
on the company’s premises only in
the case of deliberate acts or gross
negligence.
Photography, the making of
photocopies and similar operations
are to be carried out by Daimler AG
itself, or commissioned from an
outside firm by Daimler AG, at the
user’s expense. The costs are
displayed on notices and upon
enquiry.
Archived material or reproductions
must not be passed on to any third
party.
The user undertakes to publish
information based on archived
material from the Daimler AG
Archive in a proper and professional
manner. Furthermore, the user is
prepared, upon request, to submit the
relevant passages of text within its
work prior to publication. Daimler
AG is not obliged to give a reason for
requesting such submission.
The user undertakes to provide, free
of charge and immediately after its
publication, a copy of the work that
has been produced with the aid of
documentary artefacts or
reproductions from the Daimler AG
Archive. This also applies to
unprinted work such as examination
work of all kinds.
The sources used must be stated
individually and in full.
During normal working hours,
members of staff at the Daimler AG
Archive are available to provide
advice within the bounds of
possibility. Such advice extends only
to reference to the relevant archived
material and literature, and to
presenting the relevant finding aids.
The archived items and written
material must be requested from
members of staff of the Daimler AG
Archive. The archived papers and
documents and the finding aids must
be used only in the reading rooms at
the Daimler AG Archive. They must
be handled with the greatest of care.
Printed matter must be left in the
sequence and in the state of order in
which it was presented. Before
leaving the Daimler AG Archive, all
archived items, papers and
documents must be handed back to an
employee of the Daimler AG
Archive.
Permission is required to use devices
such as a typewriter, PC, laptop,
dictation machine or calculator.
These guidelines come into effect on
1 January 2009.
