Defendant, by and through undersigned counsel, respectfully moves the Court, pursuant to
Fed. R. Civ. P. 6(b), for an enlargement of time to, and including, December 3, 2008, to file its
partial motion for summary judgment addressing the first part of Plaintiff’s Freedom of Information
Act (“FOIA”) request. Defendant’s motion is currently due on November 17, 2008, pursuant to
prior Order of this Court. This is defendant’s third request for an enlargement of time. Pursuant to
Local Rule 7(m), the parties conferred in this matter and Plaintiff consents to this request. A
proposed order granting this motion and proposing a new briefing schedule is attached.
There is good cause for the Court to grant this Motion. When undersigned counsel entered
a substitution of counsel in this case, the partial motion was due and the parties were discussing
issues relating to the search for and processing of emails responsive to the second part of Plaintiff’s
FOIA request. The parties are continuing to discuss this matter in accordance with this Court’s
Order of November 11, 2008 that the parties file a joint status report setting forth an agreed upon
proposed disclosure schedule by November 21, 2008. Undersigned counsel requires additional time

to review the case files, to confer and consult with agency counsel in finalizing a declaration, and
to draft the partial motion for summary judgment. The enlargement is also required due to the press
of other matters in this case and previously-assigned cases being handled by undersigned counsel,
The parties therefore propose the following revised briefing schedule: Defendant shall file
its partial motion for summary judgment addressing only the first part of the request no later than
December 3, 2008. Plaintiff shall file its opposition and cross-motion for partial summary judgment
no later than January 5, 2009. Defendant shall file its opposition and reply no later than January 26,
2009 and plaintiff shall file its reply no later than February 9, 2009.

ORDER
Upon Consideration of Defendant’s Consent Motion for Enlargement of Time to File Partial
Motion for Summary Judgment, and the entire record herein, it is hereby ORDERED that the
motion is GRANTED.
It is further ORDERED that the parties shall comply with the following briefing schedule:
