ORDER

Now before the Court are [23] [26] the parties' cross-motions for partial summary

judgment with respect to the first part of plaintiff's FOIA request. After full briefing on the

motions, the dispute has been narrowed to twenty-one documents withheld by defendant, in whole

or part, pursuant to FOIA Exemption 5. In support of its motion, defendant has filed the

declaration of Mark Hanson, a Vaughn Index and redacted copies of all of the disputed

documents. However, before resolving the instant motions, the Court has determined that

inspection of the documents in their unredacted form is appropriate.

Therefore, it is hereby ORDERED that by not later than August 7, 2009 defendant shall

submit to the Court under seal, for an ex parte in camera review, unredacted copies of the

documents identified in the Vaughn Index by the following numbers: 1, 9-25, 27-28 and 31

(unnumbered).
