Notice is hereby given that the defendant in the above-captioned case, the U.S. Department

of Homeland Security, hereby appeals to the United States Court of Appeals for the District of

Columbia Circuit from the District Court’s September 1, 2009 memorandum opinion and order

granting in part plaintiff’s motion for summary judgment and ordering defendant to disclose

previously-redacted portions of certain records that were withheld by defendant in its response to

plaintiff’s Freedom of Information Act request.
