review a recently completed
preliminary flood insurance
study and its accompanying
maps. Citizens will be able
to see how the updated maps
affect them and ask questions

to approve the map for Fort
Recovery sometime in the
near future, but modifications
to the map may take place
prior to that action.

has filed a re-zoning request
for land along Flaler Road.
A potential buyer wants to
build a duplex where he will
live on one side and rent out

10 YEARS AGO (2001)
The Mercer county Agricul-
tural Society, the county Fair
Board, will be celebrating its ses-
quicentennial in 2002. In prepara-
tion for their 150th anniversary,
the history of the local fair has
been compiled by Arnie Fast and
Jenny Miller, Fair Board Secre-
tary/Manager, in co-operation
with Joyce Alig of the Mercer
county historical Society.
Three women from coldwa-
ter have come up with a unique
idea to celebrate the Valentine
season. Joyce Westgerdes, carol
harlamert and Joann Schwieter-
man will clean from top to bottom
the home of a lucky person who
spends much time with a loved
one due to health reasons.
A couple of St. henry eighth
graders, Steve unrast, son of
Jerry and Kathy unrast, and Matt
Wermert, son of Don and Della
Wermert, are creating and draw-
ing a cartoon strip for the internet.

50 YEARS AGO (1961)
Tragedy hit the small village of
St. Wendelin Tuesday afternoon,
February 7, when a flash fire took
the lives of three young children of
the Orville Jutte family. Instantly
killed from burns and suffocation
were: cathy Jutte, 6; her youngest
brother, Billy, 22 months; and se-
verely burned was Richard Jutte,
3-1/2 years, who died later that
evening at Our lady of Mercy
hospital in coldwater.

an adequate airport serving Mer-
cer county and parts of Auglaize

reported that eighty percent of all
planes sold in 1960 were business
planes.
Just in case you missed
it, there was a news item the
other day titled, “Jobless rate
at 2-year low”. That may well
be the best item in the paper
for some time. The jobless rate
has dropped to 9.0 percent,
down from 9.8 percent in just
two months. That’s a sign that
maybe the recession has ended
as more than half a million
people found work in January.
Retail sales have reached a
five-year high. The unemploy-
State Supreme court Issues…DNA Testing

Television crime dramas
have made it abundantly clear
that DNA testing has revo-
lutionized criminal investi-
gations the way that finger-
printing did in its day. And
the process is still evolving.
The Ohio legislature enacted
our state’s DNA testing stat-
utes in 2003, and because of
constantly improving testing
methods, has amended them
twice since then.
Those improvements can
sometimes have an impact
on criminal cases that were
already decided. here at the
Ohio Supreme court we re-
viewed one of those cases that
involved older DNA testing
methods.
The case began in 1997,
when Dr. Margo Prade was
shot and killed in her van
while parked outside of her
medical office in Akron. Her
ex-husband, Akron Police Of-
ficer Captain Douglas Prade,
was tried for her murder.
The key physical evidence
was the bite mark that the
killer made on Dr. Prade’s
arm through her lab coat and
blouse. One expert, testifying
for the state, said that the bite
mark was “consistent with”
Douglas’s teeth but concluded
that “there’s just not enough
to say one way or the other”
that it was his, while another
expert testified that the mark
“was made by captain Prade.”
An expert for the defense
maintained that Douglas’s
loose dentures meant that “the
act of biting for Mr. Prade, is a
virtual impossibility.”
The state also offered
testimony from two eyewit-
nesses. One testified that he
saw Douglas near the murder
scene before the murder. But
he admitted that although he
learned of the murder the day
it occurred, he came forward
nine months later after months
of press coverage that had fea-
tured Douglas’s photo.
The other eyewitness testi-
fied that he was standing in the
parking lot when he heard the
possible killer’s car “peeling
off.” Although he admittedly
didn’t pay any attention to it,
and didn’t identify anyone in
his first two police interviews,
he later identified Douglas
during his third interview.
The defense called a wit-
ness who provided an alibi
for Douglas. That witness
ment figures have not been this
low since April 2009. Also,
the average hourly salary rose
8 cents to $22.86. That doesn’t
sound like much of a raise but
it was better than it dropping 8
cents. So, one can only hope
this is the start of a turn around
in the economy.
If it helps any at all, as you
read this there will be less than
40 days until SPRING!! I think
everyone is more than ready
for that date to come. I saw a
testified that she saw Douglas
exercising at roughly the time
of the murder. But the jury
found him guilty, and he was
sentenced to life in prison.
In 2004, Douglas filed an
application for post-convic-
tion DNA testing. The trial
court denied it, concluding
that Douglas did not qualify
for DNA testing because Ohio
law precludes post-conviction
DNA testing when “a prior
definitive DNA test has been
conducted.”
The trial court determined
that the DNA evidence that
was introduced at Douglas’s
trial had excluded Douglas
as the source of the DNA
samples taken from Dr. Prade,
thus making it “a prior defini-
tive DNA test.” The court of
appeals also dismissed his ap-
plication.
In 2008 he tried again, but
was denied once more. This
time, the trial court further de-
termined that Douglas failed
to show that additional DNA
testing would be outcome-de-
terminative, as required by the
law, because the prior DNA
testing had excluded him as a
source of the DNA, and other
evidence at trial supported his
convictions.
The court of appeals once
again affirmed the trial court
judgment. After that, the case
came before us for a final re-
view.
The law in question in this
case states that if an eligible
inmate submits an application
for DNA testing and a “prior
definitive DNA test has been
conducted regarding the same
biological evidence that the
inmate seeks to have tested,
the court shall reject” the ap-
plication.
The phrase “definitive
DNA test” isn’t defined in the
law. So the court of appeals
used a dictionary definition of
“definitive”: “serving to pro-
vide a final solution or to end a
situation.” Accordingly, both
the trial and appellate courts
concluded that the prior DNA
testing in this case was defini-
tive because it excluded Doug-
las. But we disagreed that the
prior test was definitive.
At the trial there were sev-
eral pieces of evidence tested
for DNA, including the doc-
tor’s fingernail clippings,
the bite mark, and a broken,
bloodstained bracelet. The
state’s DNA expert agreed that

quieted those critics regarding
him not putting a minority on
his cabinet. If I remember right,
I said he would fold under pres-
sure from the black minori-
ties. I really don’t think he had
a choice in the matter unless
he wanted to commit political
suicide.

to identify the killer.
During the attack, Dr. Prade
apparently tried to defend her-
self by using her arm to push
the killer away. The killer bit
her arm through two layers of
clothing – her lab coat and her
blouse – and left a bite mark
on her arm. using the testing
methods available in 1998,
experts were not able to iden-
tify any other than Dr. Prade’s
own DNA. Because Douglas
was excluded as a contribu-
tor to the DNA that was typed
in this case, the lower courts
concluded that the prior DNA
tests done in 1998 were defini-
tive. But, as Justice evelyn
lundberg Stratton pointed out
in writing our majority opin-
ion, “the only information
that the DNA testing on the
lab coat revealed was that Dr.
Prade’s blood was present on
her lab coat.”
So the “exclusion” basi-
cally excluded everyone other
than the victim. Therefore,
the exclusion was meaning-
less, and “the test cannot be
deemed to have been defini-
tive.”
Since 1998, DNA test-
ing has advanced so far that
“a DNA profile may now be
developed from items which
were previously unsuccess-
fully typed or potentially not
attempted due to the compro-
mised or limited nature of the
sample.”
Which means that im-
proved methods are now
available to provide new in-
formation that couldn’t be
detected when Douglas was
originally tried. We therefore
concluded – by a four-to-two
vote – that a prior DNA test
is not “definitive” within the
meaning of the law when a
new DNA testing method can
detect information that could
not be detected by the prior
DNA test.
Our holding in this case
was limited to situations in
which advances in DNA test-
ing have made it possible to
learn information about DNA
evidence that couldn’t even
be detected at the earlier trial.
We thus sent the case back
to the trial court, which must
now consider whether new
DNA testing could possibly
determine a new outcome in
this case.

Financial Gifts Can Bring
Smiles on Valentine’s Day
Each Valentine’s Day, Americans spend millions of dollars on candy
and flowers. These are fine gifts, but after the chocolates are eaten and
the roses have wilted, Valentine’s Day will just be a pleasant memory.
But if you want to give a present that can benefit your valentine for
years to come, why not give a financial gift?
Here are a few creative ideas for doing just that:
• Give shares of stock. Like everyone else, your valentine no doubt
enjoys certain products or services. So why not give her or him shares
of stock in the businesses that produce those goods and services?
Your valentine will enjoy being an owner and may well use this
newfound stock ownership to develop a greater interest in investing
— and investing can help all of us work toward our financial goals.
(Keep in mind that, if you are giving away shares of your own stock,
you should take note of your original purchase price; this information
will be needed for tax purposes should your gift recipient ever sell the
shares.)
• Contribute to an IRA. Does your valentine contribute to a traditional
or Roth IRA? If so, he or she is making a wise move, because an
IRA is one of the best tax-advantaged ways to save for retirement.
Consequently, you’ll be doing your valentine a great service by helping
him or her fund an IRA. (While you can’t directly invest in someone
else’s IRA, you can write that person a check for the same purpose.)
For the 2010 and 2011 tax years, the IRA contribution limit is $5,000,
or $6,000 for investors 50 and older. And contributions for 2010 can be
made right up until the tax-filing deadline.
• Make a charitable gift in your valentine’s name. Your valentine
may well support certain charitable, educational or civic groups. By
making a contribution to one or more of these groups, and designating
the gift in your valentine’s name, you will be doing a good thing for
your valentine, for the charity — and for yourself, too, because your gift
may earn you some tax benefits. If you simply give cash, you can write
off part of the value of your gift if it’s made to tax-qualified charitable
organization. And if you give an appreciated asset, such as stock, you’ll
also avoid paying capital gains taxes, because when the stock is sold,
it will be the charity, not you, taking the gain.
• Make a debt payment. You might want to volunteer to pay your
valentine’s car payment or credit card payment for a month, and then
encourage your valentine to put the savings to work in an investment.
The more debts any of us have, the less we have to invest for our
future.
• Check your beneficiary designations. If your valentine also
happens to be your spouse, you’ll be doing him or her a favor by making
sure the beneficiary designations are correct on your insurance policies
and investment accounts. Through all the events of life — marriage,
remarriage, new children — these designations can become outdated,
so you’ll want to keep them current.
By following any or all of these suggestions, you can help make
sure your loved one will feel the glow of this year’s Valentine’s Day far
into the future.

Celina Couple Receives Albert Heckler
Award from Cheryl Ann Programs
louis and Dorothy hoyng never imagined that they’d be-
come involved with cheryl Ann Programs.
they were raising three happy, healthy boys in their celina
home. louie operated his custom upholstery shop next door,
and Dorothy worked in the high school cafeteria. they were a
ypical family.
then a very atypical thing happened. their middle son,
Brian, was struck by lightning in 1981 when he was 16. With
hat bolt out of the blue, the hoyngs’ lives changed forever.
the odds of being struck by lightning are one in 280,000,
but the hoyngs couldn’t afford to spend much time thinking
about their terrible luck. they had a son who needed them
more than he ever had. the first years after Brian’s accident,
which left him with severe disabilities, were very difficult,
hey said, as they searched for someone who could help them
help Brian.
their school district helped as much as it could.Finally, then-

knew about but had never visited as parents: cheryl Ann.
“cheryl Ann was the best thing that ever happened to us,”
louie hoyng said. “it gave Brian his life back.”
the people of cheryl Ann helped Brian with his everyday
ife. they gave him a place to go and jobs to do. he made new
riends, and enjoyed everything about his experiences there,
up to and including the bus ride out to mud Pike.
“When he would see Sam morden (his bus aide) he would
ust smile, and the people in Adult Day Services really knew
how to make him laugh,” Dorothy hoyng said.
it wasn’t long before the hoyngs were finding ways to re-
pay cheryl Ann for its help. they were regular volunteers.
louie hoyng completed upholstery jobs for the unique
equipment used at cheryl Ann, and often, said Superintendent
mike overman, “louie would forget to send us a bill.” he

For all that, and for their tireless advocacy on behalf of

Stateline Writers meet
At the April meeting of the Stateline Writer’s club, members read
profiles they had written about someone, living or dead or make-
believe, and member eileen Whitsett’s special activity of having mem-
bers combine pictures of particular scenes with a person or people
assigned to them to put into that scene brought interesting results.
Sue miller and Gretchen Bollenbacher’s proposal for a special
meeting designed to attract new members was described and approved.

bers will rehearse for their special program in June.
Stateline club members meet the 3rd Saturday of each month at
10 a.m. at the celina mercer county library. Anyone interested in
coming to a meeting or becoming a member is cordially invited to
attend.

She was born December 22, 1923, in St. marys, to
the late William A. and ruth (Schelich) Bates.
She is survived by several cousins.
She was preceded in death by a sister, Patricia Ann
Bates and a half-sister, mary ellen Bury.
She retired from c.B.S. Automotive, celina, where
she worked from 1970-1990. She had also worked at
Stokely Van camp, celina, from 1949-1970.
She was a member of celina First church of God
and northmoor country club, celina. She was a 1941
graduate of celina high School.
Services were held at 1 p.m. February 8, at W.h.
Dick and Sons-hellwarth Funeral home, celina, with
rev. richard Van horn officiating. Burial followed
at elm Grove cemetery, St. marys. contributions can
be made to the charity of the donor’s choice. email

he is survived by a son and
spouse, Shane and Sheila Gass, celina; a son, Joshua
Gass, coldwater; three grandchildren, claire, cramer,
and campbell Gass; brothers and sisters, richard Gass,
Jr., Don and Jan Gass, Dianna Boughan, Judy harris and
Joan Smith, all of lima; numerous nieces and nephews;
his mother-in-law, maxine miller, coldwater; and two
sisters-in-law, Deb and ed Bennett, Dunkirk, indiana,
and mary and Paul chandler, muncie, indiana.
he was preceded in death by his father and father-
in-law.
he worked in masonry restoration for over 30 years,
and currently owned Brix restoration.
Funeral services were held February 5, at holy
trinity catholic church, coldwater, with Fr. richard
Walling, officiating. Burial followed in St. elizabeth
cemetery, coldwater. condolences may be left at

Charles W. Hoselton, 88, celina, died at 2:04 a.m.
on January 28, at St. rita’s medical center, lima.
he was born June 5, 1922, in chillicothe, to the late
Andrew W. and Fannie (clark) hoselton.
he was married April 28, 1946, to Betty Spaulding,
who survives.
he is survived by a son and spouse, charles
and nancy hoselton, union city, tennessee; three
daughters and spouses, roxanne and John houts and
trudy and Wayne Fisher, all of celina, and Sandra
and Pat Gillis, Dayton; eight grandchildren; 16 great-
grandchildren; a sister and spouse, Jacqueline and
