Respected Sir,

I am the concerned citizen who filed a vigilance complaint


dated 28-May-2009 with the competent authority (CVO of
IIMA) based on the best facts and information available to
me. In further reference to that complaint, on 28-May-2010
I wrote an email addressed to CVO of IIMA requesting him
for certain information and personal meeting. Copies of
some documents (including these two) are attached herewith
for your perusal. Needless to say that electronic
communications are also accepted as evidence by writ
courts (Ref: http://www.indiankanoon.org/doc/1031426/ and

Judgement).

Incidentally, I also happen to be employed with IIMA.


Taking unreasonable umbrage to my vigilance complaint,
filed as a concerned citizen, CVO has refused to take
cognizance of my emails. Even after repeated pleas by this
complainant who took a day off specifically for meeting
with CVO, CVO steadfastly refused to part with information
requested vide my email of 28-May-2010. Actually, this
complainant is entitled to much of the requested
information even without asking.

Not only that, CVO even insisted on me, the whistleblower


complainant himself, to furnish evidences related to the
complaint. Sir, I believe, this is violation of CVC Act/
guidelines/ circulars. Does the complainant have access to
institute records? If CVO expects complainant to furnish
evidences, than what is the job of Vigilance Department?

All these, even after the complainant had already taken


care (in the original complaint itself) to give details of
documents which were basis of vigilance complaint. Just
one specific example, please refer to point#h of an email
dated 03-Dec-2008 10:32 from CSC Chairman to the Dean
wherein he has accused an employee of “favoring a
particular vendor” in the multi-crore rupees ERP tender.
Sir, I believe, and hope your honor would also agree, that
this constitutes a strong basis for instantaneous
registration of vigilance complaint, and that Dean HIMSELF
is the competent authority, CVO under Vigilance Act.

Moreover, during our meeting of 31-May-2010, CVO insisted


to treat me, the citizen complainant, ONLY as an employee.
I was even denied entry into visitor’s register when I
came for meeting. Sir, let me draw real life similes,
one of my family premises (actually) has got a common
fence with IIMA. In case of a land boundary dispute
between my family and IIMA, would you follow it up
with me as an employee?
would it be fair for railways to follow-up a passenger
dispute with its employee, in case that passenger also
happens to be a railway employee?
going by CVO logic, no income tax department employee
will be able to appeal for his tax liabilities without
being subjected to humiliation by his superiors in
office.

And, in the instant case, I as an employee have also been


threatened of coercive actions (ref: last line of CVO
letter dated 24-Jun-2009) by CVO even without there being
any kind of inquiry whatsoever. Sir, this is unfair.

It appears that the very substance of vigilance complaint


is completely lost on CVO in this case of a complaint of
grave nature implying (ref: CVO letters dated 24-Jun-2009,
14-Aug-2009, 23-Apr-2010) CORRUPTION AT THE HIGHEST LEVEL
of IIM, Ahmedabad.

Sir, I am writing this email to you, Head of the


organization, to kindly ensure sanctity of vigilance
administration at IIM, Ahmedabad. It is my most humble
submission that CVO is the extended arm of CVC and can not
look into vigilance complaints as Dean to protect narrow

parochial interests of senior officials. Infact it is due


to such tendency of internal CVOs that CVC guidelines
suggests for an outsider CVO (Ref: DoPT O.M.NO.
372/8/99-AVD. III dated 18-Jan-2001 AND http://cvc.nic.in
/rnfcvo.htm).

Request your urgent intervention on priority basis to


restore some semblance of vigilance at the institute.
