8. Admitted to the extent that the post of Distt. Public Relations

Officer/Information Officer is a professional post in question. Keeping

in view the nature of duties & responsibilities of the post the

educational qualification has been prescribed to this post. Hence

relaxation in the recruitment & promotion rules can not be granted.

Moreover, such relaxation for a particular person for his benefit is

genuine. It is further submitted that the person who have gain the other

essential educational qualification for the post he could have gain the

experience also. The applicant is stressing for relaxation in the

recruitment & promotion rules for his own benefit which is not

justified.

9. The facts are wrong. The Respondent No. 3 never intimated the

applicant about rejection of his candidature and applications vide


Annexure: P-5. However, Respondent No. 4 vide Annexure: P-6

intimate the applicant about rejection of his candidature.

10. a. It is wrong on the part of the applicant that the respondents have

failed to implement the persons with disabilities (Equal opportunities,

Protection of Rights and Full Participation) Act, 1995. As a result of

implementation of this Act in letter & spirit the respondent department

has advertised the post of Distt. Public Relations Officer, reserved for

visually impaired. It other thing that the petitioner does not fulfill the

requisite educational qualification for the post and respondent

department can not relax the essential qualification to give benefit to a

individual person. However, as per the standing instructions of the

Govt. if the visually impaired person is not available this post can be

interchanged to other category of person with disability.

b) This is also wrong on the part of the petitioner that the respondent

department has failed to maintain 100 point roster to provide for the

recruitment of the disabled persons. The post of Distt. Public Relations

Officer/Information Officer advertised by the respondent department

has been made reserved to the person with disability i.e. visually

impaired person. Therefore, the action of the respondent department

itself shows that roster is being maintained in letter & spirit as per the

standing instructions of the Govt. in this behalf from time to time.

c) The respondent departments has prescribed the educational

qualification to the post of Distt. Public Relations Officer/Information

Officer in view of the nature of duties & responsibilities of the post.


Educational qualification for a particular post can not be prescribed at

the liberty/interest of particular person/candidate.

d) This is also wrong on the part of the petitioner that the respondent

State has failed to provide education for disabled specially the visually

impaired. The petitioner itself has obtained Bachelors Degree in

Journalism and Mass Communication from Himachal Pradesh,

University which is evident from Annexure: P-4.

e) The essential conditions prescribed in the recruitment & promotion

rules has been prescribed in view of the nature of duties &

responsibilities of the post.

f) The qualification can not be prescribed in the interest of the

petitioner. He has gained sufficient education qualification and he can

compete to other post in Govt. departments for which he fulfill the

qualifications.

g) The petitioner can compete to other posts for which he has acquired

educational qualification.

h) The respondent State is providing employment to the persons with

disability in different cadres and in the different department as per the

eligibility of such persons.

i) The Recruitment & Promotion Rules of the post of Distt. Public

Relations Officer has been framed under article 309 of Constitution of

India. Therefore, these rules do not violate the articles 14 & 16 of

Constitution of India.
j) The recruitment & promotion rules can not be relaxed qua to the

petitioner as these rules have been framed in view of the duties &

responsibility of the post.

k) During the recent past the education facilities in the State has been

increased tremendously and number of students has acquire the

qualification due to which desirable qualification has been prescribed

as essential.

l) The recruitment & promotion rules can not be amended on the

request of a individual person and for the benefit of a particular

person.
