BE IT ENACTED by the National Assembly of the Federal Republic of


'Nigeria as follows:

PART I - NIGERIAN CONTEN-T DEVELOPMENT IN O:L AND GAS INDUSTRY

1. N otwidnstanding anything to t11e contrary contained in the Petroleum Application of


the Act.

all matters pertaining to Nigerian content in respect of all operations or

transactions carried out in or connected with the Nigerian oil and gas industry.

2 (2) Compliance with the provisions of this Act and promotion of'Nigerian
3 content development shall he a major criterion for award of licenses, permits
4 and any other interest in bidding for oil exploration, production and development
5 or any other operations in Nigerian oil and gas industry.

25 a public review in relation to the exercise of any of its functions under this Act

26 provided that any such review or assessment is completed and certificate issued
27 or denied within 30 days from the date of commencement of such review or
28 assessment.
Contents of 29 10.- (1) A plan

3 (2) Any collective agreement entered into by the operator or other body

4 submitting the plan with any association of employees respecting terns and

5 conditions of employment in the project shall contain provisions consistent with


6 this section.

7 11.-(1) As from the commencement of this Act, the minimum Nigerian Minimum and

10 (2) Where a project description is not specified in Schedule A to this Act,

14+ (3) All operators, alliance partners and contractors shall comply with die

15 minimum Nigerian content for particular project item, service or product


16 specification set out in Schedule A to this Act.

17 12. Subject to section 7 of this Act, the Nigerian Content Plan submitted First

Submission of 15 18.-(1) The operators shall submit to the Board, thirty days prior to the

17 orders, exceeding S1,000,000 (USD), which will be bided or executed in the

18 upcoming quarter.
19 (2) For each contract, subcontract and purchase order, the list should

20 provide-
21 (a) a description of the service(s)/item(s) to be contracted/purchased

22 (material and equipment specifications shall be provided upon request)

23 (b) estimated value of contract, subcontract or purchase order;

24 (c) the Anticipated Request for Proposal (RFP) issuance date, RFP closure

25 date and award date; and


26 (a) any other information requested by the Board for purposes of

27 implementing the provisions of this Act.

Designation of 28 19. Subject to Section 17 of this Act, the Board shall advise the operator,

7 (c) a list of companies, indicating locations of head offices, to whom


8 questionnaires will be issued; and

10 Request for Proposals (RFP) or a Request for Quotations (RFQ).

11 21. For purposes of compiling a bidding list for any project, the operator Docuuteta to

19 (a) location(s) of any Nigerian based office, plant or facility;

20 (e) anticipated dates for closure of bids and award of contract or purchase
21 order; and

22 (t) any other information requested by the Board.

23 22. Prior to the award of contract or purchase order to the selected Documei:t to

25 (a) the name of the selected contractor or vendor; stage.

26 (b) a list of designated sub-contractors or sub-vendors;

27 (c) where applicable, a list of proposed sub-suppliers;

28 (d) for construction or service contracts; the estimated Nigerian


29 employment (inperson-hours);

30 (e) contract/purchase order commencement and completion dates;

31 (1) Award Notification Form signed by an appropriate official of the

12 23. Upon assessment of the documentation received in compliance with

27 (g) any other information required by the Board for purposes of

28 implementing the provisions of this Act.

Establ islunent 29 25. Where applicable. before carrying out any work or activity in Nigeria,

15 major contractors with a breakdown of the skills needed, anticipated skill

16 shortages in the Nigerian labour force, project specific training requirements,

17 and the anticipated expenditures that will be made directly by the operator

18 in implementing the E&T Plan as a forecasted and actual expenditures;

19 (b) a tinne frame for employment opportunities for each phase of project

20 development and operations, to enable members of the Nigerian workforce


21 to prepare themselves for such opportunities;

22 (c) the operator shall report to the Board quarterly on employment and

23 training activities for the reporting period and compare this to the Employment

24 and Training Plan. The quarterly report shall include number of new

25 employees hired during the year and their place of residence at the time of
26 hiring and their employment status; and

27 (tit any other information required by the Board for purposes of


28 innplennenting the provisions of this Act.

29 30. Where Nigerians are not employed because of their lack of training, Training of

Requirement 3 31.-(1) For each of its operations, the operator shall submit to Board a

Allowance for 10 32. For each of its operations, an operator may retain a maximum of five per
expatriates

Approval of 12 33. Upon the commencement of this Act, all operators shall make

Requirement 19 34. zNotwitlhstanding the provisions of the Schedule to this Act, all projects
for Labour
Clause. 20 or contracts whose total budget exceeds S100 million (USD) shall contain a

21 "Labour Clause" mandating the use of a minimum percentage of Nigerian

22 labour in specific cadres as may be stipulated by the Board.


Compliance 23 35. All operators and companies operating in the Nigeria oil and gas
with
\ioerianisation. 24 industry shall employ only Nigerians in their junior and intermediate cadre or

25 any other corresponding grades designatedby the operator or company.


Research and 26 36. The Minister shall make Regulations with requirements and targets

Regulations. 27 for the growth of Research and Development in the Nigerian oil and gas industry.

Programme 28 37. For every project for which a Plan is submitted, an operator shall
