General Rules
1.General Maintenance
1. All flats, yards, car parking areas and common space, shall be under the supervision of Flat Residents
Welfare Association (FRWA)
2. The flats are for residential purpose only and no owner/resident shall use the flats, premises thereto
directly or indirectly for any purpose other than residing. If anybody is found to use the flats/premises
for purposes other than what is mentioned above, the Association will without any notice evict such
occupants. The decision of the Association shall be final.
3. The owner/resident shall maintain the flats in good condition and repair. They shall be responsible for
annual repairs and maintenance as deemed necessary and required by the Association. In case of failure
to do so, such repairs/maintenance will be effected by the Association at the cost of such defaulted
members/occupants.
4. The Association shall be entitled at all reasonable times to authorize it’s officials/agents to enter the
property and the flats, inspect the same from time to time and also carry out such alteration of work
upon the premises as may be in the interest of the upkeep of the flats/building.
5. Owners /residents shall not assign any of their rights, let transfer or part with the possession of the
whole or any part of the property without prior written permission of the Association. The Association
shall not be bound to recognize any such transfer or assignment in favour of third parties and not
withstanding such purported assignment done contrary to this the owner/resident shall continue to be
liable to the Association for all the obligations in these rules.
6. The owner/residents shall not make any additions or alterations to the flat/common properties
without the written permission of the Association.
7. Religious ceremonies and other private functions and celebrations should be conducted in the flats
without affecting peaceful living of other residents. Functions with large number guests shall be avoided
in Flat.
8. Visitors shall report to the Security staff and write down their names and addresses along with the flat
number of residents whom they are visiting. Their vehicles shall be parked at the place directed by the
Security staff.
9. The owners shall let out their flat with the permission of the Association. The tenant shall take B Class
membership of the Association by payment of Rs.500/-and admission fees of Rs.100/- Rs.500/- is
refundable when tenancy is terminated.
10. Owners /residents shall pay the monthly maintenance charge as fixed by the Association from time
to time. The maintenance charge is collected to meet the expenses incurred on facilities and amenities
provided to the occupants such as water supply, security, sweeping of common areas, external lighting,
maintenance of common areas, lift, sewage treatment etc. Default in timely payments of maintenance
charges may result in curtailment of facilities, recovery measures etc. Payment to the Association shall
be made by cheque drawn at Aluva. Cash payment may be avoided and if any made shall be at the risk
and responsibility of the person concerned.
11. Staff appointed by the Association shall not be used for personal purposes during their duty time.
12. Members shall not use or cause to use the premises for any illegal activities.
13. Flats shall not be used for Film shooting of commercial nature.
14.Negligence willfully or otherwise on the part of any residents which causes inconvenience to other
occupants, affects the general amenities, cause to loss the common property shall entail punitive fines.
The person concerned shall make good of damages/loss as decided by the Association.
15. The residents shall give the bio-data in the prescribed form with details of family members, vehicle
numbers etc. at the office while occupying the flats. Changes in telephone number or other details shall
also be informed for up-dating the records.
V. Complaints/Repairs
Association shall ensure the supply of electricity and water up to the entry point of individual flats and
common area, lifts etc. Complaints regarding electric supply and water distribution inside the flats shall
be rectified by the residents at their cost and responsibility.

Bye Laws
I. Introduction
Flat, a Ground + 8 storied housing complex constructed facing Mana Lane, Thottakkatukara; Aluva-
683108 very near to NH 47 was inaugurated on . Sprawled across cents of land, flats
the complex has 47 flats with two lifts, common staircase and emergency exit way connected to each
floor. Except ground floor, all other floors are occupied with 2 numbers of 3 bed room flats and 4
numbers of 2 bed room flats, with two balconies each. Ground floor has office room and other service
areas. All the flat owners are provided with car parking facilities also.
II. Definitions
Iii. Objectives
a) To ensure a peaceful and harmonious community living among the residents of Flat.
b) To inspire fellow feeling and co-operation amongst the residents and to instill a spirit of oneness
among them.
c) To up-keep the maintenance of common civic amenities such as water supply, power supply,
lighting, drainage and sewage, clean and hygienic open space, common areas including
staircases, terrace, yard,ifts,regulatingparking space for vehicles, waste disposal system etc.
d) To arrange for necessary services such as security, plumbing, electrical, sewage treatment,
waste disposal, sweeping of floors and premises etc.
e) To maintain facilities such as office room and other common amenities.
f) To maintain electrical room lamp post, sewage treatment plant and fire-fighting equipments in
good condition.
g) To maintain the generator set providing alternate power generation, the room housing the
same with all its accessories and electrical fittings in good condition and within proper safety
standards.
h) To fix and collect funds for the maintenance of the aforesaid objectives from time to time.
i) To settle differences, if any, amongst the residents with regard to matters affecting common
welfare, and
j) To do such other works or acts as may be considered necessary and conducive for the well being
of residents and generally contribute to the value addition of community living at Flat.
IV Membership
a) Every flat owner or spouse of the flat owner has to become a member of the Association
compulsorily and has to abide by the byelaws of the Association.
b) Owner or hire-purchaser will be considered as ‘A’ Class member and tenant as ‘B’ Class
members.
c) Any heir, nominee or transferee may become an ‘A ‘Class member, only when admitted by the
Managing Committee. It is compulsory that tenants are required to become ‘B’ Class members,
while occupying the flat in Flat.
d) The owner of a flat shall become an A Class member of the Association, by remitting a non-
refundable membership fee of Rs.1000/-(Rs one thousand only) and a onetime admission fee of
Rs.100/-(Rupees one hundred only).Tenants should become ‘B’ class member by paying Rs 500/-
as one time membership fees and admission fees of Rs 100/.The ‘B’class membership ceases
automatically when such a member vacates the flat and Rs500/ is not refunded. If the same
tenant wishes to occupy the flat in Flat for a second time, he/she has to pay the non refundable
admission fee as well as the membership fee afresh.
e) Every member, whether owner, hire purchaser, heir, nominee, transferee or tenant shall jointly
be responsible for the timely payment of a monthly maintenance charge of a flat stipulated by
FRWA from time to time. This has to be paid promptly on the first day of every month, but not
later than 5th of the month, no matter whether the flat is occupied or not. Payments made after
5th of the month shall attract penalty at the rate of Rs50/ per month or such amounts may be
fixed by the managing committee from time to time.
f) Default of monthly maintenance charges, if any, on the part of the tenant shall be deemed as
dues from the owner.
g) Accumulation of arrears beyond 3 months may result in withdrawal of facilities / services
provided to the concerned flat, without any further notice.
Management of the Association shall be vested with the Managing Committee, consisting of 9
(nine) members elected from the annual general body FRWA.Efforts should be made to have
representation from each floor .Tenants can also be elected / nominated as members of the
managing committee, however the key posts like president, vice-president, secretary, joint secretary
and treasurer shall be held by the flat owners only. The president, vicepresident, secretary, joint
secretary, and treasurer will be elected from the managing committee members. The day to day
affairs of the association will be managed by the Managing Committee.
The Managing Committee members shall hold the office for a period of one year, and have option
for further continuation, if so decided and approved by the general body of the Association;
however no office bearer shall hold the same post for not more than two years.
1) President;-The president shall have over all control over the affairs of the association and shall, with
the approval of the managing committee, take necessary decisions regarding the administration of
Goldan Apple. He /She shall preside over the meetings of the Managing, Committee, the general body
and emergency general body meetings.
2) Vice –President;-In the absence of the president, vice-president shall preside over the meetings and
carry out the duties of the President. Vice-president shall assist the president as needed.
3) Secretary; - Secretary shall be responsible for the general administration of the Association. He /She
shall exercise such powers as may be delegated to him/her by the managing committee from tine to
time. He / She shall convene the meetings with the concurrence of the president and prepare agenda
for the meetings and keep records of the meetings and keep the managing committee members
posted with the details of the activities as and when required, besides implementing the decisions of
the committee from time to time .The secretary shall be assisted in the day to day running of the
activities by a committee of two members elected from the residents.
4)Joint secretary :- Joint secretary shall assist the secretary in his tasks and take over the functions in
his / her absence .
5) Treasurer :- Treasurer shall maintain the accounts of the association ,and shall present the
statements of accounts before the managing committee / General Body .The audited statement of
accounts shall be submitted in the Annual General Body meeting.
6) Managing Committee Member: - Managing Committee Member shall assist the President, Secretary
and Joint –secretary in the maintenance and management of Flat from time to time.
VI. ACCOUNTS:
1) The Association shall keep proper books of accounts .At the end of each financial year, the
treasurer shall submit the accounts to the managing committee for audit and approval , before
submitting to the General Body .
2) The Accounts duly presented before the Managing Committee shall be audited by two
members nominated by the General Body.
3) The audited accounts shall be placed before the General Body within two months from the
close of the respective financial year.
4) The president or secretary shall operate bank accounts of the Association jointly with the
treasurer.
1) The General Body shall meet at least twice in a year. The quorum for the meeting shall be 50% of
the membership direct or by proxy. In the absence of quorum, the meeting shall re-start after 30
minutes. The Managing Committee shall decide the date of General Body Meeting.
2) There shall be a minimum of 7 (seven) days notice for the General Body ,if not an
emergency meeting.
3) The secretary shall prepare the agenda for the general body in consultation with the managing
committee.
4) A member shall have only one vote in the General Body.A simple majority shall decide all matters
in the General Body.
5) In case of equal votes and a tie exist, the presiding officer shall exercise casting vote.
6) Every member is entitled to stand for election to any post. It is mandatory that such member
standing for election should not be a defaulter in payment of monthly maintenance charges.
7) The voting shall be normally by raising hands. However ,if circumstances warrant ,the presiding
officer shall be at liberty to conduct secret ballot to decide the majority in a democratic
manner ,which shall be binding on all concerned.
1) The committee shall meet at least once in two months and record the minutes.
2) If an elected member absents for 3 (three ) consecutive meetings with out intimation to the
president / Vice –president, he / she shall cease to be a member of the committee for the
remaining period of office. The resultant vacancy shall be filled up by nomination by the
managing committee
3) The Treasurer shall present in the committee meetings, a statement of income and
expenditure, of the intervening period between two meeting
IX. AMENDMENTS
Amendments to the bye-laws shall be passed in the General Body of FRWA.However ,if urgent
amendments in bye-laws have to be implemented in emergency situations ,the same may be
decided by the General Body .
