EXCERPT FROM THE MINUTES OF THE REGULAR SESSION OF THE SANGGUNIANG
BARANGAY OF BAGUMBAYAN, BULA, CAMARINES SUR HELD ON FEBRUARY 19, 2011 AT
THE BARANGAY SESSION HALL.

WHEREAS: Pursuant to the Constitution and being a Filipino citizen, it is our duty to become a
responsible person with only not only because of self interest but for the benefit of the
majority.

WHEREAS: Establishing of Pedestrian Signs, contribute not only for maintaining cleanliness but
it could help as income generating program as well as discipline of everyone is
concerned.

WHEREAS: It is also manifested that during a slow down or a stop in vehicular traffic
movement, no vehicle shall obstruct to any position of the lane so that it must always be
cleared and passable.

WHEREFORE: On motion presented by Hon. Emmanuel S. Faller, which was duly seconded by
Hon. Salvacion M. Nagales.

BE IT ENACTED by the Sangguniang Barangay of Bagumbayan, Bula, Camarines Sur in

session that:

Section 1: Title ± This Ordinance shall be known as Ordinance establishing pedestrian

sign/lane in front of Berona¶s Residence or Feed My People School within the
premises of Barangay of Bagumbayan, Bula, Camarines Sur.

Section 2: This Ordinance shall govern the imposition of changes within the
Jurisdiction/premises of the said Barangay of Bagumbayan.

Section 3: Rules and Regulation

 a.? It is prohibited to anyone violate for this Ordinance within the premises of
Barangay of Bagumbayan.
b.? Person will be caught violating such ordinances shall be penalized

Section 4: àenalty ± Anybody found guilty for violating said ordinance shall be punished by
a fine of as prescribe as follows.

a.? First Offense - The penalties are imposed of this ordinance is an

administrative fine of 200 pesos or a community service of (1) one hour to (2)
hours.

b.? Second Offense - The penalties are imposed of this ordinance is an

administrative fine of 300 pesos or a community service of 5 hours.

c.? Third Offense & Thereafter ± Fine of 500 pesos or a community service of 8
hours.

d. Subsequent Offenses - The violators will fine 1,000 pesos while their driver
license will be confiscated by Brgy. Police member assisted by Philippine
National Police(PNP), or Municipal Traffic Enforcer and requested and inform by
Brgy. Officials upon the implementation of this ordinance within the premises of
Barangay Bagumbayan.

Section 5: Pedestrian Crossing

a.? A driver approaching crossing shall travel as such speed that if necessary to comply
with their section. He will be able to stop his vehicle before reaching the pedestrian
crossing.
b.? A driver shall give way to any pedestrian who is on a pedestrian crossing.
c.? Same direction is stopped on the approach side of or upon the pedestrian crossing
apparently for the purpose of complying with this section

Section 6: Duties of Pedestrian

a.? A pedestrian when on foot way, marked cross, walk, or pedestrian crossing shall keep
as close as practicable to the right side of the foot way.
b.? When crossing in thoroughfare at an intersection shall keep right of pedestrian
crossing in the appoint direction.
c.? When crossing a thoroughfare or portion of a thoroughfare shall do promptly by
shortcut and most direct route as, may be practicable, to the thoroughfare boundary.

Section 7: Restriction of Pedestrians

A person shall not:

 a.? While waiting, to wait a vehicle stand on any position of thoroughfare.

b.? Proceed from a footway, towards a vehicle that has not fully stopped for the
purpose of boarding it.

c.? Alight from or board, a moving vehicle, or do so at an area, where loading and
unloading is prohibited.

d.? Remain on a pedestrian crossing or marked cross, walk longer than is

necessary for the purpose of passing over the thoroughfare within reasonable
dispatch

e.? Stand up a footway thoroughfare so as to inconvenience obstruct, hinder or

prevent the free passage of any other pedestrian or any vehicle.

Section 8: Pedestrian on Thoroughfare

Except, when there is a sidewalk , on footway, a pedestrian.

a.? Proceeding along a thoroughfare shall, when practicable, travel on the

thoroughfare or side of the thoroughfare used by vehicles travelling in the
opposite direction and shall keep as close as he can to the boundary of the
thoroughfare on his left.
b.? Shall not proceed along the thoroughfare abreast of more than one other
pedestrian, except in a procession or parade authorized by the proper
authority.

a.? Pedestrian - person travelling on foot, a walker

b.? Crossing - a place at which roads, lines, or tracks intersect an
intersection
c.? Vehicle - a device or structure for transporting person
d.? Duties - an act or a course of action that is required of one by position, social
customs, law or religion.
e.? Footway ± a walk or path for pedestrians
f.? Thoroughfare - A main road or public highway.
g.? Proceed - To go forward or onward, especially after an interruption; continue
h.? Prohibited ± To forbid by authority
i.? Inconvenience - The state or quality of being Y

j.? Passage - A movement from one place to another, as by going by, through,
over, or across; transit or migration, (b) The process of elapsing (c) Enactment
into law of a legislative measure.
k.? Travelling - To go from one place to another, as on a trip; journey.
l.? Authorized - To grant authority or power to.; To give permission for;
sanction; To be sufficient grounds for; justify.
 m.? Authority - The power to enforce laws, exact obedience, command, determine,
or judge.

Section 10: Repealing Clause ± All ordinances, rules and regulation or parts thereof, whose
provisions are in contrary to the provisions of this ordinance, are hereby repealed,
amended and/or modified, accordingly.

Section 11: Effectivity ± This ordinance shall take effect immediately upon its approval.
