COUNTY OF WELD ) ss. AFFIDAVIT

In support of a request for the issuance of a warrant for the arrest of Robert Laurendo Montoya, dob/
011892 (hereinafter referred to as "Defendant"), the undersigned affiant, being first duly sworn upon oath
deposes and says:

That affiant has knowledge of the following facts from which there is probable cause to believe that:

C.R.S.18-3-402(2)( d) Sexual Assault on a Child (pattern of abuse), class F3

hereafter described, was committed by the Defendant on or about October 2009 through February 2010,
in the County of Weld, State of Colorado, to-wit:

Your affiant is a police officer for the Greeley Police Department and has gained the following
information from reading the reports and speaking to fellow officers, from reading the statements of the
victim and witnesses and through personal investigation.

On 032810, Ofc. CoggswelJ with the Greeley Police Department was dispatched to , Greeley,
Weld., CO to investigate a runaway juvenile complaint received from Ofc. Coggswell made contact
with at 2213 hours on 032810 and learned from that her daughter had
not returned home from a birthday party she was planning to attend.

According to left home at approximately 1540 hours on 032810 and stated she was
walking to a her friend z's residence at in Greeley. told
she was going to get a ride to a's residence from 's residence to the birthday
party and would be home around 1900 hours. At 1900 hours, there was no sign Of After waiting
for some time, made several phone calls to , and others asking if
they knew where was. Nobody spoke with stated they had seen at
any time during the day and did not know where she was. Ofc. Coggswell did enter as a missing
juvenile in the CCIC/NCIC system immediately following the report he took from

stated did walk out the front door of t on 032810 at 1540 hours and
has not been seen again.

Upon reviewing the runaway report the foHowing day, Det. Christian Morgan was assigned to review this case.
After an extensive search involving numerous contacts during 032910 and 033010, there were still no leads
regarding s whereabouts. A decision was made to contact the Federal Bureau of Investigation due
to the possibility had been abducted and moved from the area. During the next two weeks, mUltiple
interviews were conducted, an extensive ground search, and neighborhood canvass took place, roadblocks, and
polygraph tests were performed.

Oet. Morgan had spoken extensively with regarding friends and others would
associate with. did confide in Det. Morgan that her daughter did have a boyfriend named Robert
Montoya, dob/011892 who lives at 3770 W. 24th St. #GI7, Greeley, Weld, CO. disclosed that Robert
Montoya had moved into her residence sometime in October of2009 because Robert's own mother, Roxanne
Montoya had asked both Robert and her daughter to move out so she could develop a relationship
with Jonas Garcia. Roxanne Montoya was not allowed to have Jonas Garcia visit her at her residence because Jonas
is a registered sex offender and was precluded from being around children.

further disclosed to Det. Morgan that while Robert Montoya was living at her residence, along with
her son ), and her son , that she was under the
assumption Robert Montoya and were good friends. stated she did not initially
observe a physical relationship between Robert Montoya and however she did begin to see signs of
this relationship in December of2009. stated she did begin to find Robert Montoya and
alone together in s bedroom even though she never found them engaged in sexual
behavior. Both and reported Robert Montoya became very protective of
as well.

stated she did confront both Robert Montoya and during the first week of January
20 I 0 about the type of relationship they were having. It was at this time Robert Montoya and
admitted they had been involved in a sexual relationship in the past and currently considered themselves each others
respective boyfriend and girlfriend. stated she immediately told Robert Montoya to leave her residence
and to cease any relationship he had with stated was very angry with
her but she eventually stopped talking about her relationship with Robert Montoya and seemed to be moving past
him. did state she found and Robert Montoya together again in February 20) 0 near
2811 28 th St. at an abandoned car dealership and she again told Robert Montoya he was not allowed to see

During a subsequent interview with Robert Montoya, he did admit to Det. Morgan he had been involved in a sexual
relationship with up until the middle of February 20 I O. Robert Montoya admitted to having sex
with on numerous occasions and stated would frequently try and get him to
physically abuse her during their sexual encounters. Robert Montoya did deny physically abusuing
during sex or other times but did admit he knew was only twelve years of age and he was an adult.
During interviews with friends, it was also learned had made some comments
about possibly being pregnant.

Robert Montoya also told Det. Morgan his relationship with ended in the middle of February after
had found them talking again. Robert Montoya admitted to continuing to try and see
and stated on some occasions, he would hide in bushes outside her residence and did attempt to make contact with
her at the Brentwood Middle School where was a student. (Greeley Police Officers were
dispatched to the Brentwood Middle School on 021910 under incident #43167 and did make contact with Robert
Montoya who was observed looking in the windows.) Robert Montoya told Det. Morgan that on one of these
occasions when he tried to make contact with at the Brentwood Middle School she called him a
"stalker freak" and told him to leave her alone.

Based on the statement made by Robert Montoya admitting to having sex multiple times with to
Det. Morgan and Robert Montoya and admitting to having a sexual relationship to in
addition to Robert Montoya being aware of the age of Robert Montoya did have sex with a child.
As of 051910, efforts to locate have been unsuccessful.

The Defendant'S date of birth is 011892. The defendant, Robert Laurencia Montoya, is a Hispanic male,
HEIGHT 6-0 , WEIGHT 190 Ibs., brown HAIR, brown EYES. The Defendant's last known address is
3770 W. 24th St. #GI7, Greeley, Weld, Colorado.

The above-described events took place in Weld County, Colorado .
