WHAT IS CHEXSYSTEMS?
Cheryl wrote a few bad checks her first year in college when she was 19. After some
time she paid all the bank overdraft fees, and paid off the people who received those
bounced checks. Her parents who were helping her insisted that she close the bank
account. Three years later... she was about to graduated... a little older, and a little more
mature. She tried to open a new checking account. Every bank she applied to rejected
her because she had a negative record on file with ChexSystems.
This is a true story! Your personal story may be different... but this basic scenario
is very common and has happened to thousands of people... including me. This
is why I created this eBook. My Story
What happen to Cheryl, and to you, was when you applied to open a checking
account, the bank or credit union ran your name to make an inquiry through a
database that will tell them if you have had: frequent account overdrafts...
bounce checks... did something banks consider as an "act of fraud" or otherwise
have an unpaid balance owed to another bank on a closed account.
A retail grocer who was tired of getting bad checks, came up with the ideal, and
originally created what is now know as ChexSystems. He recognized business
institutions needed a way to share information to help stop account abuse and
fraud.
The ideal quickly caught on and rapidly grew. For nearly 30 years now,
ChexSystems has been a central provider of account abuse and fraud
information to the U.S. banking industry.
ChexSystems is merely one of the companies that EFunds owns. Many people
may not have heard of them, or ChexSystems, until that very moment when they
are denied from opening a bank account.
Efunds... the company that owns ChexSystems, Deluxe Corporation, also owns
Current Checks (a.k.a. Checks Unlimited), Designer Checks, SCAN (Shared
Check Authorization Network), the Debit Bureau, which tracks your check-writing

HOW CHEXSYSTEMS AFFECTS YOU
When you apply to open a new account at a bank that is a member of, and uses,
ChexSystems Inc. they will run a ChexSystems inquiry as part of their new
accounts procedures.
Your CheckSystems report can remain in their database files for 5 years.
Critics of the ChexSystems database say that in many cases, it is arbitrarily used
to disproportionately treat people. Many people in ChexSystems are not people
who committed an intentional act of fraud; they’ve only had an incident, or two, of
misjudgment.
They usually are of modest means. People who many banks assume will not
maintain high balances in their accounts and will not be very profitable for the
bank.
There has been an ongoing criticism that feels many banks are using
ChexSystems as an excuse to weed out low-yielding customers.
Denied access to checking, those stuck in ChexSystems are forced for five years
to use expensive check-cashing services and to undergo the inconvenience of
paying bills with money orders or cash.
The system currently contains approximately eight million names and is used by
banks to track people with histories of checking account problems.
Reports from those inside the banking industry say that on average associated
administrative cost on new accounts can be approximately $200.
We all know the basic concept that banks make their money by lending out the
money maintained in checking and savings accounts.
Those who have been reported to ChexSystems do, as a group, carry lower
balances in their accounts. Often they are those whose payroll check is
deposited on payday Friday, and at or near zero balance before next payday.
Checking accounts do not generate a lot of revenue for the banks to begin with,
and certainly not accounts that on average maintain a nominal balance.
Critics of the system feel it has very little to do with your true risk as an account
holder. It has everything to do with the bank's bottom line. Never mind the fact
that millions of Americans are harmed in the process.
Banks benefit from the protection given to them with heavy government
regulation. But with this benefit comes some responsibility to serve the public…
something the banks are escaping, legally!
Government, by letting this continue, is failing its citizens who now have no way
to exchange the benefits of their labor (e.g., direct deposit of their pay) for goods
and services.
In addition, more and more landlords, and other organizations, are now requiring
a checking account as a minimum requirement.
If your name winds up in the ChexSystems database, you could find it extremely
difficult to open a bank account.
It is very important to know that ChexSystems only maintains the database of
names! The decision of whether, or not, to deny someone from opening a bank
account is strictly up to the individual bank and their policies.
If you have been denied from opening a bank account, we know that it can create
a number of major inconveniences in your life. However, there is assistance
available to you! Most all of your options fall into one of three basic categories:
NON-CHEXSYSTEMS BANKS Some estimates say that over 85% of the banks
and credit unions in the U.S. are members of Chexsystems. So finding a bank
that dose not use them can definitely be a real challenge. But they are out there.
In addition… some banks that do use Chexsystems are realizing that
automatically denying everyone that has a Chexsystems report (over 8 million
people) is simply not smart business. Those banks look at the circumstances of
each case individually. Those banks have accounts with names like fresh start
checking, second chance checking, etc.
USE OTHER PERSONAL FINANCE SERVICES If you really don't have a need
to write a paper check, then many people don’t really need to use the banks at
all! Anyone can get a Secured Personal Money Account with Direct Deposit of
your paychecks, ATM cards with a VISA or MasterCard logo, Online Bill Pay
Services that includes the ability to send anyone a check directly from your
compute. No Chexsystems checks! Everyone is approved!

Notices
You have a right to dispute any item of information contained in your consumer file. If
you believe information in your file may be inaccurate or incomplete, please submit your
dispute to the address or fax number listed above. Please be certain to include your
Consumer ID number, the source of the information you are disputing and the nature of
your dispute. Under normal circumstances, ChexSystems will inform you of the results
of the investigation within approximately 30 days (21 days for residents of Maine).
You may be entitled to place a statement of dispute on your consumer file. Your
statement must not exceed one hundred words (200 words for residents of Maine). Your
statement must not include the names of other individuals or businesses. Your
statement must pertain to the information contained in your consumer file and must not
contain profanity. You may submit your statement to the address or fax number listed

Obviously, the only reason why most people start looking for information about
Chexsystems to begin with is because they just got denied from opening a bank

Under the Fair and Accurate Credit Transaction Act (FACTA) amendments to the
Federal Fair Credit Reporting Act (FCRA), you are entitled to a free copy of your
consumer report, at your request, once every 12 months.
So you can see why most people never pay for their Chexsystems report. You

In certain states you may also be entitle to a free ChexSystems Report by mail or
over the internet if you meet the following criteria:
Obviously since the absolute best outcome is to have your name completely
removed from ChexSystems; this section has tips, advice, and suggestions to
accomplish that.
As said before in this guide… ChexSystems is subject to the same federal laws
as the credit bureau. The FCRA (Fair Credit Reporting Act); and the FDCPA (Fair
Debt Collection Practices Act).
FIRST: You are entitled by law to challenge any and all items on your report.
SECOND: The burden of proof rests on the bureaus to prove the information is
right. NOT for you to prove to them it is wrong
These four simple yet powerful requirements has been the source for thousands
of people to have negative information deleted from Equifax, Experian, Trans
Union… and ChexSystems.
It is estimated that as many as 75 to 85 percent of all credit reports from the main
three credit bureaus contain credit reporting errors. It’s a sure bet that the
inaccuracy rates for ChexSystems is also very high.
Because of these laws, you can legally dispute any item on your ChexSystems
Report that you believe to be inaccurate and/or incomplete information. Once
your dispute has been received, then an investigation must be conducted. The
results of the investigation must reach you in a reasonable amount of time
(generally believed to be 30 days).
The FCRA gives you specific rights, as outlined below. You may have additional
rights under state law. You may contact a state or local consumer protection
agency
or a state attorney general to learn those rights.
Access to your file is limited. A CRA may provide information about you only to
people with a need recognized by the FCRA-usually to consider an application
with a creditor, insurer, employer, landlord, or other business.
You must be told if information in your report has been used against you.
Anyone who uses information from a CRA to take action against you-such as
denying an application for credit, insurance, or employment-must tell you, and
give you the name, address, and phone number of the CRA that provided the
consumer report.
You can dispute inaccurate information with the CRA. If you tell a CRA that
your file contains inaccurate information, the CRA must reinvestigate the items
(usually within 30 days) by presenting to its information source all relevant
evidence you submit, unless your dispute is frivolous. The source must review
your evidence and report its findings to the CRA. (The source also must advise
national CRAs-to which it has provided the data-of any error.) The CRA must
give you a written report of the investigation and a copy of the revisions made to
your information if the investigation results in any change. If the CRA’s
investigation does not resolve the dispute, you may add a brief statement to your
file. The CRA must normally include a summary of your dispute statement in
future reports. If an item is deleted or a dispute statement is filed, you may ask
that anyone who has recently received your report be notified of the change.
You can dispute inaccurate items with the source of the information. If you
tell anyone-such as a creditor who reports to a CRA-that you dispute an item,
they may not then report the information to a CRA without including a notice of
your dispute. In addition, once you’ve notified the source of the error in writing, it
may not continue to report the information if it is, in fact, an error.
Outdated information may not be reported. In most cases, a CRA may not
report negative information that is more than seven years old; ten years for
bankruptcies.
You may choose to exclude your name from CRA lists for unsolicited credit
and insurance offers. Creditors and insurers may use file information as the
basis for sending you unsolicited offers of credit or insurance. Such offers must
include a toll-free phone number for you to call if you want your name and
address removed from future lists. If you call, you shall be kept off the lists for
two years. The toll-free number for all of the national CRAs is 1 888 5OPTOUT (1
888 567 8688.) If you request, complete, and return the CRA form provided for
this purpose, you shall be taken off the lists indefinitely.
You may seek damages from violators. If a CRA, a user or (in some cases) a
provider of CRA data, violates the FCRA, you may sue them in state or federal
court.
The FCRA gives several different federal agencies authority to enforce the
FCRA:
Before you do anything your very first step is to obtain a copy of your actual
ChexSystems report, so you can see exactly what’s there and what the banks
are looking at.
Disputing your ChexSystems report is the first thing you should try. Just simply
disputing what ever is there. Maybe it truly is incorrect! Or maybe it is true… but
the huge bureaucracy between both ChexSystems and the bank will fail to
respond within 30 days
If there is no reply back to you at all within 30 days, then you send a follow up
letter back to them. Let them know in writing that it has been over 30 days and
according to the FCRA they are required to remove the information.

NON CHEXSYSTEMS BANKS
Our website Chexsystems Solutions has been in business since about 2001.
Back then there were simply not as much options available for people who were
in Chexsystems.
If you think about it, the world has significantly changed in since 2001. People
started using debit cards! People started using online bill pay services. People
began writing paper checks less, and less. And, if you notice there are many
stores, and business, that really prefer that you didn’t use a check. In fact, there
are a lot of places that will take your paper check… run it through just like a debit
card… and then give the check right back to you!
In addition to this… there are simply much more resources, options, and
alternatives now for people in Chexsystems! For all of these reasons we
discontinued maintaining a Non Chexsystems Bank List.
There are still companies on the internet that will attempt to sell you a list of Non
Chexsystems Banks. We strongly recommend that you Do Not pay anyone for
such a list. It is simply no longer possible to truly maintain an accurate list. Banks
start using Chexsystems… stop using Chexsystems… then start again. Things
change everyday!
And now there are many banks that do use Chexsystems but will not
automatically deny someone. Most recent estimates say there are over 8 million
people in Chexsystems. Banks are in business to make money and they are
loosing a lot of potential money by simply saying no to everyone. It is just not
smart business. Therefore these banks will look at everyone on a case by case
basis!
There is an absolutely free online resource available that has links to these
banks. They also say it also includes Non Chexsystems Banks,
Also we have had more than one suggestion that you get better success applying
at one of those satellite bank locations that may be in your local grocery stores,
Wal-Mart’s, etc then going into a main bank branch. Apparently those satellite
locations need more customers.
However, there are also a lot of banks who realize that simply automatically
denying everyone who has a Chexsystems file is not really good business. Those
banks will make a decision on a case by case basis.
You might have heard of accounts under the names: second chance checking
accounts, fresh start checking accounts, opportunity checking, bad credit
checking account, etc. For the most part, these accounts are designed
specifically for people who may have past banking issues. The bank already
knows that you need help, and that’s exactly what these bank accounts may
accomplish.
There are several nationwide banks in the United States that may approve you
for a second chance checking account while having a negative item listed on
your Chexsystems report.
Keep in mind that, as always, the final decision is up to the particular bank. This
is only a convenient directory to help you locate the bank, their website, and
physical location.

The statistics are significantly clear that people in Chexsystems also may have incorrect
or misleading information on their main credit reports. There are only 3 major credit
bureaus in the U.S. Experian, Equifax, and Trans Union.

INTERNET BANKS:
This may be a solution. Internet Banks are nearly as convenient as a local bank. Is it
really necessary for you to be walk inside, and stand in line at a bank? Obviously
internet banks have a building and a staff of employees somewhere.
However, all of their services can be completed online. They have a track record of not
using ChexSystems at all, or not automatically denying your account based solely on
your ChexSystems report. Every bank listed below has previously granted people new
accounts that are listed in ChexSystems.

FILE A BANK COMPLAINT
Feel like you may have been mistreated by a bank? Think they may have
violated some laws in the way they handled your situation?
We’ve included this section due the amount of feedback we receive from people
feeling they were mistreated by a bank employee or manager. And that the bank
sent erroneous information to Chexsystems.
Also it can often be the bank’s mistake that resulted in your name being to
ChexSystems. This is exactly what happened in my case.
We received an email from Angela. And in her case she had documentation to
show that the dispute was clearly the banks fault. They closed her account, and
reported her to Chexsystems solely because of an error that they had made. She
decided to file a complaint in the state the bank was located. She included all her
documentation and the letters that she had sent to the bank for which, the bank
never responded.
Banks and other financial institution do have governing officials that they have to
answer to. Many of these are officials for the state in which the bank is doing
business in.
The offices listed below regulate and supervise state-chartered banks. Many of
them handle or refer problems and complaints about other types of financial
institutions as well. Some also answer general questions about banking and
consumer credit.
If you are dealing with a federally chartered bank, and feel you have been treated
inappropriately, not responding to your situation, etc. you can contact the office in

MY STORY
The reason why this website was created is due to my own personal experience
with Chexsystems.
About 10 years ago I had a 1 bedroom condo and got into some dispute with the
owner’s association. As often is the case, I can’t even remember what it was
about now, but I stopped paying the monthly dues. This went on for about 8
months and then one day my ATM card didn’t work… it gave me a message to
“see your bank.” It was SunTrust and when I spoke to them they said my condo
association got a court order to levy the account.
For those who may not know… a bank levy means the account is frozen and the
bank is ordered to send your money to the court by whatever date is on the
order. It is suppose to only be for the amount that’s on the court order. Or, if you
don’t have that amount in your account then the bank sends what ever is there.
Well… the judgment was for approximately $700. I only had about $400 in the
account. Somebody at SunTrust screwed up and sent the courts the $700. Then
a couple of weeks later sent me a notice saying I was overdrawn! So, I’m sure
you can imagine what my response was. The account was completely frozen… I
could not even use the card to do a balance inquiry. So obviously I couldn’t have
done it. They either accept their mistake, or find the employee that actually did it
and have them repay. I already had another account at Wachovia and I wasn’t
feeling all that great about SunTrust anyway, so it was very easy to ignore them.
About 3 years later, I wanted to get business account. Another bank had a better
deal than Wachovia so I went to apply. I never had any problems opening an
account before and didn’t even think about it one way, or the other. But I’m sitting
at the desk, the lady’s talking on the phone and it does sound like some kind of
credit check. I’m thinking they’re running a credit check just to open up a bank
account? Then I hear her say the name SunTrust.
I honestly had forgotten all about them! So the lady hangs up the phone and just
says “Can’t do it… SunTrust says you owe them money and reported you to
Chexsystems”
It was absolutely amazing how her whole entire attitude completely changed
after she hung up that phone. She just said you need to contact Chexystems. A
security guard was there and they practically threw me out! To be fair, it was
right at closing time and I was next to the last customer. But they were definitely
ready for me to get out of their bank.
So, I’m sure you know the rest. I went home, got on the computer and
immediately started searching for information about Chexsystems. At that time I
thought it was Checks Systems. This was about 2001 and there was a whole lot
less information about them on the internet then there is now. I was already
associated with Consumers Info USA as far as their real estate dept. But I
learned how huge this was. There are millions of people being denied bank
accounts each year in the U.S. There was definitely a need for this information.
