COMMON ALLEGATIONS

Plaintiff is a Minnesotamunicipal corporationlocatedin HennepinCounty,

4. On October1,2010 Defendantsappliedfor a Building Permit from Plaintiff for a

generator.

5. On October 15,2010 Plaintiff deniedthe Building Permit becausea wind

is not an allowed useunderthe Orono City Code.

6. On November 12,2010 Plaintiff becameawarethat the Defendantsbegan

ling concretefootings on the Subject Property for the wind generatorwithout a permit. The

ty issueda Stop Work Order on November 16,2010 directingDefendantsto ceaseall

ction activity and removethe concretefootings.

7. In violation of the Stoo Work Order. on or aboutFebruarv12.2011 Defendants

lled a metal supportpole for the wind generatorand installed the turbine and rotors on or

ut February23,2011.

8. The wind generatorand concretepad continueto be locatedupon the Subject

10. Defendantsare entitledto injunctive relief to enjoin the on-goingviolations of the

City Code.

rs are not an allowed use.

No principal or accessorystructureshall be located closer to the lakeshorethan
the averagedistancefrom the shorelineof existing residencebuildings on
adjacentlots; exceptthat this doesnot apply to stairways,lifts, landings and
lockboxes. Further,the averagelakeshoresetbackshall apply only to classified
lakes and shall not apply to tributaries. The averagelakeshoresetbackline shall
be a straightline connectingthe most lakewardprotrusionsof the residence

No accessorybuilding or structure,unless an integral part of the principal


building, shall be erected,alteredor moved within ten feet of the principal
building, nor within ten feet of anotheraccessorystructure.

17. The concretepad and wind generatorare locatedcloserthan ten (10') feet to the

ipal building md anotheraccessorystructure.

WHEREFORE, Plaintiff demandsjudgment againstDefendantas follows:

1. Determinationthat the wind generatorviolatesthe Orono City Code;

2. Enjoining Defendantsfrom locating and operating a wind generatorupon the

bjectProperty;
. Directing that Defendantsimmediately terminate the operation of the wind

r and remove the wind generator,concretepad and concretefootings; and

. Awarding the City its costs and disbursements.
