Met today on 04/04/2011 for the following agenda.

1.c Identifying the EOs who have completed four years as EO for converting them as AO
as per transfer policy.
2.c Identifying the AO, who have completed two years as AO for converting them after
ascertaining their willingness as EOs as per transfer policy.
3.c Ascertaining the cases which are within the powers of RPFC-I of the Region.
4.c Ascertaining the total vacancy to fill the existing areas.
5.c Ascertaining the cases which are not within the powers of RPFC-I and orders of
relaxation is required from ACC (GJ&MP).

The Committee went through the transfer policy and other related instructions of CPFC.
Yet the outlines of the policy are narrated as under for transparency.

(i)c The officials who are due for retirement within 3 years, may not be
transferred on promotion or in accordance with the rotational transfer
p[policy guidelines to the extent possible & they may be adjusted in their
hometown and preference may be given to officials with lesser number of
year of service.
(B)c As per ACC (WZ) letter No. ACC/WZ/Transfer of EO/2951 dated 04/03/2008.
(i)c No field posting be given in last two years of retirement.
(ii)c Rotation of EOs to AOs within 4 years and AOs to Eos after two years be done.
(iii)c EO/AO should not remain as same post for more than 5 years at one station.
(iv)c Transfer of lady (female) AOs not wanting to be rotated as EOs be done
amongst the RO and SROs.
(v)c No posting of newly promoted/directly recruited through UPSC be done as EO
till completion of on job training or probation whichever is later.
(vi)c Officials due for retirement within 2 years may be adjusted in or near the
Home town giving preference to one with lesser number of years of services.
(vii)c AOs/EOs should not be re-posted in the same section or some area of
responsibility or same area on his retransfer/recall.

(C)c As per Ho letter No.HRM-II/10(25)/94/GENL/Vol.II/108511 dated 20/03/2008.


(i)c All the RPFCs shall prepare the list of officers due for transfer taking the cutoff
date as 1st of April every year by 1st February and call for three choice place
postings.
(ii)c As far as possible the officers shall be accommodated against the place of
choice opted by them, subject to the past record of posting and the period he
has continued in such areas. In any case, no officer be allowed to continue in a
place for long period violating the transfer policy.
(iii)c Directions and instructions given by HQ/CVO regarding posting of some
individual officers in a non-sensitive post should be strictly adhered to.

(D)c As per Head Office letter No. HRM-I/D-16(1)/2006/21841 dated 11/07/2008.

(i)c It was clarified in our circular letter dated 07.12.2007 that the deployment and
managing the personnel matters including promotion, seniority, transfers etc.
should be managed by RPFC-I in accordance with the instructions issued from
time to time. It was also clarified that as far as deployment of staff is
concerned the RPFCs of the region shall have full powers and deployment of
staff in the regions shall be done by RPFC (I) of the parent regions in equitable
manner in consultation with RPFC-I of the bifurcated region. It is reiterated
that RPFCs (I) should ensure proper allocation of staff to all offices by calling
for options for movement of personnel from all the offices. In case of acute
shortage of staff in other regions the RPFC shall explore the possibility of
moving the excess staff in other offices by moving the new appointees. The
respective regions could also discuss the issues with recognized staff unions
and elicit their views for equitable distribution of staff among the different
regions as well as offices and scheme movement existing personnel also. The
policy issue relating to all administrative matter having impact on the staff
and management of the regions and movement of personnel shall be done by
the committee of RPFC (I) of the all the regions in the state and the senior
most amongst the RPFC(I) will chair such meetings.
(ii)c The Officers in the grade of EO/AO attained the age of 58 years shall be, as far
as possible, posted in their choice stations for allowing them to settle down in
the last leg of the service and well before retirement.
(E)c As per Head Office letter No. HRM-I/D-16(1)/2006/1504 dated 09/04/2009.
(i)c To ensure smooth and equitable distribution of resources among the
bifurcated regions of the political state, the ACC will continue to exercise the
administrative and financial powers delegated to the Additional CPFC of the
erstwhile zones. Inter regional transfer of officials up to the level of EO/AO
within a political state (erstwhile region prior to bifurcation) shall be effected
only with the approval of the ACC of the political state. However transfer
within the regions will be prerogative of the RPFC of the region, in accordance
with laid down transfer policy guidelines. Any deviation from the transfer
policy would require prior approval of ACC of the political state.
(ii)c In respect of transfers of EO/AO within the state, Staff Posting Committee
with the following composition is to be constituted under the Chairmanship of
ACC of the state.
(a)c RPFCs in charge of the regions within the state.
(b)c RPFC/APFC (adm) of the erstwhile region.
(c)c Liaison Officer of the erstwhile region.
(F)c As per Head Office letter No. Coord/11(61)/2005/Adm.Ins./Cir./Part/2163-2363 dated
30/04/09.
(i)c The posting of Enforcement Officers should be on rotational basis and not to
be continued in the same area for a period of more than 3 years.
(ii)c RPFC-I has to ensure that the number of Eos posted in the field should
commensurate with the workload.

The Committee is informed that General Secretary, BKS Shri H D Savlani and
Secretary-in-General EPF Staff Union Shri B C Desai have given letters to issue
orders relating to transfers of EO/AO strictly in terms of transfer policy.

Having gone through the above facts the members found from the list at
Annexure ͚A͛ that there are 14 Eos in Ahmedabad region who are required to
be given Home town posting as AO in terms of directions given by Head Office
vide letter dated 06/09/2005 and in such cases the order of relaxation is not
required from ACC. Hence it is decided that the order of 14 such EOs
converting them to AOs shall be issued by the RPFC-I of Ahmedabad region.
It is also found from Annexure ͚A͛ that in Ahmedabad Region Shri D B Vadwala
AO(Sr.No.01), Shri N L Chrsiti AO(Sr.No.02), Shri R C Shah AO(Sr.No.03 ), Smt K
D Shah AO(Sr.No.04) Shri K K Damor AO (Sr.No05), Smt P N Chulani
AO(Sr.No.06), Shri M L Parmar AO(Sr.No.07), Shri B M Pancholi AO (Sr.No.08),
Shri M K Shah, AO(Sr.No.09), and Shri A D Pandya,AO (SL NO 10) are on the
verge of retirement/tendered Vol retirement, hence they may be continued as
AO in their Home town. Since no order of relaxation is required from ACC,
RPFC-I Ahmedabad region may take necessary action for the same.

In respect of Shri J C Patel, AO (SR,.No.11) OF Annexure A the RPFC-I being


competent authority shall continue him as AO as he was promoted on
attaining the age of 55 years.

Further the committee was informed that there are 03 vacancies in SRO Rajkot
in the cadre of AO, hence Shri M K Khan, EO SRO Naroda (SL NO 22), Shri G S
Bheemava, EO Vatva(SL NO 23) and Shri H N Bhatt, EO (Sr.NO. 24) are required
to be posted as AO SRO Rajkot.

Smt H R Bhatt,EO SRO Vatva (Ahmedabad region Sr.No.25) has spent 6.5 years
at one station hence her station is required to be changed and for doing this
RPFC-I Ahmedabad region is competent for the same in terms of transfer
policy. RPFC-I Ahmedabad informed that OIC SRO Vatva informed through
APAR that Smt H R Bhatt, EO is not competent as EO, accordingly RPFC-I
Ahmedabad placed before the committee that she may posted as AO Naroda.

It is found from Annexure ͚A͛ that Shri K K Goghra, at Sr.No. (26) and Shri S K
Pillai at Sr.No (27) have been ordered to be given non-sensitive charge. Hence
they may be continued as AO Ahmedabad and the committee decided that
RPFC-I Ahmedabad may take necessary action and no order of relaxation is
required.

In respect of Shri Niraj Kumar, AO (sr.No28) of Annexure ͚A͛ the RPFC-I is not
competent to take his own decision in the matter of converting him as EO
though he continued as AO for last five years. In as much as he is facing a
disciplinary proceeding under rule 10 for unauthorized absence. In this case a
reference has been made vide letter No. 1897 dated 03.03.11 by RPFC-I to ACC
(GJ&MP) who after considering the facts of his non-involvement in corruption
charges decided with committee members to refer the case to HO to consider
his candidature for the post of EO in view of acute shortage of manpower in
the field.
Attention of the committee members was drawn to Annexure ͚B͛ in which it
was found that Shri P B Panjwani, EO (SL NO.03)is continued in the same
station for more than 7 years and so he is now required to be sent to other
station to enable him to complete his remaining tenure i.e. 01Yrs 04 months
as EO. Since this is case of Inter regional transfer the competency lies with the
ACC (GJ&MP) who decided to post him in Surat Region as he has worked in
Ahmedabad region before being posted in Vadodara.

The Committee found in Annexure ͚B͛ that the other two cases of Shri H H
Pathak, EO (SL NO 01)and Smt R S Kapadia, AO(SL NO 02) fall in retirement
category hence Shri H H Pathak, EO may be converted as AO and Smt R S
Kapadia, AO may be continued as AO by RPFC-I Baroda being competent
authority for the same.

Attention of the committee members was drawn to Annexure ͚C͛ in which Smt
L Y Thakker EO (Sr.No.01 ), Smt N D Mehta EO (Sr.No.02 ), Kum B B Desai EO
(Sr.No.03 ), Smt B P Mehta EO (Sr.No.04 ) fall in the retirement category hence
they may be converted as AO and posted as AO Surat in terms of transfer
policy. SMT M H Dave, AO (Sr.No.05 ) and Shri P G Gohil AO (Sr.No.06 ) fall in
the retirement cateogy hence they may be continued as AO Surat. RPFC-I RO
Surat being competent may take necessary action.

Shri K R Meena EO (Sr.No.07 ) and Shri V L jani EO (Sr.No .08) have completed
their tenure as EO and may be accommodated as AO Surat. RPFC-I RO surat
being competent authority may take necessary action.

Shri M D patel, AO (Sr.No.09 ) may be continued as AO Surat in as much as he


is facing disciplinary proceeding and criminal case before CBI court.
In respect of Shri M M Desai, EO (Sr.NO.10 ) the committee found that
he has working as EO Legal since 28.09.07 and he has also completed 5 years
at one station, hence the committee decided to change his station and to post
him as EO Vapi in view of shortage of EO in SRO Vapi.RPFC-I RO Surat being
competent authority may take necessary action.

Shri N K Singh, AO (Sr.No.11 ) has acceded his tenure as AO, however there
has been some complaint against him by establishment under jurisdiction of
SRO Vapi. Hence ACC (GJ&MP) is competent authority to take suitable
decision in respect of this official. ACC in view of nature of complaint decided
to continue him as AO Surat.
Attention of the committee members was drawn to Annexure ͚D͛ which
contains the list of officials in respect of all three regions who have neither
completed their tenure of four years as EO and the officials who have not
completed 2 years as AO.

Attention of the committee members was drawn to Annexure ͚E͛ which


exclusively contains the names of AOs who have not completed the period of
two years as AOs. In this regard the attention was also drawn towards the
minutes of previous staff posting committee meeting held on 01.10.2010 in
which the issue of conversion of AOs to Eos who have completed six months
as AO was decided in the meeting.

Further in the meeting held on 20.01.2011 it was decided that in order


to fill the vacancies in the field, the newly promoted AOs should also be
considered. Accordingly their options have been collected. The names of
persons in Annexure ͚E͛ are to be considered for filling of the vacancies arising
out of the resultant vacancies i.e. 14 at Ahmedabad Region and the existing 07
vacancies total of two comes to 21 vacancies, 02 at Baroda Region and the
existing 3 vacancies total of the two comes to 05 & 06 at Surat Region and
the existing 09 vacancies total of the two comes to 15 vacancies. In total there
are 41 vacancies which are to be filled by the persons in Annexure ͚E͛.

ACC(GJ&MP) being the competent authority to grant the relaxation in such


cases, granted relaxation.

In Ahmedabad Region 19 persons were promoted and 12 have given their


options. Against the 21 Vacancies in Ahmedabad region 12 persons are
available. The vacancies in Ahmedabad region may be filled by the persons
promoted in Ahmedabad region. In view of the fact they have given the
options for posting in Ahmedabad Region only.

In Baroda Region 06 persons were promoted and 02 persons have given their
options. Against the 05 Vacancies in Baroda region 02 persons are available.
The vacancies in Baroda region may be filled by the persons promoted in
Baroda region. In view of the fact they have given the options for posting in
RO Baroda.
In Surat Region 10 persons were promoted and 08 have given their options.
Against the 15 Vacancies in Surat region 08 persons are available. The
vacancies in Surat region may be filled by the persons promoted in Surat
region. In view of the fact they have given the options for posting in Surat
Region.

Since the relaxation has been granted by the ACC in respect of newly
promoted AOs in Annexure ͚E͛, the RPFC-I of concerned region may issue the
orders related to their posting.

In order to ensure fairness and transparency the minutes of this proceeding be


displayed on notice board of all the offices before issuance of posting orders,
so that necessary feedback can be received from difference offices.
