A UNIFORM SYSTEM OF CITATION Abbreviations AND Form of Citation 1926 A UNIFORM SYSTEM OF CITATION FOREWORD ; This pamphlet does not pretend to include a domplete list of abbreviations or all the necessary dita as to form. It aims to deal with the more common abbreviations and forms to which one has occasion to refer. In general, unless other- wise indicated, the forms in the examples are sthose to be employed in leading articles. Volume 1 of Bouvier, Law Dictionary contains a com- prehensive list of abbreviations. . All manuscripts should be double-spaced. The notes should be printed on separate sheets and should also be double-spaced. I. CASES AND REPORTS A. In GENERAL “1. . Italicize mames of cases only in the text. ; Do not italicize the name of cases appearing in the foot notes. Jones v. Smith, 92 Conn. 34, 3 Atl. 56 (1911). 2. ‘The date in citation of cases should appear at the end of the citation. 3. To indicate the purpose of the citation, use the following forms: (a) For a square holding, cite the case only at the page where it begins. a 1 (b) (c) (a) (e) Jones v. Smith, 92 Conn. 34, 3 Atl. 56 (1911). For a dictum, put “see” before the name of the case, and, after the initial page of the case, put a comma and the page where the dictum begins. See Jones v. Smith, 92 Conn. 34, 37, 3 Atl. 56, 58 (1911). If the case is to be compared with ori distinguished from the point under} discussion put “cf.” before the name. of the case. Cf. Jones v. Smith, 92° Conn, 34, 3 Atl. 56 (1911). In a “string citation,” ie., where two- or more cases are cited on the same point, the form is: Jones v. Smith, 92. Conn, 34, 3 Atl. 56 (1911); Grey v. Williams, 200 N. Y. 54, 85 N. E. 23 (1910). Note that. in a string cita- tion, a “cf.,” “see,” or other signal (or the absence of a signal) holds good for all that follows, until (a) a different signal is given, or (b) the end. of the sentence. “Contra” means a square holding or statute to the opposite effect. Thus Jones v. Smith, 92 Conn. 34, 3 Atl. 56 (1911). Contra: Grey v. Wil- liams, 200 N. Y. 54, 85 N. E. 23 2 (1910). Note that a period sepa- rates authorities in support of a point, from those coztra. (£) “But see” means a dictum or secondary authority contra. (g) Where the name of the reporter or jurisdiction is given in full it should be followed by a comma before the page number. Thus Williams v. Wil- liams, 2 Strange, 46 (K. B. 1765). B. Tuer Crration Orpir Cite the official reports before the unofficial, and primary authorities (cases and statutes) before secondary authorities (all others) un- less there is a particular reason for reversing the order. ° The relative order of citation of cases and statutes will depend on the sense of the particular situation. If there is apparently no choice, cite cases first, as representing common-law authority. The normal order of authorities in a string citation is: holding, dictum, contra, and “but see.” Where contra precedes a dictum contra, drop “but.” “Cf” and “but cf.” should be cited wherever they logically be- long, depending on the location in the string, of that with which comparison is to be made. 3 4, Set off by a semicolon each complete citation of an authority in a string citation. But where there are authorities contra start a new sentence there- with. Thus Jones v. Smith, 92 Conn. 34, 3 Atl. 56, (1911); 2 Wicmore, Evipence (1904) 56. Contra: Grey v. Williams, 200 N. Y. 54, 85 N. E. 23 (1910). In case of dictum contra do likewise. White v. Black, 64 Minn. 316, 56 N. W. 64 (1898). But see Brown v. Green, 45 Conn. 615, 617, 40 Atl. 23, 24 (1890). C. Repgeatine Citations 1. When a case has once been referred to by name in the text of an Article, Note, or Book Review, with footnote reference there- to, do not insert a footnote. reference again when the case is further referred to by name in the text, unless it is desired to refer to a particular page, or unless it is apparent that the clarity of the article demands it. Thus Jones v. Smith, supra note 6, at 182, 64 Atl. at 202. 2. fa case has already been cited in the foot- note of the Article, Note, etc., if referred to again in another footnote, cite as follows: 4 1. Jones v. Smith, supra note 6, at 182, 64 Atl. at 202, When, however, a citation follows immedi- ately a citation to the same authority, cite simply ibid.; where they would be identical except for the page, cite ibid. 10; where there would be a variation in the volume number as well as the page, cite 2 ibid. 45. Thus 2 Wicmorg, Evinence (1904) 56; 4 ibid. 751. “Op. cit.” is used preceded by the author’s name and followed by the footnote reference and the page, to avoid repeating the title of the work cited. 2 Warton, of. cit. supra note 7, at 202; 2 WiLLisTON, op. cit. supra note 4, § 1251. If the citation is to the same page or section; 2 WHARTON, loc. cit. Supra note 7, Do not use a comma after ibid., op. cit., or loc. cit. “infra” is used to designate below as opposed to “supra” above. D. Tue Crration or Amrrican Reports The jurisdiction must be indicated in the parenthesis immediately before the date, if it is not sufficiently shown by the rest of the citation. Thus Jones v. Smith, 3.Johns. 65 (N. Y. 1856). Always cite the official re- 5 ports and the reports of the National Re- porter ‘System unless, of course, one or the other is not available. Do not cite any” other unofficial reports, except that when a case is annotated the annotation may be cited. Thus (1912) 30 L. R.A. (n. s.) 415, note. Cite only the Federal Reporter (if that is available) for lower federal cases. (a) If the name of the reporter is not the name of the jurisdiction: 1 Cush. 91 (Mass. 1852); 45 Sup. Ct. 131 (U. S. 1925). (b) If the name of the reporter covers sev- eral courts indicate the court in which’ the decision was rendered. Thus in the case of circuit courts, cite 165 Fed. 210 (C. C. N. Y. 1890); in the case of circuit courts of appeal, cite 202. Fed. 131 (C. C. A. 2d, 1910); in the case of district Cours cite 200 Fed. 300 (S. D. N. Y. 1 . It is advisable to indicate the woust in citing the New York Miscellaneous Reports. 110 Misc. 95, 190 N. Y. Supp. 210 (Sup. Ct. 1910). (c) In citing the Appellate Division it is: also advisable to give the Department. 207 App. Div. 35, 201 N. Y. Supp. 658 (ist Dept. 1923). 6 2. Ifthe case has not yet appeared in any official report, cite the advance sheets. Where only the slip decision is available, cite e.g. U. S. Sup. Ct. Oct. T. 1924, No. 256. 3. In citing early federal cases before the Fed- eral Reporter cite Federal Cases in prefer- ence to official reports, if both are available, otherwise cite the official reports. Thus Jones v. Smith, Fed. Cas. No. 1,023 (1850). E. Tuer Crration or Enciisn Reports I. Cite only the official report if that is avail- able. If not, cite an unofficial report as, e.g., the Times Law Reports, or English Re- prints. Do not cite English collections of Leading Cases, unless there is some unusual or compelling reason therefor. For cases 8 cited before the official reports and by the name of the reporter, indicate the court in * which the case was decided. Thus Lyon v. Reed, 13 M. & W. 285 (Ex. 1844). 4. The English Law Journal reports are cited *. thus: Dickson v. Johnson, 5 L. J. Ch. 210 (1898); White v. Brown, 10 L. J. K. B. . 410 (1855). 5. The Year Books should be cited thus: Pear’s Case, Y. B. 3 Hen. VII, f. 3, pl. 9. 6. Where an early English decision is not dated, but refers to a year in the reign of some sovereign, look up the coronation date in the Encyclopaedia Brittanica, in Foss, TABULAE CurraLes; Hicks, MATERIALS AND Mrru- ops or Lrcar Resrarcu, or Cooxry, Brier Maxine. This also applies to finding the dates of early statutes. II. PERIODICALS (a) Cite articles in periodicals thus: 1. Leading articlh——Haines, Efforts to Define Unfair Gompetition (1919) 29 Yate L. Je il. 2. Comments, notes, recent decisions, case notes—(1925) 25 Cou. L.- Rev. 111. (2) is meant to apply to all student work in the various journals, 9 (b) (c) (a) (b) (c) The names of all periodicals are printed ‘in small capitals, Always abbreviate the names of the vari- ous legal periodicals, using the regular state abbreviations wherever possible, as ¢.g., Micu. L. Rev. Otherwise abbreviate as— U. Pa. L. Rev., Cox. L. Rev., Harv. L. Rev., Yatr L. J., Corn. L. Q. Each legal publication shall be free to cite its own name as it chooses. The New York Law Journal, Legal In- telligencer, etc., are cited as newspapers. Thus N. Y. L. J., Oct. 27, 1921, at 2092; New York Times, Nov. 21, 1921, at 16. III, GOVERNMENTAL PUBLICATIONS Congressional Record is cited: 41 Cone. Rue. 1251 (1907). Congressional Reports are cited: H. R. Rep. No. 2119, 59th Cong. Ist Sess., Ser. No. 4906, at 806; Sen. Rep. No. 3922, 59th Cong, ist Sess., Ser. No. 4905, at 520. ‘H.R. Doc. No. 127, 61st Cong. 2d Sess., Ser. No. 5830, at 57. Sen. Doc.; ‘Ex. Doc., etc. The reports of the various departments are cited: Rep. Atty. Gen. 1920, at 7; Rep. Sec. Treas. 1914, at 65; etc. 10 (d) Tax reports are cited according to the fol- (a) (b) lowing general plan: United States Treasury Regulation 65— U.S. Treas. Reg. 65, Art. 1. Cumulative Bulletin—for the older cases —2 Cum. Bull. 1. Cumulative Bulletin—for the new cases— * JI—1 Cum. Bull. 3. The title of the case is represented by I. T. 1965, or O. D. 915, etc. so that a complete citation would be—I. T. 1965, I1J—1 Cum. Bull. 201 or O. D. 915, 4 Cum. Bull. 85. IV. TREATISES In treatises appearing in the footnotes the name of the author and of the work ap- pears in small capitals. Thus 5 Wicmore, Eviwence (1904) § 2568, n. 2. Where a treatise is cited in the body the author’s name appears in Roman type and the name of the book in italics. Thus 5 Wigmore, Evidence (1904) § 2568, note 2. Cite treatises and texts thus: 2 War- ton, Criminat Law (11th ed. 1912) 1012;'5 Wicmore, Evipence (1904) § 2568, n. 2; Portocx, Contracts (3d Am. ed. 1906) #305. Never cite an earlier edition of a work of which a later edition 11 (c) (a) (a) has appeared except for matter not appear- ing in the latter. In a few well-known works the edition is left out and the star page referred to. 2 Bu, Comm. *152; Co. Lrrr. *15. In Some cases, where the new edition is not numbered or where it commonly goes by the name of the editor or translator, the editor’s name is substituted for the number of the edition. (b) Capitalize: Act—only if part of the name of a spe- cific statute, e.g., the Sales Act; the Act (referring to the Bankruptcy Act, etc.) Article and Art.—if referring to the Fed- eral Constitution. ’ Assembly—if the name of a particular legislative body. Congress—if referring to a particular legis- lative body of which that is part of the name. Constitution—only when referring to the United States Constitution. Court—a) whenever referring to the U. S. Supreme Court; Court—b) where another court is re- ferred to by its official title. Ex parte—when part of the name of a case, e.g., Ex parte Jones. Governor—only when a specific governor is referred to. Ibid—only when beginning a sentence. King—only when a specific king is re- ferred to. President—when a president of the United States is referred to. - R. R. & Ry.—in citations. 16 (a) (b) Rev. Stat—for Revised Statutes (compila- tion). s. C.—for same case (small capitals). Secretary (of State, Treasury, etc.). Section—when referring to a section in the United States Constitution. State—when e.g., New York State (but state of New York), and when State as opposed to the Church. Statute of Frauds. Statute of Limitations. Federal should be capitalized only when the word it modifies is capitalized. Vil. ITALICIZATION Italicize as little as possible. . GENERAL RULES A general rule of form is that a citation, should read in the following order: where a case, Name of Case, Citation, Jurisdic- tion (where necessary), Date; where 2? treatise, Name of Author, Name of Book, Edition, Date, Page or Section; where a periodical, Name of Author (if any), Name of Article (if any), Date, Name of Periodical, Page. ‘ Do not abbreviate Iowa, Ohio, Idaho, or United States (except in citation of cases; where it is U. S.). For other abbrevia- tions, see appendix, p In names of parties in cases, do not abbre- viate the first word in the name of either. party. After the first word you may ab- breviate, but not at a sacrifice of helpful, clearness. , (d) In citations use: Ins. for Insurance Mfg. for Manufacturing Nat. for National R. R. for Railroad) (Omit the Co. with Ry. for Railway R. R. and Ry.) People for The People State for the State 18 (c) (f) (g) (h) (i) The abbreviations to be used to indicate the various subdivisions of treatises, stat- utes, constitutions, etc. are as follows: article—art. book—bk. chapter—c. paragraph—par. part—pt. title—tit. These are not capitalized, except that Ar- ticle and Section are capitalized when re- ferring to an article or section in the United States Constitution. A section mark (§) should be used only when a section is cited or mentioned in the footnotes. But when “section” begins a sentence or is cited in the body of the article it should be spelled out. Use “‘n” to indicate a citation to a foot- note in some work. Wiuttiston, Saves (1909) 62, n. 4. Use “note” to indicate a citation to a footnote in the same magazine.
