Bulletin 737 - 01/11 - Pollution fine Tariff and advice - Turkey

The Turkish Government has issued new guidelines pertaining to environmental pollution
tariffs. Members should be aware of the fines and implications of these changes. The new
tariff and advice as provided by out Turkish correspondent is set out below:

Please find here below the Pollution Fine Tariff from 01.01.2011 up-to 31.12.2011
(As per "Communiqué of the Tax Law Procedure (Seq No: 401)" the Fines as per the rate of
revaluation, are increased by 7.7%, as to the fines applied in 2010)

THE NEW POLLUTION FINES IN TURKIYE

AS OF 1/1/2011 UP-TO 31/12/2011

Petrol and Petroleum products discharged to sea by tankers:

1. Up to 1000 (inclusive) gross tons: Per Ton* : 56.96 TL

2. Between 1000 and 5000 (inclusive) gross tons: Per Ton* : 14.22 TL
3. Over 5000 gross tons: Per Ton* : 1.38 TL

Dirty ballast discharged to sea by tankers:

1. Up to 1000 (inclusive) gross tons: Per Ton* : 42.71 TL

2. Between 1000 and 5000 (inclusive) gross tons: Per Ton*: 8.52 TL
3. Over 5000 gross tons: Per Ton* : 1.38 TL

Petrol/Petroleum products and dirty ballast discharged to sea by vessels or any other sea
vehicles:

1. Up to 1000 (inclusive) gross tons: Per Ton* : 28.47 TL

2. Between 1000 and 5000 (inclusive) gross tons: Per Ton* : 5.68 TL
3. Over 5000 gross tons: Per Ton* : 1.38 TL

Garbage and sewage discharged to sea by vessels and any other sea vehicles:

1. Up to 1000 (inclusive) gross tons: Per Ton* : 14.22 TL

2. Between 1000 and 5000 (inclusive) gross tons: Per Ton*: 2.82 TL
3. Over 5000 gross tons: Per Ton* : 0.56 TL

[P.S.: As at 01.01.2011 Turkish Central Bank's Exchange Rate: 1 USD. = TL.1.5376]

P.S.:
As per the relevant Law, in case of the repetition of the pollution offence
by the same ship within 3 (three) years time;
- At the first repetition, the fine amount is increased by one time more,
and,
- At the second and more repetition the fine is calculated and imposed
twice as much.

In case of discharge of any dangerous substances or disposals to sea, the

fine will be calculated 10 (ten) times
as much taking the category of Petrol and Petroleum Products fines as basis.

KINDLY NOTE IF THE FINE IS PAID IMMEDIATELY

(IN ANY CASE BEFORE THE VESSEL'S SAILING / WITHIN MAX. (30) DAYS)
25% REDUCTION WILL BE BENEFITTED.

The Vessels Agents are generally sending Circular/Notice/Warning to the Owners/Masters when
they have been nominated as Agents transiting/waiting at anchorage/calling to Turkish Ports
especially before the Vessels entering Canakkale straits (Dardanelles)
that the Masters would take steps not to cause any pollution incident.

The Masters of the Vessels would pay utmost attention and take all steps not to cause any
pollution by leakage/spillage of any kind of materials (paintings, oil, bilges, clean ballast, dirty
ballast, all kind of residues, garbage, dirty waters, sewage waters, laundry waters with detergent,
lavatory soap waters, shower waters, dust, rust etc.)
