MISSION STATEMENT

The Labour Commissioner Organization is committed to establish harmonious


industrial relations in private and state sector establishments; to protect and safeguard the
benefits and rights of workers guaranteed under various labour laws in organized sector in
general and also to those engaged in unorganized sector; and to ensure safe work
environment in factories. The organization is also committed to ensure regulation of
employment and conditions of service to the building and other constructions workers; and
also the welfare measures to the building and other constructions workers and their
dependents.

The Labour Commissioner's organization seeks to achieve this objective through


enforcement of various labour laws relating to fixation of minimum wages and timely
payment thereof, guaranteeing financial benefits, providing safe and healthy work
environment, regulating service conditions, providing social security to the injured workmen
and maternity benefit to the women workers and also ensuring abolishing child labour, and
rehabilitating those, released from work.

The Labour Commissioner's organization ensures quick disposal of industrial disputes


through its conciliation machinery with a view to establish harmonious industrial relations
amongst the employers and employees, so that, along with growth in industrial production,
the interests of workmen are protected.

COMMITMENT TO THE STAKE HOLDERS

• Enforcement of labour laws in factories, shops and commercial establishments through a


Self-Certification Scheme. Under this scheme, a pre-designed format – the Compliance
Status Report (CSR), contains broadly the statements based on the minimum concerns to
be answered by the entrepreneurs, so that the status of compliance is objectively
evaluated. This format, duly filled in, is required to be submitted by the unit to the local
office of the department by 31st January of every year, which shall be verified by a joint
team in respect of 20% of the units every year. Such 20% units shall be identified on the
basis of number of workers employed therein starting from the larger employment. The
joint team shall consist of Asstt. Labour Commissioner/Labour Enforcement Officer;
Dy./Asstt. Director of Factories; a senior representative of the management of the unit;
and an agreed representative of the workers. If the compliance, after verification, is found
to be 100%, a Green Card may be issued to the unit and thereafter the unit shall be
exempted from inspection for the next five years. However, these units shall be required
to continue submitting annual compliance status report (CSR) on prescribed format every
year in the month of January.
• If a unit has received SA-8000 certification, the department on an application from the
unit, may exempt the unit from inspection for the period of such certification.
• This system of self-certification shall not be applicable in respect of hazardous factories
and for the inspection of boilers under the Indian Boilers Act, 1923.
• Regular inspections procedure, already in existence, shall be applicable to such units, who
shall not follow the above system.
• In view of specific nature of brick-kiln industry and also with an objective to ensure
implementation of labour laws applicable in brick-kiln industry, the State of Uttar
Pradesh vide order no. 625/36-3-06-62(CM)/01 TC, dated 28th March, 2006 have issued
instructions to concentrate, on priority, on certain issues relating to regulation of
employment, conditions of service, working conditions, hours of work and social security
measures under the various labour laws during the inspection of brick-kiln
establishments. The Labour Enforcement Officers and the Asstt. Director of Factories
posted in the regions have been inspecting the units to carry out the above instructions of
the State Government to ensure the above priority concerns in the brick-kiln
establishment.
• Registration and renewal of shops and commercial establishments.
• Registration and licensing of factories and renewal thereof.
• Registration of units engaging contractors and license to the contractors; registration and
licensing for the employment of migrant labour; license and renewal thereof to carry out
Beedi making; and registration to the owners of motor transport establishments.
• Inspection of boilers with a view to enforce the provisions relating to safety of boilers and
other related equipment and also registration and renewal thereof.
• Speedy and timely redressal of complaints and grievances of workers through conciliation
proceedings and enforcement of labour laws with a view to establishment harmonious
industrial relations and payment of dues and benefits guaranteed under various labour
laws.
• Timely intervention in industrial disputes for its prevention through conciliation and
settlement in respect of private and state sector establishment.
• Publication of awards within a period of 30 days.
• Implementation of provisions relating to safety, health, welfare, and working hours in
factories. Assistance to the factory management in developing health and safety policy,
on-site emergency plan, and safety report in respect of major accidents hazards factories
and also timely advice and instructions to the regional officers for the development of off-
site emergency plan in respect of districts wherein major accident hazard factories are
situated through district crisis group under the chairmanship of District Magistrate.
• Enforcement of minimum wages and its timely payment in the factories, shops and
establishments.
• Administration and enforcement of various labour laws.
• Fixation and revision of minimum wages under the Minimum Wages Act, 1948 in respect
of scheduled employments; and also through tripartite agreements. The minimum wages
are fixed/revised at an interval of five years.
• Effective functioning of Minimum Wages Advisory Board and Contract Labour Advisory
Board.
• Registration of trade unions under section-8, cancellation of trade unions under section-10
of the Trade Unions Act, 1926, amalgamation of trade unions and amendment of bylaws
are done by Registrar, Trade Union. The requisite action is initiated within a period of 7
days.
• Regulation and maintenance of labour colonies under the Industrial Housing Scheme.
• Enforcement of provisions relating to safety of boilers and other related equipment
through physical inspection and their registration and renewal thereof. Registration of
Boilers in 30 days and renewal of certificate of registration in 20 days on payment of
requisite amount of fee.
• Prohibition of child labour in hazardous process industries through inspections and
surveys under the Child Labour (Prohibition and Regulation) Act, 1986 and
mainstreaming of all forms of child labourers into formal education as well as vocational
training to the children of 9-14 years of age under the NCLP Project; and identification &
rehabilitation of bonded labourers.
• Enforcement of provisions relating to social security measures to all workers and to the
women workers as well. Compensation to the injured persons and to the nominees of
deceased workers.
• Implementation of labour welfare schemes promoted by the U.P. Labour Welfare Board
through the Labour Welfare Fund.
• Development and generation of labour related statistics. Year-wise statistics on
enforcement and administration of various labour laws is generated and sent to the
Labour Bureau, Shimla.
• Workload studies in respect of various industrial operations in the units as and when
reference is made.
• Establishing and monitoring of functioning of quality circles in industrial units.
• Organizing training for employees of the department for their professional excellence.
• Active participation in e-Governance Project and e-Biz Portal of the State Government by
data digitization and extensive application of I.T. tools in the functioning of the
Department.
• Reforms in labour laws and simplification of procedures to suit the environment of
liberalization and globalization of trade and commerce. Necessary exemptions under the
various labour laws to promote industrial growth in the state as well as ensuring the
protection of workers' interests and their due benefits.
• Due and active participation in apex level tripartite committees like Indian Labour
Conference, Standing Labour Committee; related seminar and workshops, Udyog
Bandhu. Participation in the programmes run and sponsored by ILO and UNICEF.
• Transparency in work culture by creating a website and its timely updating.

HEAD QUARTER OF THE ORGANIZATION

The headquarter of the Labour Commissioner's Organization at Kanpur is headed by


the Labour Commissioner, Uttar Pradesh, who is the Head of the Department. The
headquarter is committed to carry out its functions timely and effectively with the
assistance of Additional Labour Commissioners, Director of Factories, Director of Boilers
and the Finance Controller. The commitments envisaged are effectively honoured in
favour of stake holders through the various sections, which are independent units itself
entrusted with specific responsibility. These sections are supervised by individual
Sectional Officers indicated in the organogram mentioned above.

Industrial housing schemes.

• Identification of child labour and mainstreaming to the formal education as


well as vocational training to the children of 9-14 years of age under the
NCLP Project. Monitoring and supervision of special schools for child labour
under NCLP and INDUS Projects.

• Identification & rehabilitation of bonded labourers. Rehabilitation of bonded


labour is ensured within a period of one year provided that the concerned
bonded labour is located.

• Registration of executive body of registered trade unions (Form-J) is done


within a period of 30 days by the regional offices.

• Hearing and disposal of C.B and C.P. cases within a period of 40 days; and
also reference of C.B. cases to Labour Commissioner within a period of 30
days; and C.P. cases to labour courts and Industrial tribunals within a period of
15 days.
• Disposal of cases under the Public Premises (Eviction) Act, 1972 of all
properties relating to the Department in the State within a period of 60 days.

• Disposal of cases under the Uttar Pradesh Industrial Peace (Timely Payment
of Wages) Act, 1978 within a period of 30 days.

• Speedy and timely redressal of complaints and grievances of workers through


conciliation proceedings and enforcement of labour laws with a view to
establish harmonious industrial relations and payment of dues and benefits
guaranteed under various labour laws. This whole process is completed within
a period of 15 days.

ZONAL OFFICES OF THE DIRECTORATE OF FACTORIES AND ITS


FUNCTIONS
07 zonal offices of Deputy Director of Factories are located at 07 strategic places to
carry out registration, licensing of factories apart from major accident hazard factories and
factories employing less than 50 workers under the control of Director of Factories, Uttar
Pradesh and Labour Commissioner, Uttar Pradesh. These offices are situated at :-

Besides these 07 zonal offices of Deputy Directors of Factories, there are 17 regional
offices of Assistant Directors of Factories at Lucknow1, Faizabad2, Gorakhpur3, Allahabad4,
Varanasi5, Kanpur6, Bareilly7, Aligarh8, Agra9, Firozabad10, Meerut11, Bulandshahar12,
Bijnore13, Moradabad14, Saharanpur15, Muzaffarnagar16, Ghaziabad17, and Noida (Gautam
Budha Nagar)18 to carry out registration, licensing of non-hazardous factories employing upto
50 workers under the immediate control of respective Dy. Director of Factories. The
Assistant Director of Factories are responsible for the implementation of the provisions of the
Factories Act, 1948 and rules made there under as well as the provisions of the Manufacture,
Storage and Import of Hazardous Chemical Rules, 1989 (Amended-2000) and the Chemical
Accidents (Emergency Planning, Preparedness and Response) Rules, 1996 under the
Environment (Protection) Act, 1986.

The functions of zonal Deputy Director of Factories are :

• Registration and licensing of factories under the Factories Act, 1948 and renewal
thereof except the major accident hazard factories and factories employing less
than 50 workers in their respective administrative jurisdictions within a period of
01 month.
• Enforcement of provisions relating to safety, health, welfare and working hours in
factories situated in their respective jurisdictions.
• Speedy and timely redressal of complaints and grievances of workers within a
period of 15 days, with a view to ensure safe work environment, rights and
benefits guaranteed under the Factories Act, 1948 and rules made there under and
also the provisions relating to management of hazardous substances stipulated in
the rules under the Environment (Protection) Act, 1986.
• Investigation of all fatal and serious accidents within a period of 1 month to
ascertain the cause of accident and in providing due and timely advice and
instructions to avoid recurrence of such accidents.
• Timely coverage and registration of manufacturing units under the Factories Act,
1948.
• Ensuring rehearsal of On-site Emergency Plans in respective units twice a year in
the month of June and December to evaluate and also to rectify the pitfalls
observed during the rehearsal.
• Development of Off-site Emergency Plans of the districts wherein major accident
hazard factories are situated through district crisis group constituted under the
chairmanship of District Magistrate concerned. Rehearsal of Off-site Emergency
Plans at least once a year.

INDUSTRIAL TRIBUNALS AND LABOUR COURT

6 Industrial Tribunals and 20 labour courts are situated in the State to adjudicate the
cases relating to industrial disputes. These courts/tribunals are constituted by the State
Government under the provisions of the U.P. Industrial Dispute Act 1947 .

INDUSTRIAL TRIBUNALS are located at Allahabad, Lucknow, Kanpur, Agra,


Meerut, and Gorakhpur.

LABOUR COURTS are located at Kanpur (1) , Kanpur (2), Kanpur (3), Kanpur (4),
Kanpur (5), Lucknow, Agra, Bareily, Meerut, Saharanpur, Gaziabad (1), Gaziabad (2),
Gorakhpur, Allahabad, Varanasi, Rampur, Faizabad, Mirzapur, Firozabad and
Gautambuddha nagar (NOIDA).

PUBLIC GRIEVANCES
In house mechanism of grievance redressal has been established in the office of the
Labour Commissioner for effective redressal of grievances received from workers, trade
unions, entrepreneurs and their associations and also its own employees and other
departments.
• A complaint cell headed by Additional Labour Commissioner (I) has been set up
in Labour Commissioner's office, under whom sufficient staff has been deployed
to deal with public grievances and complaints filed against gazetted and non-
gazetted employees.
• A committee to look into the complaints of sexual harassment to women at
workplace has also been formed in this organization.

relevant information, forms etc.

1- The Beedi and Cigar Workers (Conditions of Employment) Act, 1966


An Act to provide for the welfare of the workers in Beedi and Cigar
establishments and to regulate the conditions of their work and for matters connected
therewith.
2- The Bonded Labour System (Abolition) Act, 1976
An Act- to provide for the abolition of bonded labour system with a view to
preventing the economic and physical exploitation of the weaker sections of the
people and for matters connected therewith or incidental there-to.

3- The Building and Other Construction Workers' (Regulation of
