WORLD WAR I
The National Defense Act of 1916 provided cursory authority to organize “State” foces as the last sentence of
Section 61 stated, “that nothing contained in this act shall prevent the organization and maintenance of state
police or Constabulary.” Governors used this clause as permission to begin preparations for organizing
replacement National Guard units. On 3 August 1917, the Adjutant General of New York, in order to comply with
the provisions of the State Constitution requiring that troops be available to the Governor for the protection of life
and property of the citizens of New York, organized a State Military Force known as the New York Guard under
the Home Guard Act of 1917, and the subsequent War Department Circular #3 of March 1918. Re-organized
on geographical lines under GO# 58 AGO November 1917.
In accordance with Special Orders No. 198, AGO, dated August 6, 1917 First Provisional Regiment created. In
accordance with Special Orders No. 311, AGO, dated December 11, 1917, a Provisional Brigade was created
consisting of the First and Second Provisional Regiments already on duty. Brigade was disbanded by Special
Orders #277 of The Adjutant General's Office on November 18, 1918.

MAJ George J. Winslow,
The First Provisional Regiment guarded the water supply of the City of New York and was under the command of Colonel
John. B. Rose, 1st Infantry, N.Y.G. Its territory extended from the northern boundary line of the City of New York along the
line of the Croton Aqueduct to Croton Lake, from thence to a point near Cold Spring on the east bank of the Hudson river
at Breakneck tunnel where the Aqueduct crosses under the river to Storm King Mountain. Thence along the Aqueduct to
Aahokan Reservoir, a distance of 96 miles. Two hundred forty-seven vulnerable points were guarded. The headquarters
were at Croton Lake for the greater portion of the tour, but were eventually moved to Ossining.
The territory guarded by the Second Provisional Regiment, which was commanded by Major George J. Winslow, Inspector
General, 3d Brigade, N. Y. G., extended from .Albany and Troy along the line of the Barge canal to Whitehall, and from
Waterford along the line of the Barge and Erie canals west to Tonawanda, north from Syracuse to Oswego, southwest from
Syracuse to Waterloo with posts at the International Railroad Bridge at Niagara Falls, the bridge of the Central New
England Railroad at Poughkeepsie, public buildings and two New York Central Railroad bridges at Albany. Also the
Niagara Falls power plant(s), and various other railroad bridges (near Utica, Elmira) across the state.
After the Armistice was signed and the Federalized New York National Guard units were returned to State
status, New York Guard units were deactivated. 29 December 1919. Official disbandment orders AGO#4 dated
12 Jan 1923 effective 16 Jan 1923.
WORLD WAR II
In 1940 under the threat of being pulled into the world at war, New York Army National Guard units were
being rapidly inducted into federal service. On 21 October 1940 the 76th Congress removed the restrictions on
Section 61 of the National Defense Act to allow State Military Forces. This had been heavily pushed for some
time by New York Governor Lehman and Massachusetts Governor Saltonstall. The Governor directed the
organization of the New York Guard and on 25 October 1940 General Orders Nos. 40 was issued by the
Adjutant General’s office.
Planning for the New York Guard, to include identification of force structure, Regimental Commanders and
those NYARNG personnel “physically unfit” for activation, had been commenced as early as July and August by
MG William N. Haskell, Commander NYARNG, until his activation on 23 October. The NYG was organized
effective 25 October 1940 and on that same date MG William Ottmann assumed command. Initially BG George
P. Tyner was the Chief of Staff.
The NYG structure consisted of one Headquarters, 5 Brigade Headquarters and 20 Regiments for a total of
1,116 Officers and 12,573 enlisted. The 1st, 2nd and 5th Brigades were in Metropolitan New York City, the 3rd
Brigade was in Albany and the 4th Brigade was in Buffalo. In 1941 two additional Regiments were organized, in
1942 two separate Battalions were added in Long Island, and in 1943 a separate colored Battalion was added in
the Brooklyn and Queens county area.

By late 1945 the war was over and the National Guard Bureau was working on new ARNG force structures for
the states. LTG Drum developed a new TDA to reposition the NYG for conversion into the new NYARNG. This
new force structure was to be implemented 1 January 1946.

On 7 October 1946, an official National Guard troop allotment was accepted, and the New York Guard of World
War II was phased out of existence by the reorganization of the National Guard effective 30 November 1946.
POST WWII - State War – Disaster Military Corps (SW-DMC New York Guard).
The NYG Strength by December 1946 remained at 17,060. In February 1947 the state organized a State War –
Disaster Military Corps (SW-DMC New York Guard). By 31 Dec 1947 the strength of this organization was 401
officers and 3,590 enlisted. It was organized with two Division HHC’s, and single companies of Regiments.
Under the Command and Control of the NYARNG MACOMs there was no NYG Headquarters. Infantry
Regiments had 3 companies each, all other had one company each.
SW-DMC Strength by 31 December 1948 was 273 officers and 2,290 enlisted. In late 1948 a question of
legality under section 61 of the National Defense Act became an issue. On 1 June 1949, the State War –
Disaster Military Corps (New York Guard) was disbanded.
KOREAN CONFLICT – Planning Cadre’s & Administrative and Logistical Support for
Emergency Operations
June 1950, Communist North Korean forces crossed the 38th Parallel and invaded pro U.S. South Korea. After
several New York National Guard units had been ordered into Federal service, the Chief of Staff to the Governor
directed planning for the reorganization of a New York Guard. However, only Area and Zone Command
Headquarters were organized. Organized under AGO#22 24 July 1950.
Deactivation NYS AGO#28 dated 27 Aug 1952 effective 27 Sep 1952 to comply with federal law that had
repealed the 1940 authorization effective 25 July 1947. Amended AGO#35 26 Sep 1952 to authorize a HQ
NYG for planning purposes.
By the conclusion of the Korean Emergency (27 July 1953), the New York Guard organization was limited to a
cadre staff of Headquarters, New York Guard.

In 1954, for Administrative and Logistical Support of the plans for Emergency Operations as set forth in NYSEP,
the state was divided into five zones. A Zone Service Command cadre as a part of the HQ NYG was

Current authority extends from Section 61, National Defense Act , as amended by the Act of August 10, 1956,c.
1041, 70A Stat 600; Sept 2, 1958, Pub. Law 85-861 2 ( 2 ) , 72 Stat 1542, and is codified as 32 USC 109 and
State Legislation enacted in 1958, the New York Guard was reorganized as a reserve land force of the
organized Militia of New York. In accordance with the Division of Military & Naval Affairs, General Orders
Number 25, dated 1 September 1958, the New York Guard was established, consisting of an HHC and 6
Regional Commands in a Cadre structure.
