I, Giri Namala, s/o Dr. N. Raghu Ramulu, aged 41 years, Occ: Employee, R/o. H.No
2-16-94, Prashant Nagar, Uppal Village and Mandal, Ranga Reddy District, do her
eby solemnly affirm and state as follows:
1. I am the petitioner here in and the 7th defendant in main Suit, I am acqua
inted with the case facts.
2. It is to submit that on 29-04-2009, I was set exparte as I have not file
d the written statement. In this regard it is to submit that the summons of D2 a
re not yet served. Further as the suit is filed by misjoinder of causes of aucti
ons, I filed an application for dismissal of the suit. Hence, I was under the im
pression that I have to file written statement after the summons to other defend
ants are served and after disposal of my application questioning the maintainabi
lity of the suit. Further it is to submit that since last two months I was in Ge
rmany in connection with my job work Hence I could not meet my advocate and file
written statement. I have purchased the plot from the lawful manner and I am in
possession of the same. I am having very good care to put forth and succeed in
the suit.
Hence it is prayed to set aside the exparte order passed again me on
29-04-2010 to enable me to file written statement and contest the suit, ot
herwise, I would be put to heavy loss and sufferance.
