President Obama’s speech this week calling for a
bipartisan approach to immigration reform lacked
explicit mention of the plight of bi-national gay couples,
but LGBT rights supporters are hoping his emphasis on
family unification was a hint of his support.
In his address Tuesday at the Chamizal National
Memorial Park in El Paso, Texas, Obama emphasized
passage of comprehensive immigration reform in
Congress would have benefits for both the economic
prosperity and border security of the country while
making no explicit mention of the plight that many gay
families face under current immigration laws.
On the economic benefits of immigration reform,
Obama said enacting new legislation would enable
immigrants who come to the United States to attend
college to stay in the country to use their education to
advance the economy.

Kameny papers exhibit opens
at Library of Congress
The Library of Congress has added two documents “of major historical
significance” from the papers of gay rights leader Frank Kameny to a widely viewed
public exhibit about the U.S. Constitution and Declaration of Independence.
The library quietly placed the Kameny documents on display at its Thomas
Jefferson Building across the street from the U.S. Capitol in late April without
publicly announcing the development.
On Monday, organizers of the Kameny Papers Project announced in a press
release that the documents were on display as part of the library’s “Creating the
United States” exhibit.
The release says inclusion of the Kameny documents represents the first time
“the history of gay and lesbian Americans” has been included by the library “in
the story of the Constitution and its evolution as a living instrument of freedom.”
In 2006, the Kameny Papers Project donated about 50,000 documents and artifacts
to the Library of Congress on Kameny’s behalf that the gay rights pioneer had
produced during his more than 50 years of work on behalf of LGBT equality. The
documents and artifacts, such as gay rights protest signs from the 1960s, are available
to researchers. Kameny, 85, began working on gay rights activities in the late 1950s.
One of the documents now on display at the Library of Congress is Kameny’s
1961 petition to the U.S. Supreme Court contesting a decision in 1957 by the
then U.S. Army Map Service to fire him as a civilian astronomer because he was
gay. The petition is the first such document ever filed before the Supreme Court
pertaining to a civil rights violation based on sexual orientation.
The Supreme Court denied Kameny’s petition, upholding the longstanding
policy of the then U.S. Civil Service Commission banning gays and lesbians from
working for the federal government. The policy remained in effect until 1975.
The second Kameny document included in the library’s exhibit is the original
copy of a 1966 letter from John W. Macy Jr., the then director of the U.S. Civil
Service Commission, to the Mattachine Society of Washington, the city’s first gay
rights group that Kameny founded in the early 1960s.
In the letter, Macy sought to justify the federal government’s ban on gay
employees by citing “the revulsion of other employees by homosexual conduct.”
The two Kameny documents are scheduled to remain on display at the library
until October.

Delaware gays celebrate as Markell signs civil unions
Delaware Gov. Jack Markell was scheduled to sign into law a sweeping civil unions bill
late Wednesday after Blade deadline.
The signing was scheduled to take place at the World Café Live in Wilmington and a
large celebration of local LGBT people was expected to follow.
The new law extends all state rights of marriage to same-sex couples in a civil union.
The measure passed the Senate last month by a 25-15 vote.

D.C. Pride events set to begin this month
Events associated with D.C.’s two main LGBT pride festivals – D.C. Black Pride and
Capital Pride – are set to begin this month, and organizers say they are looking forward
to a record turnout from local and out-of-town participants.
As it has since its founding, Black Pride is set to take place Memorial Day weekend,
with events beginning on Thursday, May 26, and ending Sunday, May 29, with the annual
Black Pride Health and Wellness Festival. The festival will take place 1-7 p.m. at D.C.’s Fort
Dupont Park located at Minnesota Avenue and F streets, S.E. The location represents a
change from last year’s festival, which was held at the D.C. Convention Center.
A series of Black Pride workshops covering a wide variety of topics ranging from
domestic violence and heath care to black youth and transgender acceptance in the
black community is scheduled to take place 10 a.m.-2 p.m. Friday, May 27, at the Hamilton
Crowne Plaza Hotel at 14th and K streets, N.W.

The 36 annual Capital Pride celebration is set to take place June 2-12. The Capital
Pride Parade will take place Saturday, June 11, and similar to past years, will begin at
23rd and P streets, N.W., travel around Dupont Circle to the 17 Street entertainment strip
before ending at 14th Street, N.W., at Thomas Circle.
Also similar to past years, the Capital Pride Festival is set to take place 11 a.m.-6 p.m.
on Sunday, June 12 on Pennsylvania Avenue, N.W., near the U.S. Capitol.
A wide variety of Capital Pride events are scheduled for the week preceding the parade
and festival, including a June 1 kick-off party and panel discussion at the National Press
Club; a June 5 Pride in the Park event at Six Flags amusement park in Upper Marlboro,
Md.; and a June 6 Spirituality in the Gay Community Town Hall meeting at the Hotel
Palomar at 2121 P St., N.W.
A weekly “Pride Idol” singing contest, to be held every Wednesday night beginning
May 11 at Cobalt bar at 17th and R Sts., N.W., is a new addition to the Capital Pride
events. Organizers say a final winner in the ongoing singing contest will be selected June
8. The prize: a three-month lease for a new Saab automobile, which is being donated by
Saab as part of the company’s sponsorship of Capital Pride.

Director of Baltimore’s LGBT community center resigns
Craig Wiley, executive director of the Gay, Lesbian, Bisexual, and Transgender
Community Center of Baltimore and Central Maryland (GLCCB) has resigned. He held
the position for more than seven years and became the longest-tenured executive
director in GLCCB history.
Wiley also served on the board of Centerlink: The Community of LGBT Centers.
According to his bio on Centerlink, “Since joining the GLCCB he has systematically
implemented expense-reduction strategies and indentified new and diverse revenue
streams for the organization. Mr. Wiley has also fostered relationships with many
organizational and community partners and municipal agencies, including the Baltimore
City Health Department, the Baltimore Police Department, the Office of the Mayor, local
colleges and universities, businesses, and nonprofits serving diverse constituencies that
touch the LGBT community either directly or indirectly.”
“It is with regret that I write you to let you know Craig Wiley has stepped down as
Executive Director of the Gay, Lesbian, Bisexual, and Transgender Community Center
of Baltimore and Central Maryland (GLCCB),” GLCCB Board President Trevor Ankeny
said in a statement. “Craig’s involvement with the GLCCB spanned more than a decade.
From volunteering to serving as a board member to assuming the position of executive

U.S. Attorney unseals sentence
in D.C. gay murder case

Anthony Hager, 23, and conspiracy to rob
Rivers while armed with a firearm. Hager
was 22 at the time of the murder.
Judge Herbert Dixon also sentenced
Wren to seven years on the two conspiracy
charges but agreed to a request by Wren’s
defense lawyer to allow the two sentences
to run concurrently, limiting the total time
served to 12 years.
The U.S. Attorney’s office moved to
have the court records unsealed following
inquires by the Washington Blade, which
discovered through unsealed court
records that the government dropped its
case against Hager, who was also charged
with first-degree murder while armed in
the River’s killing.
“The U.S. Attorney’s Office determined
that there was probable cause to
arrest Anthony Hager in the murder
of Mr. Rivers,” said William Miller, a
spokesperson for the office. “However,
the office later concluded that there was
not sufficient evidence to meet the higher
legal standard that is required to obtain
and sustain a conviction.”
Miller noted that at the government’s
request, the court dismissed the case “without
prejudice,” which allows prosecutors to
reinstate charges against Hager in the future
if more evidence surfaces.
“The murder case remains under
investigation,” he said.
Chris Farris, former co-chair of the
D.C. group Gays and Lesbians Opposing
Violence, said he was “outraged” that Wren
could receive just 12 years for committing
a murder and that Hager could get off
“completely free” in the Rivers’ murder.
“Take away the gay angle, take away
the history of hate crimes against our
community, take away everything else, and
I just find it incredibly stunning that one
person in the case of a murder of someone
who was fired on at point blank range five
times gets 12 years in jail,” Farris said.
Court documents filed by the
government and the defense in the case
show that Hager allegedly conspired with
Wren to force Rivers at gunpoint to drive
the two to Rivers’ house in Maryland,
where they planned to rob him of his
valuables and steal his two vehicles. But the
documents show that that Wren shot Rivers
before Hager had a chance to enter the car.
Court records also show that authorities
revoked Hager’s parole from an unrelated
conviction for armed robbery in 2005 after
learning of his arrest in the Rivers case.
Miller said the parole revocation resulted
in Hager being ordered to serve two more
years for the earlier conviction.
Under the D.C. criminal code, Wren faced
a possible maximum sentence of 70 years
in prison for second-degree murder while
armed with a firearm. First-degree murder
while armed carries a maximum sentence of
90 years in prison under D.C. law.
Separate sentencing memorandums
submitted by the defense and the U.S.
Attorney’s Office asked Judge Dixon to
consider mitigating factors that would
justify a sentence significantly lower than
the maximum sentence provided by law.
Among other things, the two pointed to
Wren’s cooperation with the government
in the prosecution of Hager before the
U.S. Attorney’s office decided to drop its
case against Hager.
Defense attorney Spencer Hecht also
states in his sentencing memorandum
that Wren recounted that Rivers paid him
for sexual encounters at Rivers’ house in
Brandywine, Md., during a one-year period
prior to the murder. Hecht’s sentencing
memo says the sexual encounters began
when Wren was 16.
“While the defendant unequivocally
accepts responsibility for his extremely serious
and dangerous conduct, and is extremely
remorseful for taking the life of another, he
offers the nature of his relationship with the
decedent in mitigation,” Hecht says in his
sentencing memo.
“The decedent was someone who
preyed on the defendant’s youth,
immaturity, and impressionability for a
substantial period of time,” the memo
says. “On frequent occasions, the
decedent would contact the defendant
and pay him to perform sex acts upon him.
This is nothing less than child sexual abuse
and rape – offenses which carry significant
prison sentences.”
Hecht provides no evidence or
substantiation of the alleged sexual
encounters between Rivers and Wren
other than Wren’s claim that they occurred.
The sentencing memo doesn’t say where
the two met or under what circumstances,
only that the two met after Wren’s mother
kicked him out of her home “because her
live-in girlfriend believed the defendant
a troublemaker.” His estrangement with
his mother resulted in his having no fixed
address, the memo says.
“It was during this period of time that
the defendant began using and selling
drugs and committing robberies of
known drug dealers to support himself,”
according to Hecht’s sentencing memo.
“It was also during this period of time
that the defendant met the decedent
Gordon Rivers (aka ‘Mr. G’), when he (‘Mr.
G’) propositioned him (the defendant) for
paid sex,” it says.
The memo also states that Wren moved

Gay activists have long complained
that defendants who target gay men for
assault, robbery and murder have often
claimed, after being charged with such
crimes, that the victim made a sexual
pass at them that prompted them to
assault or kill the victim in self-defense.
Gay rights attorneys, who describe such
a claim as the “gay panic defense,” have
said prosecutors often lack the training or
understanding to adequately contest this
defense tactic.
Hecht did not return calls to his office
seeking comment on the case and on his
client’s allegations of sexual encounters
between Wren and Rivers.
Miller, the spokesperson for the U.S.
Attorney’s office, said he could not
comment on whether his office considered
Hecht’s allegations in the sentencing
memo as an attempt to invoke the gay
panic defense.
In its own sentencing memorandum, the
U.S. Attorney’s Office recommended that
the court sentence Wren to the “middle
range” of sentences available to a court
for the offenses to which Wren pleaded
guilty. The government sentencing memo
recommends that Dixon sentence Wren

“The defendant preyed upon Mr. Rivers
by taking advantage of the trust they shared,
however inappropriate the foundation of
the relationship,” the memo says. “And it
was the defendant, not Mr. Hager, who got
in the car, put the gun to Mr. Rivers, and
pulled the trigger five times.”
The memo notes that Wren was “no
newcomer to armed robberies,” referring
to his own admission that he committed
armed robberies against drug dealers in the
months prior to his arrest in the Rivers case.

Obama officials, HRC named
in ‘racketeering’ lawsuit
Anti-gay Bush appointee
seeks $200 million
in damages

Two gay Obama administration officials
and the Human Rights Campaign were
lumped in as defendants with former
Bush administration operative Karl Rove
and more than a dozen others in a federal
racketeering lawsuit filed by anti-gay Bush
official Scott Bloch.
The 64-page lawsuit, filed in Fairfax
County Circuit Court, charges the
defendants — including former GOP
Congressman Tom Davis of Virginia —
with conspiring to force Bloch out of his
job as head of the U.S. Office of Special
Counsel through a trumped up criminal
investigation.
News of the lawsuit, which was first
reported by Courthouse News Services,
hasn’t been widely reported in major news
media outlets.
Bloch and his wife, who is a party
to the suit, are seeking $102 million in
compensatory damages and $100 million
in punitive damages.
Bloch, who served as director of the
Office of Special Counsel from 2004 to
October 2008, pleaded guilty in April 2010
to a charge of contempt of Congress. The
guilty plea followed a lengthy investigation
that included an FBI raid on his office and
home in May 2008.
The investigation stemmed from
allegations that Bloch improperly sought
to purge employees in his office who
disagreed with him and later sought to
cover up possible wrong-doing by hiring
a computer services company to “scrub”
files from his government office computer.
A federal judge in Washington
sentenced him on March 30 to one
month in jail in connection with his guilty
plea but agreed to stay the sentence
while Bloch appeals it on grounds that he
didn’t know the contempt of Congress
law carries a mandatory minimum jail
term of 30 days.
The gay Obama administration officials
named in Bloch’s suit are John Berry,
director of the U.S. Office of Personnel
Management, and Elaine Kaplan, OPM’s
general counsel. Kaplan preceded Bloch
as head of the Office of Special Counsel
during the Clinton administration.
While working as an attorney in private
practice after her term ended as U.S.
Special Counsel, Kaplan joined others
who criticized Bloch for dismantling LGBT-
supportive policies at the Special Counsel’s
office that Kaplan established there.

Kaplan and others argued that an
existing U.S. civil service law protected
federal workers from discrimination
based solely on their sexual orientation
through a provision that barred bias for
non-work related factors. Bloch, upon
taking office after being appointed by
President George W. Bush, reversed
Kaplan’s policies, saying he disputed the
assumption that the civil service law could
be interpreted to bar discrimination based
on sexual orientation.
In his lawsuit, Bloch alleges that the Bush
White House demanded that he back off
from reversing Kaplan’s polices at the Office
of Special Counsel, saying White House
aides threatened to arrange for his dismissal
if he failed to comply with their request.
Bloch and his wife, who are
representing themselves in the case,
filed their suit under a federal statute
called the Racketeer Influenced and
Corrupt Organizations Act, or RICO.
The statute allows both criminal and civil
charges to be brought in cases where the
government or a private party alleges
that others conspired to commit an illegal
act or to damage a person or a business
through a “criminal enterprise.”
Other parties named as defendants in
the lawsuit include the Executive Office
of the President, the Office of Special
Counsel, the National Treasury Employees
Union, and several government watchdog
groups, including the Government
Accountability Project.
In his lawsuit, Bloch names Berry as a
defendant only in his capacity as director
of the Office of Personnel Management,
making no allegations that Berry played a
role in Bloch’s forced resignation as head
of the Office of Special Council during the
Bush administration.
However, Bloch repeatedly alleges in
the lawsuit that OPM as a government
agency “conspired” with others in the
Bush administration to force his ouster
because, among other things, he was
investigating possible breaches of
government ethics rules by Bush White
House staffers, including Karl Rove, and
officials with other government agencies.
The lawsuit alleges that Kaplan was a
party to the alleged effort to oust him from
his post as head of the Office of Special
Counsel in her role as general counsel to
the National Treasury Employees Union,
which opposed Bloch’s policies and
practices at the OSC. Kaplan became
general counsel to NTEU shortly after her
five-year term as head of the Office of
Special Counsel ended.
The lawsuit alleges that Kaplan joined
other organizations and individuals who
disagreed with Bloch’s policies and sought
his removal.
It says the Human Rights Campaign was
among several outside groups that Kaplan
and others worked with to discredit Bloch
and “conspire” to oust him from office.
During his tenure as head of the Office of
Special Counsel, HRC criticized Bloch for
rolling back his office’s protections for gay
federal workers.
“We don’t believe this case has any
merit,” said HRC spokesperson Fred Sainz.

believe and thereon allege, that in her
current role as general counsel of OPM,
[Kaplan] is conspiring with or has conspired
with third parties to damage plaintiffs as
hereinafter alleged, improperly, illegally,
and against the Ethics in Government Act,
both as to her involvement in previous
issues as Special Counsel of the OSC, and
as general counsel of OPM with conflicts
of interest, personal and official, and to
conspire to harm plaintiffs…,” Bloch says
in his lawsuit.
The lawsuit charges that Kaplan and
those she allegedly conspired with
sought to “disrupt official investigations,
undermine official functions in the
Office of Special Counsel, divert loyalty
of employees away from Scott Bloch,
and otherwise seek to undermine and
harm plaintiffs in their reputation and
family life.”
Berry and Kaplan or a spokesperson
for the Office of Personnel Management
couldn’t be immediately reached for
comment on the lawsuit.

in the United States,” Obama said. “So
instead of training entrepreneurs to create
jobs in America, we train them to create
jobs for our competition. That makes no
sense. In a global marketplace, we need
all the talent we can get — not just to
benefit those individuals, but because their
contributions will benefit all Americans.”
Obama also said enacting
comprehensive immigration reform would
contribute to border security by allowing
U.S. immigration officials to focus on
immigrants who come to the United
States for unscrupulous purposes.
“The most significant step we can take
now to secure the borders is to fix the
system as a whole — so that fewer people
have incentive to enter illegally in search of
work in the first place,” Obama said. “This
would allow agents to focus on the worst
threats on both of our borders — from
drug traffickers to those who would come
here to commit acts of violence or terror.”
But never during the speech did
Obama directly address that under
current immigration law, gay Americans
are unable to sponsor their foreign
partners for residency in the United
States. Foreign nationals in same-sex
relationships with Americans could be
subject to deportation and separation
from their loved ones upon expiration of
their temporary visas that allow them to
remain in the country.
Even U.S. citizens in legally recognized
same-sex marriages with foreign nationals
cannot obtain marriage-based I-130 green
cards for their spouses because of the
Defense of Marriage Act, which prohibits
federal recognition of the unions.
At one point in his address, Obama said
immigration law should “respect families
following the rules — reuniting them more
quickly instead of splitting them apart.”
The remark seemed directed toward
immigrants who are permanent residents
in the United States seeking to have their
loved ones join them, and not aimed at
problems faced by gay Americans and
their foreign partners.
“While applicants wait for approval, for
example, they’re often forbidden from
visiting the United States,” Obama said.
“Even husbands and wives may have to
spend years apart. Parents can’t see their
children. I don’t believe the United States
of America should be in the business of
separating families. That’s not right. That’s
not who we are.”
White House Press Secretary Jay Carney
suggested on Wednesday that President
Obama isn’t open to issuing a moratorium
to stop the deportations of LGBT foreign
nationals in same-sex marriages who
would be eligible for residency in the
United States if not for the Defense of
Marriage Act.
Under questioning from the Washington
Blade, Carney noted that Obama
articulated in his immigration speech on
Tuesday that problems in the immigration
code — whether they impact gay
Americans and their foreign spouses or
not — require a comprehensive legislative
solution as opposed to executive action.
“The president, I think, made the point
in his speech yesterday that he — we
have to take comprehensive action on
immigration reform and that he can’t just
wave a wand and change the law,” Carney
said. “So, I’ll leave — I’ll leave it at that
terms in of his view.”
Pressed on whether he believes the
White House has the authority to issue
such a moratorium, Carney replied, “It’s
not for me to decide. I’m not a lawyer.”
Shin Inouye, a White House
spokesperson, said the president’s speech
was intended to emphasize the importance
of immigration reform on his agenda and
the lack of explicit mention of gay families
shouldn’t be seen as an indication of the
president’s position on the issue.
“The president delivered this speech
because he wants a constructive and civil
debate on the need to fix the broken
immigration system so that it meets
America’s economic and security needs
for the 21st century,” Inouye said. “It is
fundamental for America to win the future.
His remarks are not meant to be a laundry
list of all the issues that immigration
reform should address.”
LGBT rights supporters working on
immigration issues expressed gratitude
to the president for giving the speech
despite his lack of explicit mention of gay
couples during the address.
Steve Ralls, spokesperson for
Immigration Equality, said his organization
wholeheartedly supports the notion
expressed by Obama that immigration
system should keep families together in
the United States.
“We couldn’t agree more, and while
the president didn’t use the ‘LGBT’
qualifier in his reference to families, we’re
going to ensure the White House knows
— clearly and unambiguously — that
any immigration reform effort must be
inclusive,” Ralls said.
Ralls added that his organization is
pleased that Obama is stepping up efforts
to reform the immigration system and is
glad to hear him talk about an end to
family separation.
“Now, we look forward to working with
him, and other leaders, on a concrete
plan that includes our families, too,” Ralls
said. “It’s time for everyone to get into the

business of reforming our laws in a way
that unites, rather than separates, loved
ones. That’s the right thing to do, and the
goal we remain committed to.”
Lavi Soloway, co-founder of Stop the
Deportations, also said he applauds the
commitment to reform that President
Obama expressed during his speech and
for emphasizing that family unification is
the bedrock of immigration law.
However, Soloway said Obama needs
to take administrative action by exercising
his prosecutorial authority to ensure that
foreign nationals in legally recognized same-
sex marriages with U.S. citizens can stay in
the country without fear of deportation.
“To keep our country safe, we must
focus our law enforcement resources on
deporting those who have committed
crimes and endanger our security,”
Soloway said. “At the same time this
administration must take great care
that, in the zeal to achieve that goal,
innocent families are not torn apart. The
administration has not yet delivered
fully on its goal to protect all families
from deportation, where possible, by
application of existing prosecutorial
discretion guidelines.”
Soloway, who handles immigration
cases as an attorney with Masliah &
Soloway PC in New York, maintained
that Obama can issue such a change
because he has already determined that
DOMA is unconstitutional because of the
impact the anti-gay law has LGBT families,
including same-sex bi-national couples.
“This administration can act now to
ensure that no LGBT families are torn
apart by instituting a moratorium on
deportations of all spouses of lesbian and
gay Americans until all married couples
are treated equally under our immigration
laws,” Soloway said.
Gay-inclusive bill introduced
Just days prior to Obama’s speech,
a U.S. House member from California
introduced family immigration legislation
that includes language allowing gay
Americans to sponsor their foreign

partners for residency in the United States.
Rep. Mike Honda (D-Calif.) introduced
the Reuniting Families Act, which has a
provision that would protect bi-national
same-sex couples as one of its six prongs
to keep families together in the country.
During a conference call last week,
Honda touted his legislation as a means to
make U.S. immigration policy more fair for
gay Americans and their foreign partners.
“RFA also ends discrimination in our
immigration system by allowing same-
sex permanent partners to sponsor their
foreign national partners for immigration
benefits,” Honda said.
The provision allowing gay Americans
to sponsor their foreign partners for
residency in the United States is identical
to other legislation known as the Uniting
American Families Act, which is sponsored
by Rep. Jerrold Nadler (D-N.Y.) in the
House and Sen. Patrick Leahy (D-Vt.) in
the Senate.
Rachel Tiven, executive director for
Immigration Equality, praised Honda for
including a provision for bi-national same-
sex couples as part of his legislation.
“Separating families has an enormously
expensive impact, it is a drain on the
economy and separating Americans from
their loved ones and forcing them to move
abroad because they can’t keep their
family together in this country is simply
pointless,” Tiven said.
In addition to including UAFA-like language,
Honda’s legislation would help shorten the
wait times that can keep legal immigrants and
their overseas loved ones separated for years.
The bill would classify spouses and children
of permanent U.S. residents as “immediate
relatives” and exempt them from numerical
caps on immigration.
“The reality is almost 6 million people
are stuck in the logjam of our family visa
system,” Honda said. “The current system
has not been updated in over 20 years,
and many family members who apply
for visas are not granted admission for
decades — and that undermines their

Holder halts deportation of

to resort to illegal migration.”
The Reuniting Families Act has 73
co-sponsors, including House Minority
Leader Nancy Pelosi (D-Calif.) as well
as gay Reps. Barney Frank (D-Mass.),
Tammy Baldwin (D-Wisc.) and Jared
Polis (D-Colo.). The co-sponsors are all
Democrats; no Republicans have signed
on in support.
Rep. David Cicilline, another gay
lawmaker, isn’t among the co-sponsors.
His office didn’t respond on short notice
to explain why his name isn’t on the list of
supporters.
During the conference call, Honda
said he intends his legislation to be a
marker to set the tone for debate on
larger comprehensive immigration reform
legislation in the 112th Congress.
“It’s to also tell our citizens and those
with legal permanent resident status to be
part of the movement for a comprehensive
package for everyone in this country,”
Honda said. “I’d like to make sure that we
both the Reuniting Families Act and the
Uniting American Families Act were provisions.
Menendez’s office didn’t respond by
deadline to a request for comment on when
the senator would reintroduce the Reuniting
Families Act or whether it would include
a provision to keep bi-national same-sex
couples together in the United States.
Steve Ralls, a spokesperson for
Immigration Equality, said he thinks
Menendez will likely again introduce
comprehensive legislation this Congress
that would include both Uniting American
Families Act and the Reuniting Families Act.
“Sen. Menendez would be the best
person to talk about the Senate CIR strategy,
but my expectation is that we will see an
inclusive, all-encompassing Senate bill
which incorporates the various other bills,
such as UAFA and RFA, into one,” Ralls said.
‘A positive first step’
In a related development last week, an
order to vacate from U.S. Attorney General

just go through the arc once and just fix all
the holes and make sure that this thing we
call immigration system … is a better vessel
for people that we’re trying to care of.”
Until comprehensive immigration
reform can be passed, Honda called on
Obama to issue a moratorium to stop the
deportation of foreign nationals in same-
sex unions who would be eligible for
marriage-based green cards if not for the
Defense of Marriage Act.
“The president has at his disposal certain
kinds of statutory existing powers that he
can stay a deportation process,” Honda
said. “He can put in a place a situation
where folks will be held in abeyance and
allowed to work and allowed to continue
their lives until such time that we correct
our immigration system.”
Last month, Honda was among the 47
U.S. House members, who, along with
Rep. Zoe Lofgren (D-Calif.), wrote the
Justice Department and Department
of Homeland Security to stop the
deportations of foreigners in legally
recognized same-sex marriages in the
United States.
In the 111th Congress, Sen. Robert
Menendez (D-N.J.) sponsored the Senate
version of the Reuniting Families Act, but
he has yet to introduce the bill this year.
The version of the bill that Menendez
previously introduced didn’t include a
provision for bi-national same-sex couples,
although the legislation was similar in other
respects to Honda’s bill. However, at the end
of last year, Menendez introduced broader
immigration reform legislation in which the
facing separation.
In the decision, dated April 26, Holder
remands to the Board of Immigration
Appeals the case of Paul Wilson Dorman
— a New Jersey man who’s seeking
residency in the United States through his
partner — to reassess a previous petition
that was denied based on the Defense
of Marriage Act, which prohibits federal
recognition of same-sex marriage.
“In the exercise of my review authority
under that regulation, and upon
consideration of the record in this case,
I direct that the order of the Board be
vacated and that this matter be remanded
to the Board to make such findings as
may be necessary to determine whether
and how the constitutionality of DOMA is
presented in this case,” Holder writes.
Holder asks the Board of Immigration
Appeals to clarify questions not addressed
in the initial proceeding, such as whether
the petitioner’s civil union with his partner
makes him eligible as a “spouse” under
New Jersey law and the Immigration and
Nationality Act as well as whether Dorman
can establish exceptional and unusual
hardship to qualify for relief.
The details of the Dorman case weren’t
immediately known, such as when his
partner filed the petition, when the Board
of Immigration appeals initially rejected
the application or when any deportation as
a result of the case is expected to proceed.
Nor was it clear why Holder decided to
intervene in this case when other foreign
nationals in same-sex relationships are
faced with potential deportation.
Tracy Schmaler, a Justice Department
spokesperson, said the action isn’t
the first time that an attorney general
has remanded a case to the Board of
Immigration Appeals for reconsideration.
“By way of history, over the years, attorneys
general in several administrations have
exercised their review authority in immigration
cases,” Schmaler said. “Since 1996, attorneys
general have reviewed 30 cases involving a
variety of immigration law issues.”
Lavi Soloway, an attorney who handles
immigration cases, said the order from
Holder could be a sign that the Obama
administration is looking for a way to
help same-sex bi-national couples who
are barred from the marriage-based
immigration process because of DOMA.
“There isn’t yet a final decision that
could be applicable, but on the other
hand, the action by the attorney general
to vacate the decision would now suggest
that it would be appropriate to adjourn
any deportation proceedings where there
are similar issues at stake,” Soloway said.
Steve Ralls, spokesperson for
Immigration Equality, said the implications
of the order to vacate remain unclear,
but could indicate that the Obama
administration is moving to intercede on
their behalf.
“It appears to be a positive first step
that, I think, is based at least in part on
the congressional pressure that has been
placed on DOJ around DOMA and the
issue of bi-national couples,” Ralls said.
Ralls was referring to letters that member
of Congress sent to the Justice Department
and the Department of Homeland Security
urging officials to stop the deportations
of foreign nationals in legally recognized
same-sex marriages. Last month, Sen. John
Kerry (D-Mass.) and 11 other senators in
one letter, and Rep. Zoe Lofgren (D-Calif.)
and 47 other House members in another
letter, asked the Obama administration to
make the change.
“I think it’s a positive sign that the
attorney general himself decided
to intervene to take this step,” Ralls
continued. “We’re hopeful that it will then
be replicated in other cases for couples
who are facing separation, but I think it’s a
little too early to know for sure that’s going
to be the case.”
Soloway said he plans to use the
order to help defend his clients who face
possible separation because of DOMA.
Josh Vandiver, a U.S. citizen, and
Henry Velandia, a professional dancer
from Venezuela, were legally married in
Connecticut last year. Velandia was placed
into removal proceedings in 2009 when his
employment-based immigration case was
denied. Last summer, Vandiver filed an
I-130 marriage-based green card petition
for Velandia, but it was denied in January
on the sole basis of DOMA.

House panel adopts anti-gay amendments
Defense bill includes
language to disrupt
‘Don’t Ask’ repeal,
affirm DOMA

A House defense committee approved
on Wednesday a series of anti-gay
amendments as part of major Pentagon
budget legislation aimed at disrupting the
process for repealing “Don’t Ask, Don’t
Tell” and at demonstrating support for the
Defense of Marriage Act.
The most high-profile amendment
came from Rep. Duncan Hunter (R-Calif.),
who introduced a measure that would
expand the certification requirement
needed for repeal to include input from
the four military service chiefs. The
Republican-controlled House Armed
Services Committee voted 33-27 in favor
of adopting the measure as part of the
fiscal year 2012 defense authorization bill.
The vote in favor of the Hunter
amendment was mostly along party lines,
although Reps. Todd Platts (R-Pa.) and Chris
Gibson (R-N.Y.) voted against the measure.
Rep. Mike McIntyre (D-N.C.) was the sole
Democrat to vote in favor of the measure.
The repeal legislation signed into law in
December allows for repeal of “Don’t Ask,
Don’t Tell” after 60 days pass following
certification from the president, the defense
secretary and the chair of the Joint Chiefs of
Staff. Hunter’s amendment would expand
the certification requirement to include
input from the uniform chiefs of staff for the
Army, Navy, Air Force and Marine Corps.
Hunter, a Marine Corps veteran of Iraq
and Afghanistan, billed the amendment
as a means to ensure the uniform military
leaders — which he described “the ones
that are actually responsible for the men
and women under their care” — are able
to express their opinion before moving
forward with “Don’t Ask, Don’t Tell” repeal.
“Right now as it stands, the only
folks that have to sign on to this are the
president, who has never been to war or in
ground combat, Adm. [Mike] Mullen, who,
with all due respect to him, has never been
to ground combat in Iraq or Afghanistan,
and Secretary Gates, a political appointee,
who is a very fine gentleman, but has
never been in ground combat in Iraq or
Afghanistan,” Hunter said. “I, and others in
this room, have more combat experience
than the people who would sign off on the
repeal of ‘Don’t Ask, Don’t Tell.’”
Hunter emphasized his amendment
would require the service chiefs to issue
certification only based on their belief that
“Don’t Ask, Don’t Tell” repeal wouldn’t
harm morale and unit cohesion for
combat arms units under their jurisdiction.
According to the Pentagon survey
published in November, these units are the

Involving the military service chiefs
in the “Don’t Ask, Don’t Tell” repeal
certification process could disrupt or delay
open service in the U.S. military because
some uniform leaders of the military —
notably Marine Corps Commandant Gen.
James Amos — expressed opposition to
passing repeal legislation last year. Amos
has since said the Marine Corps would
work to implement open service.
Despite the concerns that were expressed
last year, each of the service chiefs testified
in April that the process for enacting “Don’t
Ask, Don’t Tell” repeal has been proceeding
smoothly. Some service chiefs — including
Chief of Naval Operations Adm. Gary
Roughead — have said they oppose
any effort to expand the certification
requirement and they believe the defense
secretary would adequately represent their
views in the certification process.
Many Republican committee members
voiced support for the Hunter amendment as
they expressed opposition to implementing
open service in the U.S. military.
Rep. Doug Lamborn (R-Colo.) said he
supported the amendment because the
president, the defense secretary and the
chairman of the Joint Chiefs of Staff had
already backed “Don’t Ask, Don’t Tell”
repeal before Congress acted to end the
military’s gay ban.
“I always felt the deck was stacked when
the three people who were supposed to
sign off on it, agreed to and had all been
on record ahead of time saying what
their preference was,” Lamborn said.
“This broadens it, and, I think, adds more
objectivity to the whole matter, and I think
that that’s really good thing.”
Rep. Steve Palazzo (R-Miss.) said he
opposes “Don’t Ask, Don’t Tell” repeal
because he hasn’t encountered one
American or U.S. service member who
wants an end to the anti-gay law. Despite
his remarks, polls found that around 80
percent of Americans favored ending the
military’s gay ban at the time Congress
repealed the statute.
Palazzo added he had a visit earlier today
from about 85 veterans of World War II and
said he believes they’d be displeased with
“Don’t Ask, Don’t Tell” repeal.
“I don’t think that they would look upon
this as progress,” Palazzo said. “I don’t
think they’d look at this as the sacrifices
they made for our families, for our
country, for our allies, future generations
of Americans — to see their military go
down in flames by implementing [an end]
to the DADT policy. Our men and women
in uniform deserve better.”
But Democrats on the committee
defended repeal of the law that Congress
passed last year and said the current
repeal process is working well.
Rep. Adam Smith (D-Wash.), ranking
Democrat on the House Armed Services
Committee, said the Hunter amendment
troubled him because it suggests the
president and the defense officials
identified in the repeal law aren’t capable
of making critical defense decisions.
“It’s a very, very dangerous thing to say
that the president of the United States,
the commander in chief; the secretary of
defense; and the chairman of the Joint
Chiefs of Staff are somehow not quite
qualified to make important military
decisions,” Smith said. “These are the
same people that decide whether or not
we go to war. They made a decision on
whether or not to kill Osama bin Laden.”
Rep. Chellie Pingree (D-Maine) directly
responded to the view expressed by
Palazzo that World War II veterans would be
unhappy with “Don’t Ask, Don’t Tell” repeal.
“Let’s not fool ourselves,” Pingree said.
“Some of those soldiers were gay as well,
and many of them took a long time to
admit to that, or come out on that, but
they’ve all been courageous in doing so
and I think that they can’t be characterized
as a generation that doesn’t want to see
this change in the military.”
Although the committee adopted
the amendment as part of defense
authorization, passing such a provision
into law would be challenging because
the Senate would have to agree to it

Obama would have to sign the measure.
Further, defense officials have testified
that certification could happen mid-
summer, and the final version of the
defense authorization will likely not reach
the president’s desk until after that time,
rendering Hunter’s provision useless.
Hunter’s amendment was one of three anti-
gay amendments the House Armed Services
Committee approved on Wednesday as
part of the defense authorization bill. Other
measures affirmed the panel’s commitment
to DOMA, which prohibits federal recognition
of same-sex marriage.
The DOMA-related amendments were
apparently inspired by Navy guidance on
same-sex marriage that was made public
this week.The guidance, which is dated
April 13 and signed by Chief of Navy
Chaplains Rear Adm. Mark Tidd, indicated
military bases could be used for same-
sex marriage ceremonies in states where
such unions are legal and that Navy
chaplains can officiate same-sex marriage
ceremonies if they so choose.
However, following an outcry from
conservatives, the Navy rescinded the
guidance and said further legal review on
the issue was necessary.
Rep. W. Todd Akin (R-Mo.) introduced
an amendment mandating that marriage
ceremonies on military installations must
comply with DOMA and that chaplains
can only officiate in their official capacity
over such ceremonies if they comply with
the anti-gay law.
The committee adopted the amendment
as part of the Pentagon budget legislation
by a vote of 38-23. Republican members
of the panel were unanimous in their
support for the measure. Reps. McIntyre,
Larry Kissell (D-N.C.) and Mark Critz (D-
Pa.) joined with the GOP to vote in favor
of the amendment.
Akin said the amendment was
necessary because he believes the recent
Navy guidance demonstrates that the U.S.
military was willing to skirt federal law.

So the Prop 8 judge is gay — big deal
Walker case demonstrates
the need for us to come out

The debate over whether Judge Vaughn
Walker should have recused himself, or at
least come out publicly as gay, before de-
ciding on the Prop 8 case in California is ac-
tually a big step forward for the LGBT com-
munity. The world is becoming aware that
we have LGBT judges and some are ready
to be open about who they are.
Nearly 50 years after women and Afri-
can Americans had to listen to the bigots
contemplate whether they could decide
a case involving someone of their own
gender or race we in the LGBT communi-
ty have finally reached that status. People
will now question us and debate whether
we should be able to sit on cases that
may have some impact on our own lives.
They will question whether we are able
to impartially follow the law and decide
a case on its merits, rather than on per-
sonal interest, as all judges are required
to do. That’s a great step forward and I
am only sorry it has taken this long.

birth certificate? Have any of your children or
immediate family members or close friends
changed their gender from what appeared
on their birth certificate? Please prove those
answers by producing the long form of your

member of a political party that supports civil
and human rights for all people or conversely
have you ever been a member of a political
party that opposes civil and human rights for
any segment of society? The list of questions
could go on and on.
What this debate over Judge Walker’s
suitability to decide the Prop 8 case does in
the short run is show how imperative it is for
more members of the LGBT community to
come out. Politicians, judges, business lead-
ers and community activists need to stand up
and be counted. If we continue to hide in the

The IRS is now “recognizing” the com-
mon property of spouses and partners and

It is evidently a problem to recognize those
marriages/partnerships when it comes to dis-
tributing federal benefits and protections.
If those relationships are recognized by
the state (such as California) and then the IRS
“recognizes” the common property status
created by those relationships (recognized
by extension but none-the-less recognized)
then how pray tell is it any different for one
department of the federal government (IRS),
to be recognizing status created by marital
and partnered relationships, for the purpose
of tax collection in this case, but other de-
partments may not recognize status created
by these relationships?
Isn’t status likewise created in said states,
which could be similarly recognized as it ap-
plies to inheritance tax? To Social Security?

edging status/circumventing DOMA in one

we are hiding our sexual orientation for ne-
farious purposes rather than just fear of them.
I understand and for many years agreed
with those who say it is no one’s business.
But I reached the conclusion that we will
have to make it everyone’s business before
we see it become irrelevant. The argument
made by the Protect Marriage group with
regard to Judge Walker is that they are
fighting for a fundamental principle that no
judge is permitted to try a case in which he/
she has an interest in the outcome is ridicu-
lous in this case. They have no idea wheth-
er Judge Walker wants to get married and
the argument was turned down many years
ago when it was tried with women and
minority judges. In this case we could use
the same argument against a married het-
erosexual judge because this same group
contends that marriage between same-sex
individuals hurts heterosexual marriages
thereby making it a case that would directly
impact the deciding judge.
We as a nation need to say we will not
tolerate bigotry or those who espouse it.
The president needs to fully “evolve” and
lead. It may be too late for him to lead, but
he should follow, on this issue as for the first
time polls are showing that more than 50
percent of the nation believes that same-sex
couples should have the right to marry.
Those groups opposing it and challeng-
ing judges like Vaughn Walker will eventu-
ally be forgotten and relegated to the dust-
bin of history. But until that time we as a
community and our allies need to stand up
and speak out; and we need to come out.

Our invisible moms, dads and grandparents
Census suggests more
than 5,000 LGBT
elders living in D.C.

Did you know that there are probably
more than 5,000 LGBT seniors living in
the District of Columbia?
The newly released 2010 Census data
tells us that there are 601,723 residents in
the city. Detailed data for age groups has
not yet been released. However, based on
the most recent available age breakdown
data, the D.C. Office on Aging estimates
that the population of residents over 60
is more than 100,000. Using conservative
estimates at 5 percent to be considered
as LGBT, it would indeed mean that there
are more than 5,000 seniors among our
LGBT communities. Census data mining
alone does not offer a complete picture.
When we compare poverty and other cir-
cumstances we know that we are prob-
ably dealing with a diverse LGBT popula-
tion most likely heavily weighted toward
poverty.
Sadly, more precise information about
these lives must await a long delayed
comprehensive needs assessment. SAGE

of Congress exhibit a
milestone to celebrate

Across the street from the U.S. Capitol,
on the second floor of the Library of Con-
gress, beneath a Plexiglas case, between
a Suffragette’s scrapbook and a charcoal
drawing of Selma Alabama, lay two docu-
ments attesting to the painful history of
discrimination suffered by gay men and
women.
The papers — a 1960 Petition for Writ
to the U.S. Supreme Court appealing
the case of a federal employee fired for
being gay, and a 1966 letter from Civil
Service Commission citing “revulsion” of
gay men and lesbians as reason for dis-
missing them from federal employment
— were culled from the archive of civil
rights activist Frank Kameny, and testify
to the 50-year struggle of gay Americans
to be recognized as full citizens of the
United States with unalienable, constitu-
tional rights.
While there is nothing particularly im-

dertaking. And we will insist that data be
collected on the LGBT population.
SAGE Metro DC (Services and Advo-
cacy for GLBT Elders) is housed at the DC
Center. We are a new affiliate of SAGEU-
SA. We are in the process of finishing a
series of focus groups to determine from
LGBT seniors themselves, what programs
and services could be helpful. But SAGE
Metro DC is keenly aware that they are
as “in the dark” as most about the “invis-
ible” members of our community.
Why no real data, at least up to this
point? The government, both federal
and local, has never collected statistics
on LGBT elders and there are only a few
private non-profit groups that have col-
lected data, usually not in a comparable
format. And part of the problem is also
due to the fact that many LGBT elders
grew up in the pre-Stonewall era and had

demonstrate the Constitution’s “living”
nature, and its ability to be interpreted
by successive generations to redefine
concepts of citizenship and broaden the
meaning of who is American. The objects
were selected because as a group they
represent the long march toward consti-
tutional equality of women, the disabled,
African Americans, and now gays and les-
bians.
The Library’s public exhibition of gay
civil rights memorabilia in the context
of a shared American history is, to my
knowledge, the first time a major Ameri-
can institution has presented LGBT histo-
ry as a natural part of the American story.

environment than today. They are proud
that they were able to survive without
ending up in a prison or mental institu-
tion for being LGBT. Unfortunately, too
many still lead isolated lives. The concept
of “coming out” was not, and for many, is
still not in their vocabulary and suspicions
abound about providing even the most
general information about their lives. This
situation is very different for the LGBT
post-Baby Boomer populations that have
lived more of their lives out and proud.
So how has our LGBT community re-
sponded to the needs of the seniors
among us? With more than 150 organiza-
tions in our community, how many have
or seek members over 60 years of age?
How many of our social service organiza-
tions have targeted services for seniors?
As sensitive as we are to the terrors of ho-
mophobia, racism and sexism, how many

Rather, the exhibit seamlessly includes
gay civil rights into the story of what
unites Americans and makes us whole.
Seeing gays included in this shared his-
tory is profound, and I recommend every
gay man and women who lives in, or vis-
its, D.C. see this exhibit.
I was lucky enough to be present
on the day the papers were unveiled. I
stood before the display with wide eyes
and an open heart as I saw myself be-
come part of the American story. But
then something extraordinary happened.
A tourist stepped forward to see what the
commotion was. She paused, first over

programs in our community recognize
and have taken on ageism as just as de-
structive a force in our world? An “ism,”
by the way, that permeates across cat-
egories of gender, sex, and race.
There are a handful of other LGBT
organizations besides SAGE Metro DC
trying to respond to our seniors, includ-
ing Prime Timers of DC, a social club for
older gay men and their admirers; Metro
Retirees, a social club open to men and
women, Older and Wiser Lesbians (OWL)
and local activists in the Transgender Ag-
ing Network. There is also a coalition of
people concerned about these issues
brought together by the AARP District of
Columbia office called the Washington
DC LGBT Aging coalition.
And, thank goodness, there are sev-
eral D.C.-based senior organizations that
are reaching out and are friendly to LGBT
senior residents including the Methodist
Home, the Residences at Thomas Circle,
IONA senior services, Emmaus Senior Ser-
vices and senior “villages” in the District.
All this is a good start, but given the
estimates of the size of the population
of our invisible brothers, sisters, moms,
dads, and grandparents, there is also
much more to do.

she looked back as if to ask, “What y’all
looking at,” before moving on. You could
see her mind work “… women, the blind,
the gays … what’s so special here?”
Then it hit me, the exhibit’s signifi-
cance is neither about a lesbian see-
ing herself woven into the fabric of our
country, nor about an LGBT teen learning
about the bravery of a previous genera-
tion of gay activists. The true significance
of this exhibit is its ability to reach the
person who gives little thought to LGBT
rights, and show them that we, too, are
part of a common story. I stood there as,
again and again, tourists examined the
contents of the case and moved on with-
out a word, a look, a thought as to the
idea that gays did not belong there.
That is the promise of this display. That
across the street from the U.S. Capitol, on
the second floor of the Library of Con-
gress, before a Plexiglas case, someone
will stand looking down at these two doc-
uments and, in a quiet moment, come to
understand that we are all Americans and
equal in the eyes of our Creator. And that
moment will be truly historic.

MCC-D.C. celebrates
40 years of pro-LGBT
gospel ministry
After stabilizing its membership and attendance MCC-
D.C. experienced a boom era around 1999 and 2000
in which it wasn’t uncommon for 500 faithful to come
through the doors on an average Sunday morning.

The memories come flooding back for Candace Shultis when
asked about her 25-plus years on staff at Metropolitan Community
Church of Washington, the District’s largest mostly gay church.
She’s been gone a few years now having left to pastor a St.
Petersburg, Fla., MCC church. But so much of her ministry was
in Washington, on the occasion of the church’s 40th anniversary
— the festivities kick off tonight with an event at Human Rights
Campaign headquarters — she waxes nostalgic during an hour-
plus phone chat from her new parish. Her memories run the
gamut of human emotion, from tedium and tragedy to laughter
and tears of joy.
She remembers one anniversary weekend where outside
festivities were planned at the old M Street location. Members
asked her to pray for good weather — “I guess they figured I had
a closer connection to God about such things,” she says — only
to have it rain the entire weekend. The joke for years was never to
have her pray for weather again.
She also remembers feeling ridiculous blessing the current
Ridge Street location with former pastor, the late Rev. Larry Uhrig,
who died of AIDS in 1993, going around the new church with a
plant he’d brought from Hawaii throwing water at the building,
again in the pouring rain.
It never takes long, though, for talk of MCC’s history to come
around to the AIDS crisis, which took a staggering toll on its
members and which Shultis admits defined much of her ministry
there, especially in the 1980s and well into the ’90s.
“I think in many ways my time there, certainly for a good bulk
of it even early on in the pastorate, was defined by HIV and AIDS,”
Shultis says. “You just can’t say anything but that. It was just real
clear, this had a huge impact on the community and we lost a
lot of people. Not all from AIDS — some had heart attacks, Bob

Local gay group
working to rehab
home with Habitat

There’s an old saying that if all you have
is a hammer, everything looks like a nail.
Usually, that’s not a compliment. But it’s
a good place to begin — with hanging
wallboard, and pounding nails — if the
task at hand is to rehab a home through
volunteer labor and sweat equity, with
the dwelling to be turned over to a family
needing a hand up, not a handout.
To secure affordable home ownership
one family at a time in Montgomery County,
one of the nation’s most affluent suburban
areas, is the goal of the county’s Habitat
for Humanity affiliate, founded in 1982 but
now in a new partnership with activists in
the LGBT community and their allies in an
initiative called Pride Build 2011.
Michael Meller, who is gay and chairs the
effort, hopes to raise the $60,000 needed
to bring the 67th Habitat-sponsored
home in Montgomery County to fruition
later this year.
“Too often the LGBT community may be
viewed as separate from the community at
large, and that’s just false,” Meller says.
“We do care, we do give back, we do
want to make a better life for everybody,
not just ourselves, and this kind of project
makes it clear that the LGBT community
is in fact an integral part of the greater
community as a whole,” says Meller, a
business consultant specializing in real
estate financial and market feasibility
studies. “In doing this, we’re bringing
together a very high-profile and renowned
organization, Habitat for Humanity, which
doesn’t just go out and ask for money,
but also for blood, sweat and tears from
volunteers to get invested in the project.”
The group has $25,000 saved but
needs $30,000 to get started, then
another $30,000 to complete the project.
So the group is hosting a fundraising
reception next week featuring blue-
ribbon LGBT sponsors such as state Sen.
Rich Madaleno, and three delegates from
the county, Bonnie Cullison, Anne Kaiser
and Heather Mizeur, all from Montgomery
County, as well as Elizabeth Birch, former
Human Rights Campaign executive
director. Acting as special guest host will
be Tom Sherwood, a reporter for NBC
News Channel 4 who specializes in politics
and D.C. government. Guest admission is
$50 and host committee admission is $75.
The group will start if it reaches its
$5,000 goal. Organizations contributing
include Washington Blade, PFLAG, the
National Gay & Lesbian Task Force, the
National Gay & Lesbian Chamber of
Commerce and the Sanford and Doris
Slavin Foundation. The lead corporate
sponsor is Marriott International, which is
donating two vacations for a live auction
to be held at the reception.
The reception will take place on Thursday
at 5706 Warwick Place, from 6:30-8:30
p.m. at the home of Jeffrey Slavin, mayor
of Somerset, Md., an affluent community
of little more than 1,000 people wedged
near Chevy Chase and Bethesda close to
Friendship Heights. Joining Slavin, first
elected Somerset’s mayor in 2008, will be
two other mayors, also gay, David Lublin,
mayor of Chevy Chase and professor of
government at American University; and
Peter Fosselman, a civil engineer and
since 2006 mayor of Kensington, Md.,
and also as of last month, an appointee
of Maryland Governor Martin O’Malley as
the state’s deputy secretary of state.
Meller says his group is using this project
to get a feel for how receptive the local
LGBT community is to helping Habitat.
Meller points to Bob Bernstein, a
Bethesda resident, as the “genesis for this
idea,” after Bernstein, a Pride Build donor,
saw a similar idea at play in Portland.

Bernstein, whose daughter is a lesbian,
says. “I thought, ‘Here’s a way to step that
up and also meet a need, so a family can
get an affordable home,’ so I contacted
Habitat for Humanity in Montgomery
County, and they were equally excited to
get something similar started here.”
It’s unknown who the family receiving
the home will be. The group isn’t targeting
an LGBT family. Habitat’s Amanda Fein
says the project “will definitely” be done
by year’s end. It will likely be a house
needing significant rehab work. She says
they hope to have it selected this month.
Habitat’s modus operandi is using
volunteers — sometimes hundreds — to
build or rehabilitate houses that are sold to
qualified families at no profit and are financed
with affordable, no-interest mortgages.
Monthly payments are deposited into
a local Habitat fund that helps to build or
rehab more homes. In addition to a down
payment and the monthly mortgage
payment, the new homeowners invest,
says Fein, on average between 200 and
500 hours of their own labor into building

their own homes, these “partner families”
also attend workshops on handling money
and basic home maintenance and repair.
The next local Habitat homeownership
information session is Wednesday at 6:30
at the group’s offices at 9110 Gaither
Road in Gaithersburg, Md. Interested
people must live or work in the county
for at least one year prior to application
and be permanent legal residents of the
U.S. People must be currently living in
substandard housing conditions. They
must pre-register to attend and must pre-
qualify based upon family size and family
income, ranging from $31,050 to $36,250
for one person to $31,050 to $68,350 for
eight or more people.

selected by Habitat’s Family Selection
Committee based on housing need,
willingness to put in a set number of
hours of work themselves and their ability
to repay when the house is sold to the
selected homeowner at a below market
price and with a 30-year, no-interest

The Tony Award winning “Chicago:
The Musical” — with its heart of purest
bile, its lyrics by Fred Ebb, and its music
by John Kander — mocks everything we
claim to value in life (truth, love, justice,
you name it). On the Capitol Hill stage of
the St. Mark’s Players, consistently one of
original file: Adobe InDesign
the area’s CS5community theaters,
sharpest
it’s here through May 21.
This “Chicago” with its iconic

choreography by Bob Fosse and later Ann
Reinking is stylishly restaged by director
Rick Hayes [if circled]
and choreographer Rikki
Howie, sharply punched up with jokes and
sight gags to fit this top-notch production
neatly into the historic church’s tall-
ceilinged but narrow nave. But it delivers
the same signature Kander and Ebb tap-
dance around a seedy world of jail cells, its
story forever doomed.
The satirical story of Roxie Hart and
Velma Kelly, and how they beat their
respective murder raps, has been told
many times before. At St. Mark’s it is
· 51 MANNAKEE ST., ROCKVILLE, MD 20850 staged with all the famed double-snap,
wise crackle and syncopated pop that this
show can be at its best.
Billy Flynn is portrayed by Eric Kennedy,
who packs the part with animal appeal — a
wolf’s whistle, a fox’s morals and a cat’s grin of
self-satisfaction. Kennedy, who’s gay, imbues
Billy with oodles of smarm and charm in the
key role as the mercenary mouthpiece for
the murderesses. But he’s more than being
both sleazy and sleek in the role — Kennedy
also has a great voice and a fine soft shoe to
go with dark good looks.
Attention must also be paid to the three
women playing the two roles of Velma

a comic sensibility as well as the chops
and gams to sing and dance and just the
right mix of curve, verve and nerve as they
shimmy and shake and bring high-kicking
whoopee to their dreams of making it big
in show business.
Also noteworthy is Genevieve Williams
as their jailor, Mama Morton, with her
deep rumble of a contralto voice. With
heavy hints that she is lesbian (Billy calls
her “butch”), there’s real spice in this
Mama’s gumbo.
Heather Cipu also deserves notice —
she shines as Mary Sunshine, hitting every
high note with her operetta-soprano ode
to saccharine, “A Little Bit of Good,”
though later she drops the goodie-two-
shoes image and matronly frock to reveal
a very different persona underneath.
Finally, there is Stephen Yednock as poor,
put-upon Amos Hart, the one and only
decent person, Roxie’s good-natured
but basically dimwitted husband who is
prepared at every turn to take the fall for
her if he can. Yednock brings real feeling
to several songs, especially his solo
lament, “Mister Cellophane.”
This staging of “Chicago” is simply
great right down to the terrific ensemble
who among them function like a chorus,
singing and dancing different roles,
including the females in a first-rate “Cell
Block Tango,” wicked and wonderful in red
lips and black leather, and in the opening
song, “All That Jazz.” Other show-
stoppers include “We Both Reached for
the Gun” and “Nowadays.” Special kudos
go to the show’s director, Rick Hayes, also
the Players’ artistic director, and as the
musical director, the veteran musician J.
N. Wickert III, at the baton of an 11-piece
orchestra. Both are gay, as is the Players’
president Jerry Dale Jr., who also serves as
stage manager for this show.

Throughout her long career in show
business, Terri White has certainly sung
her share of Stephen Sondheim tunes
in nightclubs and piano bars, but it’s not
until now that she is actually tackling a full-
fledged role in one of his musicals.
As has-been dancer Stella Deems in
Sondheim’s nostalgic backstage story
“Follies” (currently enjoying a much
anticipated run at the Kennedy Center),
White, who is also gay, feels she’s found
the part of a lifetime.
“I first saw ‘Follies’ when it opened on
Broadway in 1971,” says White, 62. “And over
the years I’ve sort of grown into the part.” Not
only do White and her character both share
roots in theater of a different era, they also
know what it means to step away from show
business and find respite in sunny Florida.
“It’s uncanny,” White says. “It’s as if Stella was
written especially for me. I’ve just had to wait
40 years to be old enough to give it a try.”
Considered among the best of
Sondheim and James Goldman’s
collaborations, “Follies” is a hauntingly
beautiful tribute to lavish revues and
increasingly complicated lives. Gathered
for a final goodbye in a once grand New
York theater on the eve of its destruction,
a group of former showgirls reminisce
about the glamorous, good old days and
share where their post-chorine lives have
taken them. On top of Goldman’s rich
libretto, the show boasts a memorable hit
laden score: “Broadway Baby,” “I’m Still
Here,” “Too Many Mornings,” “Could I
Leave You?” and “Losing My Mind.”
With a multi-million dollar budget,
a 28-piece orchestra, and a large
cast including megawatt dames like
Bernadette Peters, Elaine Page and Linda
Lavin, the Kennedy Center’s “Follies”
(staged by gay director Eric Schaeffer) is
produced big as it should be, says White.
“And there are no divas here,” she adds.
“It’s a brilliantly cast group of professionals
who’ve come not only to work, but also to

enjoy ourselves while we’re here. I respect
all the ladies and relish the opportunity to
share the stage with them.”
As a kid, White was part of the family act
the White Quartet, and travelled the South
and the Midwest performing on the TOBA
— Theater Owners Booking Association,
or more familiarly known to performers as
Tough on Black Asses — circuit.
“My father was a crooner and a hoofer.
He taught me to tap dance and put me
on stage when I was 8. Times were often
tough. Sometimes managers didn’t pay us
and we’d get very low on funds,” she says.
White’s Broadway and off-Broadway
experience includes Joice Heth in
“Barnum,” “Ain’t Misbehavin’” as Neal,
gay director/choreographer Tommy Tune’s
“The Club” (Obie Award 1976) in which she
literally tap danced from her entrance to her
exit, “Nunsense,” “Stepping Out” at Radio
City with Liza Minnelli, “Chicago,” and the
recent revival of “Finian’s Rainbow.”
Despite her big talent, White has known
lulls in her career. After appearing in Tony
Award-winning “Barnum” on Broadway in
1980, White was unable to find similar gigs
for eight years. “I was effectively blacklisted
for being gay,” she says. “There were a lot
of gay men in the theater, but you didn’t
see a lot of openly gay women performing
on Broadway then or now.”
In 2008, White lost her apartment and
slept in Manhattan’s Washington Square
Park for three months. With the help of
friends she found a signing gig in Key
West, Fla., where she met her wife and
business partner Rhonda Everett. A
year later the couple was celebrated a
commitment ceremony on the stage of
the St. James Theater where White was
playing in “Finnian’s Rainbow.” Shortly
thereafter, they were legally married in
nearby Connecticut.
“For now,” White says, “I’m happy
playing this incredible part Stella in
‘Follies.’”

It’s painful when a long-awaited album
from a much-loved artist finally appears
and is a disaster.
The pain is especially acute on Aretha
Franklin’s new album, the Wal-Mart
exclusive “A Woman Falling Out of Love.”
Rumors swirled wildly last fall that she
had pancreatic cancer — Rolling Stone
even went to press with the news citing
anonymous Franklin family members.
So it’s a delight and huge relief to see a
much trimmer Aretha — she lost about
85 pounds — back on the media circuit,

Falling” had been a solid, career-punctuating
comeback on par with her last good album,
Signature 1998’s “A Rose is Still a Rose.” Sadly, it’s her
worst album in ages joining schlock like
“Almighty Fire,” “You,” “Sweet Passion” and
“Get it Right” as some of the least compelling
junk in her vast discography.
Aside from the fact that she’s healthy
and, based on last week’s TV promo
appearances, in reasonably good voice, the
good news is that the album is out at all.
She was predicting an imminent release as
far back as 2006 when she first mentioned
the title to Billboard. It was so unfathomably
delayed, it became almost a joke, sort of
R&B’s answer to “Chinese Democracy,” the
decade-in-the-making Guns n’ Roses album
that finally saw release in 2008. Thankfully
active on the touring circuit, Franklin’s studio
output ground nearly to a halt in the last
10 years. There was an uneven Christmas
album in 2008. Her last “real” album was
2003’s “So Damn Happy.” It felt hit-or-miss
at the time; it plays like a masterpiece,
though, compared to “Woman Falling.”
Left to her own devices, Franklin
stumbles badly here churning out an
inconsistent and all-over-the-map sonic
mess that struggles to muster even
one catchy hook or chorus. “This You

produced), “Put it Back Together Again,”
“When 2 Become One” and first single
“How Long I’ve Been Waiting” sink like
quicksand in a soggy stew of momentum-
sapping and dated-sounding R&B drivel.
Franklin, thankfully, sounds great. Her
voice — while not quite the rafter-raising
feat of nature it was 30 years ago — still
has a luster and sheen that’s delightful to
hear. In a way, though, it makes this album
doubly tragic — with better material,
it’s obvious Franklin possesses the vocal
wherewithal to have produced a home run.
The covers are hit or miss, but two of
the three are the record’s high points. A
sassy, bluesy cover of B.B. King’s “Sweet
Sixteen” promises early hope but proves
an isolated and fleeting moment. A duet
with an oddly uncredited Ronald Isley on
“The Way We Were” is sweeping and
feels positively glorious compared to
everything else.
The insipid “New Day” sounds like a
promising change of pace initially with
its deep bass line but soon dissolves into
trite lyrics (“you can make it if you try!”).
“Faithful,” a duet with gospel’s Karen
Clark-Sheard is so ludicrously oversung it
makes Christina Aguilera sound reserved.
And despite a Billy Preston-caliber
organ accompaniment courtesy of Darrell
Houston, “His Eye is On the Sparrow”
shows merely that Franklin’s son Eddie,
singing lead here, inherited his mother’s
range but not her interpretive finesse. She
accompanies him on piano. It gives the
album warmth, but since Aretha’s never
recorded this standard herself, I’d have
much rather heard her sing it.
The album closes with a bombastic
rendition of “My Country Tis of Thee,” which
Franklin sang at Obama’s inauguration.
She battled the cold that day — here she
battles an overwrought orchestration (her
own arrangement) that never met a musical
cliché (rumbling timpani!, gospel choir on
caffeine!) that it didn’t try to work in.
Franklin said she cut tracks with Faith Hill,
Shirley Caesar and several producers for this
album but they’re all MIA. It’s impossible to
know how much was recorded over the last
five years for this album but considering
what made the final cut, one shudders to
imagine the outtakes. From the amateur
photography and packaging to the
dubious selections and bland production,
this is a near-total disaster.

When the Trey McIntyre Project performs
tonight in Washington, viewers, obviously,
will have a sense of what they’re in for. But
that’s not always the case in Boise, Idaho,
where the company is based.
The 41-year-old Trey McIntyre chose the
unlikely locale after a nationwide search for
a host city and, all things considered, found
Boise the best fit. His dancers have made
a splash there by launching what they
call “SpUrgans” — spontaneous urban
performances — where McIntyre says, “we
will go into an office or into a park, or into
a restaurant, do our dance and get out,”
basically, guerilla-style dance done with a
boom-box for music and flying feet and
swiveling hips, startling observers.
The whole point of a “SpUrban,” he
says, is to surprise, to connect viscerally
and unexpectedly, site-specific however,
seeing the dance environment writ large
— to go directly where people live and
work in the community itself. His dancers
also perform at games of the Idaho
Stampede, the local NBA team, where
they sold 300 tickets to one performance.
This weekend’s performance, of course,
will be less out of the blue.
At Harman Hall, McIntyre promises a

McIntyre says he never came out per se. New Hope, Bucks County Pa.
His parents asked him about it when he

his dance career after leaving home at 17
for the Houston Ballet Company. By 19 he
was hired, enjoying a long run there that
lasted until 2008 by which time he had
been working as a choreographer, his own
dancing days ending in the mid-’90s.
McIntyre’s partner of eight years,
29-year-old John Michael Schert, met in
New York and knew early on they’d form
a company together. It began in 2005
as a summer touring company and was
established in 2008 as a full-time company, Painting by Dwayne Dunlevy
now with 10 dancers.
The dancers — now five males (including
Schert) and five females, salaried for 35
weeks a year and with full health benefits
— are happily settled in Boise. Now in
their third year there, they are also touring
with upcoming concerts at Harman Hall in DO tell-equality for all.

Out soprano in ‘Iphigenie’
The Washington National Opera will be performing Gluck’s “Iphigénie en
Tauride” starring out soprano, Patricia Racette, at the Kennedy Center (2700 F St.,
N.W.) this weekend and through May 28.
“Iphigénie en Tauride” is about Iphigénie, saved by the goddess Diana then
held captive to serve as her high priestess. She must decide if she will obey the
King Thoas and sacrifice two strangers, including her brother Oreste.
Racette, a lesbian, last performed at WNO in “Peter Grimes” in 2009. She has
also performed with the Metropolitan Opera, San Francisco Opera, Lyric Opera
of Chicago, Houston Grand Opera and the Santa Fe Opera.
Sunday’s performance will be followed by question-answer session with
Christina Scheppelmann, WNO’s director of artistic operations and select cast
members.
“Iphigénie en Tauride” is performed in French with English supertitles. Tickets
range from $25 to $300.

‘Carmen’ to close season
The gay-helmed Washington Ballet is closing its 210-2011 season with “Carmen,”
opening Thursday at 8 p.m. at the Harman Center for the Arts (610 F St., N.W.).
The program will also feature the premiere of Associate Artistic Director David Palmer’s
“Passing Through” and Edwaard Liang’s “As Above, So Below.”
The show runs through May 22. Tickets range from $20 to $87 and can be purchased

Exhibit honors AIDS history
The National Museum of American History (1400 Constitution Ave., N.W.) will mark the
30th anniversary of the emergence of the HIV/AIDS epidemic with a three-part display
and website opening June 3.
One display, “HIV and AIDS Thirty Years Ago,” will look at the early phase of the
pandemic. Located in the “Science in American Life” exhibition, this display will feature
photographs, magazine covers and the equipment Dr. Jay Levy used to isolate the virus.
Another display, “Archiving the History of an Epidemic: HIV and AIDS 1985-2009” will
how people were affected by the disease. In the museum’s Archives Center, this display
will feature popular culture materials including posters for the 1993 movie Philadelphia,
photographs and quotations from oral histories.
The last display will be of a panel from the AIDS Memorial Quilt of the Names Project
Foundation honoring Roger Lyon, who died of complications from AIDS in 1948, not long
after he testified before Congress to get funding to combat the epidemic.

Rock steady
New gay climbing
group meets in Rockville

Being out in nature can be a peaceful
experience and can bring a sense of calm
for most people.
Being out in nature can also be a heart
thumping experience depending on what
you have chosen to do with your time with
Mother Nature.
I once put in four days of climbing on
the Appalachian Trail in the Shenandoah
Valley. Considering how many rock faces
I fell off during one particularly rainy day,
I could have benefited by spending some
time with Rainbow Climbing D.C.
This LGBT rock climbing group is a
relatively new entity under the Team
D.C. umbrella. Led by Chris Gorham, its
members can usually be found at Earth
Treks in Rockville on Tuesday and Thursday
nights and sometimes on weekends. For
beginners, this would be a great place to
start. The club has no member dues, but the
climbing fees at Earth Treks run around $20.
Rainbow Climbing D.C. has hosted
two local outdoor climbs recently in
Carderock, Md. The site is located on the
Potomac and there is climbing available
on both sides of the river. Carderock offers
four top rope climbs and is a great place
for beginners to try outdoor rock climbing.
Gorham says it’s also a great place to
hang out and the group will be planning
another trip to Carderock soon.
As is the case with all the local LGBT sports
clubs, there is a national organization that
helps network the athletes. In rock climbing,
it’s Homo Climbtastic. Its people help LGBT
climbers and their local clubs connect with
other climbers and clubs. Its website is also
a public blog I found pretty entertaining

Homo Climbtastic also hosts two
climbs annually and taut those as the
worlds largest queer-friendly climbing
conventions. Gorham just returned from
the most recent convention in Bishop,
Calif. One of the attractions in Bishop
were two multi-pitch lead climbs with
vertical elevations of 120 to 200 feet.
The next Homo Climbtastic convention
will be held from July 14-18 at New River
Gorge in Fayetteville, W.V. New River
Gorge is the most popular rock climbing
and rappelling destination in the eastern
United States. Also located nearby is
Summersville Lake which is a 28,000 acre
body of water known nationwide for its
variety of sports attractions.
At the 2010 Gay Games in Cologne,
sport climbing was one of the sports
contested. While Cleveland/Akron has
not announced its sports for 2014, there is
a good possibility that sport climbing will
be on the list. Sport climbing is a style of
rock climbing wherein a climber ascends
a route that already has permanent bolts
and anchors attached on the rock wall.
Sport climbing is considered the safest
style of climbing because the climber is
able to clip to the bolts which are generally
8 feet apart. The chance of falling is greatly
diminished. Since the element of danger
is reduced, sport climbing emphasizes the
gymnastic and athletic aspects of climbing.
It focuses on the development of the
climber’s stamina, strength and flexibility.
According to Gorham, the best way
to catch the rock climbing vibe is to put
yourself out there in different locales with
different climbers. Besides the group’s
usual climbing at Earth Treks and the
occasional Carderock trip, the climbers will
also be at Sport Rock in Alexandria on May

early 2010 after a lengthy national search.
He volunteered at the D.C. church from ’89
to ’92 and has high praise for both Uhrig
(whom he calls “incredibly passionate —
prophetic in the best sense of the word”)
and Shultis (“strength, integrity and
grounding”).
Despite the adage that Sunday
mornings provide the U.S. with its most
segregated hour, MCC-D.C. is widely
known for its healthy interracial mix
and array of ages. Shultis says it wasn’t
always that way and in its early years was
dominated by white gay men, a trend she
was eventually concerned about.
Shultis put her neck on the line during
a heart-to-heart with Uhrig when she was
still assistant pastor and said, “You have
got to pay more attention to women,
more attention to people of color, the
music had to change, the attitudes had to
change … it took a lot of time to change
the ratios but I think he really listened.
Things began to change after that.”
Shirli Hughes, the church’s minister of
music since 2001, says it’s important to honor
the church’s past, a reason she’s excited
about the bounty of anniversary festivities
that are planned throughout the year.
“It’s taking all of that rich history of what
has been our past and all those saints who
have gone on before us and the sacrifices
that so many have made to make it
possible to be where we are today,” she
says. “It’s taking that collective wisdom
and energy and using it to propel us into a
new vision, to really embrace the limitless
possibilities of the future.”
But now with so many mainline Christian
churches opening and welcoming LGBT
believers, is MCC-D.C. in danger of
becoming an anachronism? Has the
decline in attendance been partially due
to that trend?
Johnson says no.
“The difference is we’re not just an
affirming church, it’s hard to find the
right language,” he says. “I don’t want to
bash any other churches by any means,
but I think it’s because of MCC in a lot
of ways that other churches even started
opening their doors [to gays]. There were
many, many years when it was just us.
And many others are still fighting that
battle internally. … Other churches may
welcome and affirm you but we are you.”
Sue Elliott, an Upper Marlboro, Md.,
resident who’s been active in the church
since the early ’90s, knows what that feels
like first hand. It’s a big reason she’s been
in the church choir and on the church’s
vestry council for so long.
She says the 40th anniversary comes
as no surprise considering how much the
church offers.
“I never thought for a minute it wouldn’t
be here to see 40,” she says. “I’m excited.
We’re moving forward and have a lot of
new things planned. I never doubted for a
minute that it would last.”

Botox and other injectables have been
around for a long time, but there are still
myths that persist about this procedure.
Many people are interested in trying it
out, yet some have reservations about
