My client takes a strong and serious exception to the Article published in “The New Indian Express” dated 02.06.2011 under the heading “Minister Steals a telephone exchange, loots BSNL.” in which false, scandalous and baseless allegations has been made against my client with a sole malafide intention to defame my client. The said article has been written by Mr. S. Gurumurthy who is a prominent person in the vested interest lobby which is acting against my client. The summary of the allegations in the article is that my client established a BSNL Telephone exchange with 323 home lines at his residence and the same was connected by secret cable from my clients residence to Sun TV network and the same was used by Sun TV for its telecasting operations. The article further alleged that such service was also connected to Office of the “Dinakaran” the Tamil News Paper. All the above allegations and the other allegations in the article are specifically denied as false, motivated, baseless, scandalous, defamatory and derogatory. The BSNL further clarified that from the date of installation to till March 2009 out of eligible 4,50,000 eligible meter call units for three years my client has used only 1,73,698 metered call units and my client has not exceeded his eligible metered call units. The billing information along with metered unit calls is sent monthly to Liason Officer, Parliament - LOP and there were no outstanding dues payable by my client. The copy of the letter dated 04.05.2009 written by V.Meenalochini, General Manager, (OP), Chennai Telephones, BSNL is enclosed. The above letter clearly proves that the allegations made against my client are false and baseless. My client issued a legal notice dt. 25.04.2009 to “Dinamani” and other news papers who had published and carried the false and defamatory news item. Further, the Hon’ble Chief Minister of Tamil Nadu Selvi J. While so, in a matter which is subjudice before the Courts of Law without verifying the veracity and reality and without waiting for the outcome of the legal battle, publishing the same article is nothing but not only interfering with the administration of justice but also with sole intention to mar the reputation and goodwill of my client. Attributing false, frivolous and motivated allegations with regard to a subject matter which is already pending before the Courts of Law for adjudication is nothing but abuse of process of law intended to gain cheap publicity for ulterior gains. My client empathetically denies all the allegations leveled against him in the article, as a Minister my client performed to the best of his abilities by placing India in the forefront of Telecommunication system. You have made these false allegations in the article with a sole purpose of defaming my client knowing fully well that the allegations are false and the same will bring down the reputation of my client without proper verification of facts and without ascertaining the real facts from my client. My client states that it is the duty of a responsible newspaper being the fourth estate of the Nation to verify the genuineness and correctness of the news article before publication.
