The attention of the of all RJDSEs / DEOs in the State is invited to the references
read above, and they are requested to comply the interim orders passed by the Hon'ble
Andhra Pradesh Administrative Tribunal strictly to the extent of applicants only in the
following issue in the ensuing transfer counseling, 2011 under intimation to this office
and G.P. for School Education Andhra Pradesh Administrative Tribunal, Hyderabad
without fail.

Certain Applicants filed O.A.No.3370/2011 and batch before the Hon'ble Andhra
Pradesh Administrative Tribunal on the contention that they are entitled to be retained in
the same school, as G.O.Ms.No.55 dated.23.04.2011 is not applicable in the
rationalization scheme to the applicants, even though the applicants are not eligible to
participate in the Transfer Counseling as they did not complete minimum two years of
service.

The Hon'ble Tribunal on 02.06.2011 is pleased to pass the following interim

orders:
“1. The respondents shall take into consideration the entitlement points of
the respective applicant in the previous transfer counseling.

2. The respondents are also directed to add the entitlement points to

which each applicant is entitled to from the date of joining the present station till
they are transferred. If the applicants are not given the benefit of Rule 8 and 9 of
G.O.Ms.No. 65, they shall also be extended the said benefit.

3. The respondents are also directed to allow the applicants to participate

in the transfer counseling and consider the case of the applicants according to
their entitlement points in the ensuing transfer counseling.

4. If the benefits of directions 1 to 3 are extended, the respondents need

not extend 15 entitlement points to the applicants which they propose on account
of premature transfer.

Receipt of the proceedings should be acknowledged.

Certain applicants (Headmasters) filed O.A.No.3447/2011 and batch before the

Hon'ble Andhra Pradesh Administrative Tribunal on the notification of all vacancies to
enable them to participating in the Transfer Counseling to try for better places, according
to their entitlement points.

The Hon'ble Andhra Pradesh Administrative Tribunal is pleased to pass the

following interim orders:

“The Applicants are contending that they were promoted as Headmasters

during January, 2009 and, in order to accommodate seniors, they were disturbed
in July, 2009 and posted to the places where the vacancies are available.
Subsequently some of the juniors were promoted from September, 2009
onwards till April, 2011 and they were accommodated in better places.
Therefore, the Applicants requested to notify all those vacancies to enable them
to participate in the transfer counseling to try for better places according to their
entitlement points.

In the light of the above circumstances, the Respondents are directed to

notify all the vacancies of P.G. Headmasters / Grade-II Headmasters (Gazetted)
who are promoted from September, 2009 to April, 2011 in the ensuing transfer
counseling.”

School Assistant (Phy. Sci.) and they are being shifted as School Assistant (Phy. Sci.)
and School Assistant (Maths) in the ensuing transfer counseling, though they have not
completed two years of service in their respective stations in which they are presently
working. Hence they requested to retain in the same school.

The Hon'ble Tribunal on 03.06.2011 is pleased to pass the following interim

orders:

“1. The respondents shall take into consideration the entitlement points of
the respective applicant in the previous transfer counseling.

2. The respondents are also directed to add the entitlement points to

which each applicant is entitled to from the date of joining the present station till
they are transferred. If the applicants are not given the benefit of Rule 8 and 9 of
