Council OKs ordinance after silent public hearing Monday

Dexter village residents who exercise their rights under the Michigan Medical Marijuana Act are now covered in the villages code of ordinances. The Village Council approved the ordinance changes after a silent public hearing Monday evening. The ordinance additions include the definition of home use occupation, which is in congruence with the state law, which allows qualifying patients registered with the Michigan Department of Community Health to legally cultivate medical marijuana at their primary residence for personal use with assistance from a primary caregiver. The intent of the zoning ordinance is to regulate medical marijuana home occupations by providing for regulations and feeds

in a manner that promotes and protects the public health, safety and welfare, mitigates the potential impacts on surrounding properties and person and that conforms with the policies and requirements of the MMM Act, the ordinance reads, with the following regulations included: - The medical use of marijuana shall comply at all times and in all circumstances with the Michigan Medical Marijuan Act and the General Rules of the Michigan Department of Community Health, as they may be amended from time to time. - Medical Marijuana Home Occupations are not permitted within 1,000 feet of a public school or public library in accordance with the Drug Free School Zone Act. - All medical marijuana shall be contained within the main building in an enclosed, locked facility.

- The registered primary caregiver may cultivate marijuana for compensation, for up to five patients, plus themselves, to whom the primary caregiver is connected through the Michigan Department of Community Health registration system. - No patients to whom the primary caregiver is not connected through the Michigan Department of Community Health registration system are allowed to purchase or receive

mechanical permits shall be obtained for any portion of the residential structure in which electrical wiring, lighting and/or watering devices that support the cultivation, growing or harvesting of marijuana are located. - If a room with windows is utilized as a growing location, any lighting methods that exceed usual residential periods between the hours of 11 p.m. and 7 a.m. shall employ shielding methods, without altera-

Hazels to mark 2 years

As Hazels Home Cookin approaches its two-year anniversary, owner Denise Livingston says that business has been brisk, but there are still a lot of people who dont realize that for the price of the average fast food combo item folks could be eating nutritious, filling home-cooked meals for the same price. Hazels opened its doors in the historic post office building at 8050

Main St., which used to be a United States Postal Service outpost. The building is currently owned and leased out by the village government. Although Livingston converted her lease from a yearly basis to monthto-month, she says that Hazels is still going strong. Village President Shawn Keough looked slightly disappointed as he informed the council and the public during his comments portion of this weeks meeting that the villages pursuit of cityhood had hit another snag. The village will have to wait until the Michigan Boundary Commissions Aug. 18 meeting for clarification on whether an exception filed by municipal attorney William Fahey on behalf of Webster Township has any legal standing when it comes to the question of whether or not Dexter village should be Dexter city. The attorney general is going to provide a written opinion (in the meantime) on whether the challenge is taken into consideration, Keough explained to those at the meeting. The state surveyor that recommended our petition go forward found it legally sufficent. He said that he had

an informal conversation with the attorney general, on whether a Public Act 425 Agreement between the village and the township caused a conflict, since properties included in the agreement are also included within the legal boundary that the village submitted to the commission in its petition. After a previous petition including a non-contiguous border was submitted to the commission last year, the village had to reboot the process and proceed forward with the new legal map, containing the subdivision of Westridge, the Cedars of Dexter retirement community development and the historical Gordon Hall structure and grounds, all of which are currently within the Webster Township border. The new filing was submitted to the commission on April 12 last year. The previous petition was the villages best attempt to keep the current
