WHEREAS, Ordinance No. 07, series of 1994, which provides for a comprehensive policy guidelines in the implementation of Presidential Proclamation No. 887, defines underprivileged and/or landless citizens as individuals or families residing in the City whose average monthly income or combined household income is less than Five Thousand pesos (P5,000.00); WHEREAS, the poverty threshold, or the level at which a person can be considered as poor or underprivileged, for Southern Mindanao as determined by the National Statistical Coordination Board is pegged at P8,201.00 in 1994, P10,503.00 in 1997 and P12,430.00 in 2000; WHEREAS, the latest available poverty threshold survey published by said government agency for the province of South Cotabato for year 2007 is P16,136.00 for urban areas and P13,897.00 for rural areas; WHEREAS, it is imperative to attune such provision of Ordinance No. 07, series of 1994, with the foregoing economic indicators by way of adjusting the level of average family income or combined family income to a more realistic one; NOW, THEREFORE, on motion of City Councilor Ramon R. Melliza, duly seconded by City Councilors Jose Orlando R. Acharon, Lourdes F. Casabuena, Minardo A. Avila Jr., and Eduardo D. Leyson III, be it RESOLVED, as it is hereby resolved, to enact this Ordinance: ORDINANCE No. 02

AN ORDINANCE AMENDING SECTION 3 (D), ARTICLE I OF ORDINANCE NO. 07, SERIES OF 1994, WHICH PROVIDES COMPREHENSIVE GUIDELINES FOR THE IMPLEMENTATION OF PRESIDENTIAL PROCLAMATION NO. 887, RE: "FURTHER AMENDING PROCLAMATION NO. 2029, DATED NOVEMBER 11, 1980, AS AMENDED BY PROCLAMATION NO. 2162, DATED FEBRUARY 12, 1982, WHICH ESTABLISHED THE MINDANAO STATE UNIVERSITY-GENERAL SANTOS CITY UNIT, CIVIL RESERVATION AND THE HUMAN SE ILEMENT SITES FOR I LANDLESS FAMILIES LOCATED IN GENERAL SANTOS CITY"

Be it enacted by the Sanggunaing Panlungsod of General Santos that:

Section 1. Section 3 (D), Article I of Ordinance No. 07, series of 1994, is hereby amended to read as follows: "(D) Underprivileged and/or landless citizens refer to individuals or families residing in the City whose average monthly income or combined household income is not more than Sixteen Thousand pesos (816,000.00)." Section 2. The provision of Section 3 (D), Article I of Ordinance No. 07, series of 1994, is so far as inconsistent with the provision of this Ordinance, is hereby repealed, amended or modified accordingly. Section 3. This Ordinance shall take effect on the day after fifteen (15) days following its publication in a newspaper of general circulation within the City of General Santos.
