When was New Exploration Licensing Policy (NELP) launched?

Government of India approved the New Exploration & Licensing Policy (NELP) in1997 and it became effective in February, 1999 Since then licenses for exploration are being awarded only through a competitive bidding system and National Oil Companies (NOCs) are required to compete on an equal footing with Indian and foreign companies to secure Petroleum Exploration Licences (PELs). Seven rounds of bids have so far been invited under NELP, in which, 206 exploration blocks have been awarded. In addition, 28 exploration blocks were signed prior to NELP. Under NELP, 68 oil and gas discoveries have already been made in Cambay onland, North East Coast and Krishna-Godavari deepwater areas, for which, development plans by the operators, viz., Cairn, RIL and Niko are in progress. First crude oil production from deepwater in KG basin has commenced at the rate of 10,000 barrels of oil per day w.e.f l7th September 2008. Natural gas production from KG basin is likely to commence in 2009. With Exploration and development efforts made under NELP, Natural Gas production in the country is likely to be doubled from the present level of gas production of about 90 million standard cubic metres per day (MSCMD) by end of l1th Five Year Plan.

What are the main terms and conditions of NELP?


The main features of NELP are as under: i) ii) iii) No mandatory state participation through ONGC/OIL or any carried interest of the Government. Blocks to be awarded through open international competitive bidding. ONGC and OIL to compete for obtaining the petroleum exploration licenses on a competitive basis instead of the existing system of granting them PELs on nomination basis. ONGC and OIL to get the same fiscal and contract terms as private companies. Freedom to the contractors for marketing of crude oil and gas in the domestic market. Royalty at the rate of 12.5% for the onland areas and 10% for offshore areas. Half of the royalty from the offshore area to be credited to a hydrocarbon development fund to promote and fund exploration related activities, such as acquisition of geological data on poorly explored basins, promotion of investment opportunities in the upstream sector, institution building etc. Royalty to be charged at half the prevailing rate for deep water areas beyond 400 m bathymetry for the first 7 years after commencement of commercial production. Cess to be exempted for production from blocks offered under NELP.

Companies to be exempted from payments of import duty on goods imported for petroleum operations. No signature, discovery or production bonuses. Seven-year tax holiday from the date of commencement of commercial production. Fiscal stability during the entire period of contracts. A separate Petroleum Tax Guide (PTG) to facilitate investors. A Model Production Sharing Contract (MPSC) which is reviewed for every NELP round. Contracts to be governed in accordance with applicable Indian Laws.

Terms beneficial to private companies under NELP?


Terms Beneficial to Private Investors under NELP as compared to terms for earlier rounds: i) ii) iii) A carried interest of national oil companies at 30% has been abolished. Companies are exempted from payment of cess. Companies are free to have 100% participating interest as against the earlier regime where up to 40% participating interest was to be hold by NOCs. This will also provide operational flexibility to the companies in selecting partners of their choice. Incentive for deepwater exploration with only half of the royalty payable in the initial seven years from the commencement of commercial production. Seven years tax holiday from the date of commencement of commercial production. Contribution made to Site Restoration Fund Scheme is deductible in the year of contribution as against in the year of site restoration as per the earlier the provisions of the Income-tax Act. Freedom to market oil and gas in the domestic market.

Terms beneficial to NOCs under NELP?


Terms Beneficial to National Oil Companies: i) NOCs are exempted from payment of cess under NELP and the maximum royalty rate under NELP is 12.5% of international price as against 20% of the administered price in non -NELP areas.

Exemption from payment of customs duty. NOCs to get international price on their production of oil and gas. Seven years income tax holiday.

The profit petroleum is calculated every year based on the revenue generated from the project and costs incurred by the contractor. NELP model of profit petroleum computation supports higher profit petroleum share to the Government at higher prices higher production of oil and gas.

What is the status of oil & gas production from NELP blocks in Gujarat?
Commercial production of gas has commenced from the NELP II block CB-ONN2000/2, operated M/s Niko resources at the rate of 0.3 MMSCMD from the year 2004 onwards. The gas price realized by NIKO is about US$ 4.50 per MMBTU. Commercial production of oil has commenced from July 2007 from the block CBONN-2000/1 operated by M/s GSPC at the rate of 700 barrels per day. First deepwater crude oil production from the block KG-DWN-98/3 has been commenced at the rate of 10,000 barrels per day from I7th September 2008.

What is the Position of Hydrocarbon Reserves in the country as on 1st April, 2008?
Total Prognosticated Resources of the country has been estimated at about 28 billion tons. As on 1st April, 2008, oil & gas reserves are of the order of 1860 MTOE provisionally. The break-up of Initial In-Place, Ultimate Reserves and Recoverable reserves is given below:
