Gay and Lesbians Minority Rights


In my opinion, minoritys problem is common in all of the part of this world. Even if there are living creatures that exist in mars, then, it will also appear such problem, because it is difficult to have absolute justice to all people. Justice in my opinion is relative. Minority problem often related to the problem in which the minority (as the opposite of majority) is ignored or violated both in the rights and in the existence. The minority as stated in Jabareen (2008) is a group numerically inferior to the rest of the population of a State and in a non-dominant position, whose members being nationals of the Statepossess ethnic, religious or linguistic characteristics differing from those of the rest of the population and show, if only implicitly, a sense of solidarity, directed towards preserving their culture, traditions, religion or language. (p.640). From the definition above, the problem occur when a group which is small in number is ignored, or if it is not then, controlled or forced by the majority. According to Kymlicka (2007) for the first few decades of the twentieth century, the minority problem was seen primarily as an issue of irredentist minorities. Minority rights is, by the intention, emerged to protect the rights of those minority people or creature. (p.28) But surprisingly, there is no clear and tough definition of what area of minority rights should be covered and protected. There great ambiguity and bias of what the definition of Minority rights is. Therefore, the minority rights, which actually intended for the sake of human life virtue, can be mis-interpret and mis-use. The result may be an unpredictable badness. Take for example when Gay and Lesbian want their existence be admitted by using tool namely minority rights. Under this umbrella, Gay and Lesbian want their wrong and bad style of life to be justified. I say wrong and bad because, there is no, even single, religion which consider Gay and Lesbian as normal. All religion has the same opinion that becomes Gay and Lesbian is a sin. In Bible we can see the proof in Leviticus (18:22) says, "Thou shalt not lie with mankind, as with womankind: it is abomination." Additionally, Leviticus (20:13) says, "If a man also lie with

mankind, as he lieth with a woman, both of them have committed an abomination: they shall surely be put to death; their blood shall be upon them." These verses clearly prohibit homosexuality in very strong terms. Islam does also condemn homosexuality, it can be seen in Quran "We also sent Lut : He said to his people : "Do ye commit lewdness such as no people in creation (ever) committed before you? For ye practice your lusts on men in preference to women: ye are indeed a people transgressing beyond bounds." (Qur'an 7:80-81), "What! Of all creatures do ye come unto the males, and leave the wives your Lord created for you? Nay, but ye are forward folk." (Qur'an 26:165). In Hinduism, we can see the verse which prohibit homosexuality as in Manusmriti (11.68). "A twice-born man who engages in intercourse with a male, or with a female in a cart drawn by oxen, in water, or in the daytime, shall bathe, dressed in his clothes." Further we can see the Indonesian stance is against Gay and Lesbian. Indonesia contains the most Muslim people in the world with 89% of its citizens identifying themselves as Muslim. The family policy of the Indonesian authorities, the social pressure to marry and religion means that homosexuality is generally not supported. Both traditionalists and modernist Muslims generally oppose homosexuality. Many Islamic fundamentalist groups such as the FPI (the Front of Supporters of Islam) and the FBR (Betawi Council Forum) are openly hostile towards Gay and Lesbian people by attacking the home or work of those they believe are a threat to the values of Islam. What I am trying to say actually is, sometimes it is not mere because some group of people is minority in the quantity or power, so that we have to protect that minority group by giving them minority rights. Further it is also important to know and consider the reason, intention, condition, and also the implication why those minority groups are treated unjustly. Since the definition of minority rights is not clearly stated, it may possibly lead to the misuse of it to attack majority rights.
