SPROUT WEDDING AND EVENT CONTRACT

DEPOSIT: The client agrees to pay a NON-REFUNDABLE deposit of $200 to book Sprout. This deposit will be applied to the cost of the event. Sprout will accept cash, personal and bank checks, money orders, and credit cards for the deposit. TERMS: Payments, excepting deposit, must be in cash, bank check, or money order ONLY. Absolutely NO credit cards or personal checks will be accepted. The balance is due two weeks prior to the event date. If the event is booked less than two weeks prior to date then the entire amount is due upon booking. No guarantee is given that the exact choice of flowers will be available on orders made less than two weeks prior to the event. Color and style will match as closely as possible. CONSULTATIONS: Acceptance of this contract entitles the client to a 30 minute Quick Quote, a Design Development meeting of 1-2 hours, and a Review meeting of 30 minutes. Additional consultation time is billed in full hour increments of $50 per hour. Off site inspections are available by appointment for a $50 per hour fee including travel time. Any accumulated consultation fees need to be paid for before the flowers are delivered. CANCELLATIONS: The client understands this is a custom order. The client also understands if payment is not made in full two weeks prior to the event date, this contract is canceled and all payments are forfeited. Contract cancellation must be made in writing or by email. Contract cancellations made before final payment will receive a refund of monies paid, less non-refundable retainer, accumulated consultation fees, and any expenses outlaid, e.g. custom containers or construction. Cancellations made less than two weeks prior to the event date will receive absolutely NO refund. CLIENT PROVIDED ITEMS: Items provided by the client (containers, fabric, ribbon, etc.) must be in usable condition clean, polished, pressed, water tight, price tags and labels removed, etc. The client will be charged a $35 service fee for items that are not in usable condition that must then be prepared by Sprout. Items provided by the client must be received two weeks prior to the event. Items not received in time will not be used. TABLE COUNT: The final table count is due three weeks prior to the event. There can be no reduction of the table count after this time. Additions to the table count after the deadline will be at the discretion of Sprout and will be billed accordingly. SAMPLE CENTERPIECES: If needed, clients who have booked Sprout with a deposit are entitled to two sample centerpieces at a 50% discount. Additional sample arrangements will be billed at full price. Samples ordered without booking Sprout will be billed at full price. DELIVERY/DESIGNER SERVICES: Delivery services are $35 per hour per staff person needed. Designer services are $50 per hour per staff person needed. Time and a half charges apply for Sundays and Mondays and double time for holidays. Delivery and designer service charges are estimates only. Any additional hours incurred will be billed after the event. Sprout is not responsible for transporting flowers between venues. It is the sole responsibility of the client to furnish transportation for the flowers between venues. Client must provide directions and maps to all delivery locations two weeks prior to the event. We are not responsible for incorrect delivery times or locations given to us by the client.

SUBSTITUTIONS: Sprout reserves the right to make substitutions of equivalent value based on quality, availability, and/or fluctuating market prices. The integrity of the proposed color scheme will be maintained and flowers of equivalent value will be used. Example: Red roses would NOT be substituted for white orchids. RENTALS: A credit card deposit is required for rental items. All rentals are to be returned no later than four days after the event. Missing, late, or damaged items will be charged at the full retail price to your credit card. DAMAGE: Sprout is not responsible for any damage done to: flowers if requested to leave with an outside party; business or personal property, accidents, or injuries caused directly or indirectly by the use of floral items; items provided by the client. EXCLUSIVITY: It is understood that Sprout will act as the sole and exclusive florist for your event. By signing this contract the client agrees that no other person or company, professional or otherwise, shall provide fresh or artificial floral products for the clients event without the consent of Sprout. This clause protects the reputation and professional integrity of Sprout. Rare exceptions might be considered on a case by case basis. Inquire with Sprout. You may be asked to provide samples. PHOTOS: Acceptance of this contract allows Sprout to use photos taken by Sprout of your event in all forms of media, including and not limited to Sprouts web site and print advertising. ACCEPTANCE OF DELIVERY: In the event that the client will not be available during flower delivery, the client will be responsible for having a designated person meet the florist. This is to ensure that all items are delivered and accounted for. The person delivering the flowers will NOT be held accountable for any damages that may occur if there is not a designated person to accept and/or sign for the delivery.

This agreement contains the entire understanding between Sprout and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to amend this agreement is to do so in writing, and providing the document is signed by all the relevant parties and received within one month of the event date unless otherwise specified.
