PROVINCIAL ADMINISTRATION
6.1.1 Background
At the inception of the North East Provincial Council in 1989, Ministry of Interior was established and it was in charge of a Secretary. Departments of Provincial Public Administration,LocalGovernment,andRuralDevelopment,wereunderthisMinistry.In 1991, the Ministry of Interior was abolished and the Departments of Provincial Public Administration, Local Government and Rural Development were brought under the direct supervision of Chief Secretary. The post of Deputy Chief Secretary was created andtheDepartmentofProvincialPublicAdministrationcameunderhispurview. TheNorthEastProvincialMinistrieswereregroupedinJuly,1999andaMinistrytitledas Ministry of Provincial Public Administration, Local Government, Cooperatives, Rural Development,RoadDevelopment,Industries&ManagementDevelopment&Training wasestablishedtoacceleratethedevelopment,devolutionanddecentralizationprocess introduced bytheGovernment throughtheprovincialcouncilsystem.Accordingly,the Ministryischargedwiththeresponsibilityofcoordinatingandsupervisingtheactivities ofthefollowing:

ManagementDevelopment&Training With the Establishment of this Ministry, action was taken to strengthen the administrationandinstitutionalsystemstoresolvethenexistedproblemsandenhance thecapacityatDistrictandDivisionallevels.Actionhadalsobeentakentoentrustmore responsibilities to the Local Authorities and mobilize participation of village and divisional level institutions in the development and devolution programme of the ProvincialCouncilthrougheffectivepeopleparticipationandsupport.

TheMinistryofProvincialPublicAdministrationprovidedguidanceandpolicydirection and coordinated functions of the Provincial Public Administration and Management Development&Traininginlinewiththenationalpolicy,andtheprovincialdevelopment directions. The policy adopted by the Ministry in respect of the Provincial Public AdministrationandManagementDevelopment&Trainingfallswithintheframeworkof the national policy and the subjectand functions assigned under list i & iii of the 9th schedule of the 13th amendment to the Constitution of the Democratic Socialist RepublicofSriLanka.
On 16.10.2006, the Supreme Court of Sri Lanka gave its judgment for a fundamental right infringement case about merger of the Northern and Eastern Provinces. As the judgmentsaysthatthemergerwasnotalegitimateone,twoseparateentitiesi.e.the Northern Provincial Council and the Eastern Provincial Council have been established since 22.12.2006. Accordingly, the Ministry of Provincial Public Administration of the NPCalsowasestablished.
The Ministry held regular staff meetings with all the departments to review human resource development activities and to monitor and evaluate their sectoral performances.TheMinistryhadbuiltupgoodrelationshipswithrelevantlineministries, departments,otherprovincialcouncils,districtsecretariatsanddivisionalsecretariats.
After series of debates on subjects allocated to various Provincial Ministries, the Honorable Governor has made a proclamation on reallocation of subjects (Ref the Honorable Governors memo No 09/2007). Consequently, the Public Administration Secretariat has been established under Chief Secretarys Cluster with effect from 01.01.2008. The Management Development and Training Unit of the NPC has commenceditsfunctionsunderthepurviewofthissecretariat.

6.2.1 Background
Provincial Public Service Commission is an Institution established under the provisions of Provincial Councils Act No. 42 of 1987. As per Section 32(1) Appointment, Transfer, Dismissal andDisciplinaryControlofofficersoftheNorthProvincialPublicServicearevestedintheHon. Governor. The Hon. Governor, acting under the provisions of Section 32(2) has delegated his powersofAppointment,Transfer,DismissalandDisciplinaryControlofOfficerstotheProvincial Public Service Commission, reserving to himself the power of Appointment of Provincial SecretariesandProvincialHeadsofDepartments. Section32(2)oftheProvincialCouncilsActNo.42of1987wasamendedbyProvincialCouncils (Amendment)ActNo.28of1990introducinganewsubsection2AempoweringtheProvincial PublicServiceCommissiontodelegatetoChiefSecretary,ProvincialSecretariesofMinistriesand ProvincialHeadsofDepartmentsthepowerofAppointment,TransferDismissalandDisciplinary Control of Officers in the Non Staff Grade and accordingly revised powers of delegation was circulatedamongallSecretariesandHeadsofDepartmentsinAugust,1999withtheapprovalof the Hon. Governor retaining with the Provincial Public Service Commission the power of Appointment,Transfer,DismissalandDisciplinaryControlofOfficersintheStaffGrade. The Provincial Public Service Commission consists of a Chairman and three Members Hon. Governor appoints the Chairman and the Committee members for a Period of three years. DependingontheworkvolumetheCommissionsitsonceortwiceamonth.TheHon.Governor hasthePowertoaltervaryorrescindanyappointment,transferoranyotherorderrelatingto disciplinary matters made by the Provincial Public Service Commission. Earlier there were several positions without proper Service Minute, Schemes of Recruitmentandpromotionalopportunities.WithintheLastfewyearsmostofthesepositions have been identified and action have been taken to prepare and approve service minutes, Schemes of recruitments and to ensure that the officers serving in the Northern Provincial Councilareprovidedwithasalarystructurebefittingtheirqualificationandexperience.

6.2.5 Constraints
1. Shortage of experienced staff To overcome this problem it is proposed to give trainingtotheofficersonthejobandoutsidethejob.
2. LackofaTranslatorandaDataentryoperator. Due to the multiethnic Composition of the Province the PPSC needs to advertisein all three languages. Service Minutes are prepared in all languages and the General Correspondence is also conducted in the same way. Therefore Services of two translators are required. Presently a capable officer is engaged on contract basis to attend to this task. Though not adequate the arrangement is more or less serves the purpose. Further some of the Management Assistants are encouraged to do some translationandthishasalsohelpedtheAdministration. In order to create a Data base for Human resources the PPSC needs a Data entry operator.NowthemanagementAssistantsareengagedtoattendtothistask.Butifthe PPSCexpanditsactivitiesandcreateadatabaseappointmentofaDataentryoperator wouldbenecessary. ShortageofvehiclesThePPSCSecretariathasonlytwovehicles.ToconductExamsand to facilitate travel arrangement for Chairman PPSC and members the PPSC requires a van.NowthePPSCobtainsvehiclesfromotherMinistriesandDepartments,whenthere isanecessity.
