Heritage
TheUniversityofMountUnionisproudofitsreligiousheritageanditsbackgroundintheMethodistChurch.Formorethanacentury, theUniversityhasbeenofficiallyconnectedwiththeMethodistChurch.ItisnowaffiliatedwiththeEastOhio,WestOhioandWestern PennsylvaniaConferencesoftheUnitedMethodistChurch. TheChristiancommitmentoftheUniversitygoesbeyondhistoricalandinstitutionaltieseventhoughtheUnitedMethodistChurch exercisesnodirectcontrolovertheeducationalfunctionsoftheUniversity.TheChristianandliberalartstraditionsreinforceeachotherin thestrivingforexcellence,concernfortheinherentdignityandworthofeachindividualandtheemphasisonthespiritualaswellasthe intellectualachievementsofhumanity. History
TheUniversityofMountUnionistheoutgrowthofatownmeetingheldbyforwardlookingcitizensofthevillageofMountUnionon October4,1846.Atthattime,thepeoplegatheredtohearOrvilleNelsonHartshornoutlinetheneedforanewinstitutioninthearea,where menandwomencouldbeeducatedwithequalopportunity,wheresciencewouldparallelthehumanities,wherelaboratoryand experimentalsubjectswouldreceiveproperemphasis,andwheretherewouldbenodistinctionduetorace,color,sexorposition.On October20,1846,thisyoungmanorganizedandtaughtonthethirdflooroftheOldCardingMillaselectschoolofsixstudents. Theschoolgrewrapidlyunderhisinspiredleadershipandin1849becameknownasMountUnionSeminary. In1853anormaldepartmentwasaddedforthetrainingofteachers.OnJanuary9,1858,theinstitutionwascharteredand incorporatedunderthelawsoftheStateofOhioasMountUnionCollege. AlthoughMountUnionhadnotbeenestablishedbychurchefforts,itsfounderandearlyfacultymemberswerededicatedMethodist laymen.OneofthearticlesinthecharteroftheinstitutionlookedtothedaywhenMountUnionwouldcomeunderthepatronageofsome annualconferenceoftheMethodistEpiscopalChurch.ThePittsburghAnnualConferenceheartilyendorsedthenewUniversityin1858, butitwasnotuntil1864thatMountUnionwasgrantedfullpatronagebytheconference. InSeptember1911,ScioUniversity,locatedatScio,Ohio,wasunitedwithMountUnion.Bythearticlesofconsolidation,theliberalarts alumnioftheformerinstitutionweremadealumniofthelatter. Sciowasestablishedin1857atHarlemSprings,Ohio,asTheRuralSeminary.In1867theschoolwasmovedtoNewMarket,whereit wasknownvariouslyasNewMarketCollege,theOneStudyUniversity,andfinally,ScioUniversityin1878. FormanyyearsMountUnionhasclaimedthedistinctionofbeingoneofthefirstinstitutionstohaveasummerschool.Startedin1870, thisfirstsummerschoolwasactuallyafourthtermintheschoolyear.Sincethattime,summerinstructionhasbeenofferedeachyearatthe institution. OnAugust1,2010,theinstitutionofficiallybecameknownastheUniversityofMountUnion.Thechangetoauniversitydesignation wasmadeinanefforttobetterdescribewhatMountUnionistodayandmoreeffectivelycommunicateallthattheinstitutionhastooffer. Thisdecision,unanimouslyapprovedbytheBoardofTrustees,cameaftercarefulreviewofdatagatheredthroughnumerousresearchefforts andthoughtfulconsiderationanddiscussion. From1846topresent,theadministrationoftheUniversityhasbeenundertheleadershipof11presidents:OrvilleNelsonHartshorn, 18461887;TamerlanePlinyMarsh,18881898;AlbertBirdsallRiker,18981908;WilliamHenryMcMaster1899,19081938;CharlesBurgess Ketcham,19381953;CarlClusterBracy,19541967;RonaldGilbertWeber38,19671980;G.BenjaminLantzJr.,198085;HaroldM. TheFiveCollegeCommission
TheFiveCollegeCommission,whichoperatesasadivisionofTheCommissiononHigherEducationoftheUnitedMethodistChurchin Ohio,includesinitsmembershipthefiveUnitedMethodistCollegesinthestate:MountUnion,BaldwinWallace,OhioNorthern,Ohio WesleyanandOtterbein.ThepurposeoftheFiveCollegeCommissionistopromotecommunicationandunderstandingandtoserveas liaisonbetweenthefiveUnitedMethodistCollegesandtheUnitedMethodistsoftheStateofOhiofortheirmutualbenefit .

AlumniandRelatedOrganizations
TheUniversityofMountUnionAlumniAssociationwasofficiallyorganizedin1948,havingfunctionedformanyyearsasaninformal organization.ItspurposeistopromoteinterestinMountUnionthroughavarietyofprograms.Allformerstudentsareautomatically membersoftheassociation.ActivitiesarecoordinatedthroughtheOfficeofAlumniRelations,partoftheUniversitysadministrativestaff andtheAlumniCouncilfromtheassociation. TheAssociationholdslocalmeetingseachyearinmanyareasthroughoutthenation.Specialprogramsforalumnifromallareasare providedattheUniversityonAlumniWeekendandalsoonHomecomingDay.MountUnionMagazine,aquarterlypublication,keepsalumni andfriendsinformedoftheprogramsandactivitiesoftheassociationandoftheUniversity. TheMountUnionWomen,foundedin1933,isanorganizationoflocalchapterswiththeNationalCabinetasitsgoverningbody.Its purposesaretofostertheinterestsofMountUnion,topromotetheeducationofwomen,toprovideaneffectivemediumofcontact betweenalumnaeandtheUniversityandtoorganizelocalchaptersofMountUnionWomen. AnywomanwhohasattendedMountUnionisamemberofMountUnionWomen.Associatemembershipsmaybeheldbythewifeof analumnusandthemother,daughterorsisterofanalumnusoralumna.Honorarymembershipsaregiventothewifeofthepresidentof theUniversity,thewivesofallmembersofAdministrativeCouncil,thedirectorofalumniactivitiesandwomenmembersoftheUniversitys BoardofTrustees.Honorarymembershipsmaybegiventowomenprofessorsandwivesofprofessors.

StudentResponsibility
Eachstudenthastheresponsibilitytobeawareofandtoadheretoallrules,regulationsanddeadlinespublishedinthisGraduate Catalogue,andinanyHandbooksprovidedbygraduateprograms.

TheUniversityofMountUnionEducationalRecordsPolicy
InaccordancewiththeFamilyEducationalRightsandPrivacyAct(commonlyreferredtoasFERPA,ortheBuckleyAmendment), MountUnionhasadoptedthefollowingpoliciesandprocedurestoprotecttheprivacyofeducationalrecords.Studentswillbenotifiedof theirFERPArightsannuallybypublicationintheGraduateCatalogueandontheUniversityswebsite.

Definitions

TheUniversityofMountUnionusesthefollowingdefinitionsinthispolicy Student:anypersonwhoattendsorhasattendedtheUniversity. Educationrecords:anyrecordinwhateverform(handwritten,taped,print,filmorothermedium)whichismaintainedbytheUniversityand isdirectlyrelatedtoastudent,withthefollowingexceptions: personalrecordskeptbyaUniversitystaffmemberiftherecordisnotrevealedtoothersandiskeptinthesolepossessionof thestaffmember; studentemploymentrecordsthatrelateexclusivelytothestudentinthecapacityofanemployee; recordsmaintainedseparatelyfromeducationalrecordssolelyforlawenforcementagenciesofthesamejurisdiction; counselingrecordsmaintainedbytheUniversitychaplainortheUniversitycounselor; medicalrecordsmaintainedbytheUniversitysolelyfortreatmentandmadeavailableonlytothosepersonsproviding treatment;and OfficeofAlumniActivitiesrecords.

RightsUnderFERPA

Astudentshallhavetherightandparentsofadependentstudentmayhavetherighttodothefollowing: inspectandreviewthestudentseducationrecords; requestthatthestudentseducationrecordsbeamendedtoensuretherecordsarenotinaccurate,misleadingorotherwisein violationofastudentsprivacyorotherrights; consenttodisclosuresofpersonallyidentifiableinformationcontainedinthestudentseducationalrecords,excepttotheextent thatFERPAauthorizesdisclosurewithoutconsent; fileacomplaintwiththeU.S.DepartmentofEducationconcerningthefailureoftheUniversitytocomplywiththe requirementsofFERPA;and

ProceduretoInspectEducationRecords
Studentsmayinspectandreviewtheireducationrecordsuponrequesttotheappropriaterecordcustodian(s).Studentsmustsubmita writtenrequestthatidentifiesaspreciselyaspossibletherecord(s)thestudentwishestoinspect. Accesswillbeprovidedwithin45daysofthewrittenrequest.Informationcontainedineducationalrecordswillbefullyexplainedand interpretedtostudentsbyUniversitypersonnelassignedto,anddesignatedby,theappropriateoffice. Studentrecordsaremaintainedinthefollowingoffices: admissionsandacademicrecordsintheOfficeoftheRegistrar; financialaidrecordsintheOfficeofStudentFinancialServices; financialrecordsintheOfficeofBusinessAffairs; progressandadvisingrecordsinthedepartmentalofficesandfacultyoffices; disabilityrelatedrecordsinDisabilitySupportServices; counselingrecordsintheOfficeoftheChaplainandCounselingServices; academicdishonestyrecordsintheOfficeofAcademicAffairs; disciplinaryandstudentconductrecordsintheOfficeofStudentAffairs.

RightoftheUniversitytoRefuseAccess

TheUniversityreservestherighttorefusetopermitastudenttoinspectthefollowinginformation: thefinancialstatementofthestudentsparents; lettersofrecommendationforwhichthestudenthaswaivedhisorherrightofaccess; recordsofapplicantswhowereneitheradmittedtonorattendedtheUniversityofMountUnion; recordscontaininginformationaboutmorethanonestudent,inwhichcasetheUniversitywillpermitaccessonlytothatpart oftherecordwhichpertainstotheinquiringstudent;and recordswhichareexcludedfromtheFERPAdefinitionofeducationalrecords.

RighttoChallengeInformationinRecords

Studentshavetherighttochallengethecontentoftheireducationrecordsiftheyconsidertheinformationcontainedthereintobe inaccurate,misleadingorinappropriate.Thisincludesanopportunitytoamendtherecordsorinsertwrittenexplanationsbythestudentinto suchrecords.ThestudentmaynotinitiateaFERPAchallengeofagradeawardedunlessitwasinaccuratelyrecorded;insuchcasesthecorrect


gradewillberecorded.

ProceduresforHearingstoChallengeRecords

Studentswishingtochallengethecontentoftheireducationrecordsmustsubmit,inwritingtotheappropriateoffice,arequestfora hearingwhichincludesthespecificinformationinquestionandthereasonsforthechallenge. HearingswillbeconductedbyaUniversityofficialwhodoesnothaveadirectinterestintheoutcomeofthehearing.Studentswillbe affordedafullandfairopportunitytopresentevidencerelevanttothereasonsforthechallenge.Thehearingofficerwillrenderadecisionin writing,withinareasonableperiodoftime,notingthereasonandsummarizingallevidencepresented. Ifthehearingresultsareinfavorofthestudent,therecordshallbeamended.Shouldtherequestbedenied,anappealmaybemade,in writing,andsubmittedtotheregistrarwithin10daysofthestudentsnotificationbythehearingofficer.Theappealshallbeheardbyan AppealsBoardofthreedisinterestedseniorUniversityofficials.Theboardwillrenderadecision,inwriting,withinareasonableperiodof time. Shouldtheappealdecisionbeinfavorofthestudent,therecordshallbeamendedaccordingly.Shouldtheappealbedenied,the studentmaychoosetoplaceastatementwiththerecordcommentingontheaccuracyoftheinformationintherecordand/orsettingforth anybasisforinaccuracy.AslongasthestudentsrecordismaintainedbytheUniversity,whendisclosedtoanauthorizedparty,therecord willalwaysincludethestudentsstatementandtheboardsdecision.

DisclosureofEducationRecords

TheUniversitywilldisclosenondirectoryinformationcontainedinastudentseducationalrecordonlywiththewrittenconsentofthe student,withthefollowingexceptions: toschoolofficials,includingteachers,whohavealegitimateeducationalinterestintherecord; toofficialsofanotherschoolinwhichthestudentseeksorintendstoenroll; tofederal,stateandlocalagenciesandauthoritiesasprovidedunderlaw; totheparentsofaneligiblestudentifthestudentisclaimedasadependantforincometaxpurposes; accreditingorganizations; tocomplywithajudicialorderorlawfullyissuedsubpoena; emergenciesaffectingthehealthorsafetyofthestudentorotherpersons;and asotherwisepermittedbyFERPA. Anystudentwhowishestoauthorizereleaseofhisorhergradestooneorbothparentsshouldcompleteadisclosureformin theOfficeoftheRegistrar.

DirectoryInformation

Disclosureofdirectoryinformationnormallymaybemadewithoutthestudentsconsent.Directoryinformationincludesthestudents name;schoolandpermanentaddresses;school,permanentandcellulartelephonenumbers;schoolmailboxaddress;schoolemailaddress; dateandplaceofbirth;majorsandminors;datesofattendance;enrollmentstatus;classlevel;degree(s)receivedanddatesofconferral; honorsandawardsearned;previousinstitutionsattended;weightandheightofathletes;participationinofficiallyrecognizedactivitiesand sports;andphotograph. AstudentwhowishestohavealldirectoryinformationwithheldmustsubmitanAuthorizationtoWithholdDirectoryInformation formtotheregistrar.Theholdwillbecomeeffectivethefirstdayofclassinthenextregularsemester(fallorspring).Oncefiledthisrequest becomesapermanentpartofthestudentsrecorduntilthestudentinstructstheregistrarinwritingtohavetherequestremoved.Because theUniversityscomputersystemisunabletoputaholdonselectivedirectoryinformation,alldirectoryinformationwillbeplacedonhold oralldirectoryinformationexceptnameandemailaddresswillbeplacedonhold.Moreover,thisrequestdoesnotrestrictthereleaseof thisinformationtoindividualsandagencieslistinDisclosureofEducationalRecordsabove. .

PetitionsandAppealsRegardingNonDisciplinaryAcademicMatters

Anystudentwithaconcernaboutanondisciplinaryacademicmatter(forexample,theassignmentofagradeorthesubstitutionofa course)shouldattempttoresolvethematterwiththeinstructor,ifoneisinvolved,orthegraduateprogramdirector.Ifthematterthen remainsunresolved,thestudentmaysubmitapetitiontotheAcademicPoliciesCommitteeforreview.Petitionformsandinformationare availablefromtheOfficeoftheRegistrar. ThestudentmayappealdecisionsoftheAcademicPoliciesCommitteetotheVicePresidentforAcademicAffairsoftheUniversity.The studentmustsubmitawrittenrequestforanappealtotheOfficeofAcademicAffairsnolaterthanfivebusinessdaysfollowingthe notificationofthecommitteesdecision.

WithdrawalProcess

AstudentwhowantstowithdrawafterclasseshavestartedforthesemesterinitiatestheprocesswiththeProgramDirectortoindicate thathe/sheiswithdrawing.TheofficialdateofwithdrawalisthedatethestudentcontactedtheProgramDirectorORthemidpointofthe semesterifthestudentleaveswithoutnotifyingtheinstitutionORthestudentslastdayofattendanceatadocumentedacademicallyrelated activity,whicheveristhelatest.Thispolicyappliestostudentswhowithdrawfromalltheirclassesforthesemesteroraresuspended. Studentswhoparticipateinactivitiesoncampuspriortothefirstdayofclassesandthensubmitwrittennoticeofwithdrawalpriorto thefirstdayofclassesshallbeassessedanearlywithdrawalfeeof$100. Thechargesfortuitionandfeesassessedtothestudentarebasedonthenumberofcalendardays(includingSaturdayandSunday)that thestudentisenrolledoncampusindirectproportiontotheperiodofenrollment(numberofcalendardaysinthesemester).Thestudent whowithdrawsafter60percentoftheenrollmentperiodwillbechargedforthewholesemester. 6

FinancialAidforGraduateStudents

TheprimarygoalofthefinancialaidprogramatMountUnionistoassiststudentsinmeetingtheirUniversityexpensesbyproviding financialresources.FinancialassistancefromtheUniversityshouldbeconsideredassupplementaltothefamilyeffort.Theinvestmentofthe familyincludesparentalsupportfordependentstudentsandacontributionfromthestudentsthemselves.MountUnionwillstrivetoassist eligiblestudentstothegreatestextentpossiblebasedontheUniversitysavailableresources.

EligibilityandDeterminationforFinancialAidforGraduateStudents

Tobeeligibleforfinancialassistance,thestudentmustbeclassifiedashavingatleasthalftimeenrollmentandshowsatisfactory progresstowardmeetingtherequirementsforadegree(seepage6).Institutionalfundsandfederalgrantsarenotavailabletograduate students. ConsiderationforFederalStaffordLoansrequiresthestudenttofiletheFreeApplicationforFederalStudentAid(FAFSA)eachacademic yearandmeetthefederaleligibilityrequirements.Studentsmustshowfinancialneed(accordingtotheFAFSA)toqualifyforSubsidized StaffordLoanfunds.Maximumannualamountsequal$8,500(subsidized)and$12,000(unsubsidized).Amountsmaynotexceedthecostof attendance(directandindirectcostsassociatedwiththeprogram)inthegivenloanperiod. ApplyingforGraduation Allstudentswhowishtograduatemustapplyforgraduationatleastonesemesterpriortotheirplanneddateofgraduation.Applicationfor GraduationformsareavailableintheOfficeoftheRegistraroronlineattheregistrarswebsite.TheUniversityrecommendsthatstudentsapplyat leastonesemesterbeforegraduationtoensurethatallgraduationrequirementscanbeidentifiedandcompletedbytheexpectedgraduationdate. TheDirectorofthePAProgramwillconfirmtheeligibilityofeachstudentwhosubmitsanapplicationtotheRegistrartoparticipateintheevent. RequirementsfortheDegreeinPhysicianAssistantStudies

Thedegreeofferedisamasterofscienceinphysicianassistantstudies.AllstudentsacceptedintothePhysicianAssistantProgramwill beenrolledinanidenticalcoursescheduleforthedidacticyear(firstfoursemesters).Duringtheclinicalyearstudentsarerequiredto completeeightrequiredclinicalrotationsandtwoelectiveclinicalrotations. PurposesoftheStudentDisciplinaryProcess
TheUniversityofMountUnionstudentdisciplinaryprocessiscomposedofstudents,facultymembers,andadministratorswhose purposeistoaidinthedevelopmentofhighervaluesandpropercitizenshipinalloflife,notincampuslifealone.Studentdiscipline concernsthoseexperiencesandprocessesthathelpastudenttoachieveselfcontrol,tomakematuredecisions,andtoacceptresponsibility forher/hisdecisions.Tothisend,MountUnionsupportstheconceptofeducationaldiscipline.TheUniversitywillmakeanefforttoeducate studentsthroughsanctions.However,shouldastudentbeconsideredadangertotheuniversitycommunityordemonstrateunwillingnessto adheretothebehavioralexpectationsoftheUniversity,s/hewillbetreatedinasimilarmannerasonewhohasfailedacademically,andmay beseparatedfromtheUniversity.

ArticleI:Definitions
Forthepurposesofthestudentdisciplinaryprocess,thefollowingdefinitionswillapply: 1. ThetermUniversitymeansUniversityofMountUnion. 2. The term student includes all persons taking courses at the University, either fulltime or parttime. Persons who withdraw after allegedly violating the Student Code of Conduct, who are not officially enrolled for a particular term but who have a continuing relationshipwiththeUniversity,orwhohavebeennotifiedoftheiracceptanceforadmissionareconsideredtobestudents. 3. Theterm"graduatestudent"meansanypersonenrolledinaUniversityofMountUniongraduateprogram. 4. ThetermfacultymembermeansanypersonhiredbytheUniversitytoconductclassroomorteachingactivitiesorwhoisotherwise consideredbytheUniversitytobeamemberofthefaculty. 5. The term administrator means any person employed by the University to perform assigned administrative or professional responsibilities. 6. ThetermmemberoftheUniversitycommunityincludesanypersonwhoisacurrentstudent,facultymember,administrator,orany otherpersonemployedbytheUniversity. 7.ThetermUniversitypropertyincludesallland,buildings,facilities,andotherpropertyowned,leased,orcontrolledbytheUniversityor anystudentorganization. 8. The term student organization means any number of persons who have complied with the formal requirements for University recognition. 9. ThetermadministrativehearingofficermeansaUniversityadministratorauthorizedbythedeanofstudentstodeterminewhethera studenthasviolatedtheStudentCodeofConductandtoimposesanctionsaccordingly. 10. Thetermstudentconductboardmeansanypersonsauthorizedbythedeanofstudentstodeterminewhetherastudenthasviolated theStudentCodeofConductandtoimposesanctionsaccordingly. 11.Thetermcollegeappealsboardmeansanypersonsauthorizedbythedeanofstudentstoconsideranappealofthedeterminationof responsibilityand/orsanctionsgivenbyanadministrativehearingofficerorstudentconductboard. 12.ThetermcomplainantmeansanypersonwhosubmitsachargeallegingthatastudentviolatedtheStudentCodeofConduct.Inall cases before the student conduct board, a representative of the University shall act as a complainant. In cases before the student conductboardoranadministrativehearingofficerwhereamemberoftheUniversitycommunitybelievesthats/hehasbeenavictimof anallegedviolation,thisindividualmayalsobeconsideredacomplainant. 13.ThetermchargedstudentmeansanystudentchargedwithviolatingtheStudentCodeofConduct. 14. ThevicepresidentforstudentaffairsanddeanofstudentsisthepersondesignatedbythepresidentoftheUniversitytoberesponsible fortheadministrationoftheStudentCodeofConductandisreferredtointhisdocumentasthedeanofstudents. 21

ArticleII:Jurisdiction
ThesubmissionofanapplicationforadmissiontoUniversityofMountUnionisanoptionalandvoluntaryaction.Institutionalapproval ofthatapplicationis,inturn,anextensionofprivilegetojointheacademicandsocialcommunityandtoremainapartofitaslongas academicandbehavioralstandardsaremet.TheseexpectationshavebeenestablishedsothattheeducationalpurposeoftheUniversity maybepursuedinanatmosphereconducivetosuchanundertaking.WhenastudentorgroupofstudentsviolatestheStudentCodeof Conduct,thesestudentsmustacceptresponsibilityfortheiractions. Students are expected to exhibit good judgment and responsibility in their behavior on University property, at University sponsored events,andoffcampus.TheUniversityreservestherighttoaddressstudentbehaviorsthatoccuroffcampus,includingthosethatarealso beingacteduponbylegalauthorities.AlthoughtheUniversitywillnotautomaticallyimposesanctionsinadditiontothoseimposedbylaw enforcementagencies,itdoeshavetheobligationtointroducecounselingand/ordisciplinaryactionifthestudentsbehaviorconflictswith theUniversityseducationalobjectivesoritsresponsibilitiestomembersofthecommunity.Thedeanofstudentsorher/hisdesigneeshall decide whether the Student Code of Conduct shall be applied to conduct occurring off campus, on a case by case basis, in her/his sole discretion.Disciplinaryactiontakenonthisbasisshallconformtothestudentdisciplinaryprocess,includingappeal. Each student shall be responsible for her/his conduct from the time of application for admission through the actual awarding of a degree.Thisincludesduringtheacademicyear,beforeclassesbeginorafterclassesend,aswellasduringperiodsbetweentermsofactual enrollment. The Student Code of Conduct shall apply to a students conduct even if a student withdraws from school while a disciplinary matterispending. Ingeneral,anynonacademicviolationbyastudentorgroupofstudentsattheUniversitywillcomeunderthejurisdictionofthestudent disciplinaryprocess.

ArticleIII:StudentDisciplinaryProcessAuthority
ThestudentdisciplinaryprocessatUniversityofMountUnionconsistsoftheresidentdirectors,thedirectorofresidencelife,the associatedeanofstudents,thedeanofstudents,astudentconductboard,acollegeappealsboardand,onoccasion,otheradministratorsas deemedappropriatebythedeanofstudents.Disciplinarycasesarehandledbyoneoftheaboveindividualsorgroupsdependingonthe natureandseverityoftheoffense.Thedeanofstudents,orher/hisdesignee,willdecidewhichbodyshallhearthecase.

ArticleIV:ViolationofLawandUniversityDiscipline
Universitydisciplinaryproceedingsmaybeinstitutedagainstastudentchargedwithconductthatpotentiallyviolatesbothcriminallaw andtheStudentCodeofConductwithoutregardtothependencyofcivilorcriminallitigationincourtorcriminalarrestorprosecution. Proceedingsinthestudentdisciplinaryprocessmaybecarriedoutpriorto,simultaneouslywith,orfollowingcivilorcriminalproceedingsoff campusatthediscretionofthedeanofstudentsorher/hisdesignee.Determinationsmadeorsanctionsimposedunderthestudent disciplinaryprocessshallnotbesubjecttochangebecausecriminalchargesarisingoutofthesamefactsgivingrisetoviolationofuniversity rulesweredismissed,reduced,orresolvedinfavoroforagainstthecriminallawdefendant. Whenastudentischargedbyfederal,state,orlocalauthoritieswithaviolationoflaw,theUniversitywillnotrequestoragreetospecial considerationforthatindividualbecauseofherorhisstatusasastudent.Iftheallegedoffenseisalsobeingaddressedunderthestudent disciplinaryprocess,theUniversitymayadviseoffcampusauthoritiesoftheexistenceoftheStudentCodeofConductandhowsuchmatters aretypicallyhandledwithintheUniversitycommunity.TheUniversitywillattempttocooperatewithlawenforcementandotheragenciesin the enforcement of criminal law on campus and in the conditions imposed by criminal courts for the rehabilitation of student violators (provided that the conditions do not conflict with campus rules or sanctions). Individual students and other members of the University community,actingintheirpersonalcapacities,remainfreetointeractwithgovernmentrepresentativesastheydeemappropriate.

ArticleV:AdministrativeHearings
Section1:Jurisdiction AnadministrativehearingmaybeconductedtoactonallinfractionsofnonacademicUniversityrulesandregulationsbyastudent, groupofstudents,orstudentorganizationaffiliatedwiththeUniversity. Administrativehearingsmaybeconductedbyresidentdirectors,thedirectorofresidencelife,theassociatedeanofstudents,thedean ofstudentsorotheradministratorsasdeemedappropriatebythedeanofstudentsorher/hisdesignee. Section2:ProceduresforAdministrativeHearings ThepurposeofanadministrativehearingistoprovideanevaluationofachargedstudentsresponsibilityforviolatingtheUniversityof MountUnionStudentCodeofConduct.Thehearingwillbeconductedinaccordancewiththeproceduressetforthbythestudent disciplinaryprocess,butshallnotbeboundbytechnicalrulesofevidenceorotherformalrulesofprocessandprocedure,suchasareapplied incriminalorcivilproceedings. Thefollowingproceduralprotectionsareprovidedtochargedstudentsinadministrativehearings: a. receivingwrittennoticeofthespecificchargespriortothehearing; b.knowingthecontentofwrittenmaterialbeingconsideredinthecase; c.theopportunitytobepresentatthehearing,torespondtotheallegations,andtoproviderelevantinformation; 22

d.theabilitytobringpertinentandnecessarywitnessestospeakonher/hisbehalf(witnessesmayonlybepresentinthehearing whentheyareprovidinginformation,notthroughouttheentireprocess); e.therighttospeakornotspeakonher/hisownbehalf.Invokingtherighttonotspeakwillnotbeconsideredanadmissionof responsibility. Ifthechargedstudentfailstoattendthehearingafternotificationhasbeengiven,thehearingmaybeheldinher/hisabsence. Administrative hearings shall be closed to all parties other than the following: the charged student; the complainant (if any); the administrativehearingofficer;andwitnesses(whoareonlypresentduringthetimethattheyareprovidinginformation.) Theadministrativehearingofficerwillreviewthewrittenmaterialswiththechargedstudentatthehearing.Inaddition,ifrequestedby thechargedstudent,arrangementswillbemadeforher/himtoreviewthewrittenmaterialspriortothehearing. Theadministrativehearingofficerwilladvisethechargedstudentoftheallegationsmadeagainsther/himandgivethechargedstudent the opportunity to accept or deny responsibility. If the charged student denies responsibility, then the administrative hearing officer will consider all available information in order to decide if the charged student should be found responsible for violating the Student Code of Conduct. While the University brings all charges within the student disciplinary process, there are occasions when a member of the campus communitybelievess/hehasbeenavictimoftheallegedviolationandmayalsobeconsideredtobeacomplainant.Inthiscase,thisperson willbemadeawareofthespecificchargespriortothehearing;beinformedofthecontentofwrittenmaterialaboutthecase;andhavethe opportunitytobepresentatthehearing,providerelevantinformationconcerningtheallegedviolation,andbringpertinentandnecessary witnessestosupportthechargesathand(witnessesmayonlybepresentinthehearingwhentheyareprovidinginformation,notthroughout theentireprocess). Afindingofresponsibilitywillonlybemadeifthepreponderanceofinformationsupportsthechargesplacedagainstthestudent. IfthestudentacceptsresponsibilityorisfoundresponsibleforviolatingtheStudentCodeofConduct,thentheadministrativehearing officer will assign appropriate disciplinary sanctions and explain them to the student. Following the hearing, a letter will be sent to the studentconfirmingtheoutcomeofthehearingandthesanctionsassigned. Allproceduralquestionsaresubjecttothefinaldecisionofthedeanofstudentsorher/hisdesignee.

ArticleVI:StudentConductBoard
Section1:Jurisdiction ThestudentconductboardmayactonallinfractionsofnonacademicUniversityrulesandregulationsbyastudent,groupofstudents, orstudentorganizationaffiliatedwiththeUniversity. During the academic year, a committee of student conduct board members consisting of three faculty members and two student members will act as the final appeals board for appeals of academic disciplinary decisions reached by an Academic Dishonesty Hearing Committee.Ifthechargedstudentisagraduatestudent,atleastoneofthestudentsonthefinalappealsboardwillbeagraduatestudent and at least one of the faculty members will teach at the graduate level. Appeals of decisions made by an Academic Dishonesty Hearing Committee that must be heard during the summer, or at times when classes are not in session, may be heard by the Vice President for AcademicAffairsorher/hisdesignee. Section2:Organization ApoolofqualifiedstudentandfacultyboardmembersshallbeselectedinaccordancewiththeprocessdescribedinArticleVI,Section6. Section7:Hearings Hearingsaretobeheldasnecessaryinordertoaddresscasesassignedtotheboard.Foreachhearingofthestudentconductboard,the boardshallbecomposedofthemembersstatedinArticleVI,Section2. Section8:ProceduresforStudentConductBoardHearings Thepurposeofastudentconductboardhearingistoprovideanevaluationofachargedstudentsresponsibilityforviolatingthe UniversityofMountUnionStudentCodeofConduct.Thehearingwillbeconductedinaccordancewiththeproceduressetforthbythe studentdisciplinaryprocess,butshallnotbeboundbythetechnicalrulesofevidenceorotherformalrulesofprocessandprocedure,suchas areappliedincriminalorcivilproceedings. Inhearingsinvolvingmorethanonechargedstudent,theDeanofStudents,orher/hisdesignee,inher/hissolediscretionmaypermit thehearingsconcerningeachstudenttobeconductedeitherseparatelyorjointly. Inordertoprotecttheprivacyofthestudentsinvolved,hearingsofthestudentconductboardshallbeclosedtoallpartiesotherthan thefollowing:thechargedstudent(s);thecomplainant(s);thesittingmembersofthestudentconductboard;aUniversityof MountUnion student,facultyorstaffmemberwhoisactingasanadvisorforthechargedstudentand/orthecomplainant;andwitnesses(whoareonly presentduringthetimethattheyareprovidinginformation.)Intheeventthatastudentorganizationisinvolvedinahearingbeforethe student conduct board, one member will represent the organization, while other members who want to present information will be consideredtobewitnessesandwillonlybepresentwhentheyprovideinformation. Ifthechargedstudentfailstoattendthehearingafternotificationhasbeengiven,thehearingmaybeheldinher/hisabsence. Asinglerecordingshallbemadeofeachhearing.Thedeliberationsofthestudentconductboardwillnotberecorded.Therecording shall be the property of the University. Recordings of all student conduct board proceedings will be kept on file in the associate dean of studentsoffice.Recordingswillbeerased60daysafterthehearingunlessanappealisstillpending.Inthiscase,recordingswillbeerased thirtydaysafterthefinalappealdecision. A written description of the charges shall be made available to the sitting members of the student conduct board. This description shallincludethenameofthechargedperson,persons,orgroupsinvolved,thetimeandplaceoftheallegedoffense,andthenatureofthe allegedoffense.Inaddition,otherwrittenmaterialsmaybeconsideredatthediscretionofthesittingmembersoftheboard.Thesewritten materialsshallbeheldinconfidenceandwillbecollectedattheconclusionofthehearing. Acopyofallwrittenmaterialstobeconsideredinthehearingshallbeprovidedtothechargedstudentandthecomplainant(s)fortheir useduringthehearing.Thesewrittenmaterialswillbecollectedattheconclusionofthehearing.Ifrequestedbythechargedstudentorthe complainant(s),arrangementswillbemadeforthemtoreviewthewrittenmaterialspriortothehearing. AUniversitystaffmemberwillbeacomplainantandpresentinformationpertinenttothechargesbeingconsideredbytheboard.The University staff member acting as a complainant may be present at the hearings, make a statement concerning the alleged violation, be informedofthecontentofwrittenmaterialaboutthecase,callwitnessestosupportthechargesathand,anddirectlyquestionwitnesses. WhiletheUniversitybringsallchargeswithinthestudentdisciplinaryprocess,thereareoccasionswhenamemberofthecampuscommunity believess/hehasbeenavictimoftheallegedviolationandmayalsobeconsideredtobeacomplainant.Inthiscase,thispersonmaybe directlyinvolvedinthecasebroughtbeforethestudentconductboardand,therefore,willbemadeawareofthespecificchargespriortothe hearing; be informed of the content of written material about the case; and have the opportunity to be present at the hearing, provide relevant information concerning the alleged violation, bring pertinent and necessary witnesses to support the charges at hand (witnesses may only be present in the hearing when they are providing information, not throughout the entire process), question witnesses in the mannerdescribedinthestudentdisciplinaryprocess,andbeaccompaniedbyanadvisorwhomustbeaUniversityofMountUnionstudent, faculty, or staff member and may not be an attorney. Advisors may not speak or directly participate in the hearing, unless otherwise approvedbythemembersofthestudentconductboard. Thecomplainant(s)andthechargedstudentmayarrangeforwitnessestopresentpertinentinformationtotheboard.Witnesseswill provideinformationtoandanswerquestionsfromthestudentconductboard.Questionsmaybesuggestedbythechargedstudentand/or thecomplainant(s)tobeansweredbyeachotherorbyotherwitnesses.Thesequestionsshallbedirectedtotheboardchairperson,rather than to the witness directly. This method is used to preserve the educational tone of the hearing and to avoid creation of an adversarial environment. The student conduct board may accommodate concerns for the personal safety, wellbeing, and/or fears of confrontation of the complainant,chargedstudent,and/orotherwitnessesduringthehearingbyprovidingseparatefacilities,byusingavisualscreen,and/orby permittingparticipationbytelephone,videophone,videoconferencing,videotape,audiotape,writtenstatement,orothermeans,whereand asdeterminedinthesolejudgmentofthedeanofstudentsorher/hisdesigneetobeappropriate. Aftercompletionofthepresentationofinformation,theboardwilldeliberateprivatelyandreachadecision.Afindingofresponsibility shallonlybereachedwhenamajorityofsittingmembersfindsthatthepreponderanceoftheinformationthathasbeenpresentedsupports theallegationthatthechargedstudenthasviolatedtheUniversityofMountUnionStudentCodeofConduct.Ifthechargedstudentisfound responsiblefortheviolation,thenthestudentconductboardwillmakeadecisionregardingappropriatesanctionstobeassigned. Thesecretaryandchairpersonwillensurethatwrittennotificationofthefindingsoftheboardaregiventothedeanofstudentsor her/hisdesigneeassoonaspossiblefollowingthecompletionofthehearing.Thedeanofstudents,orhisorherdesignee,willnotifythe chargedstudentoftheoutcomeofthehearing. Allproceduralquestionsaresubjecttothefinaldecisionofthedeanofstudentsorher/hisdesignee.

ArticleVII:Appeals
Section1:GroundsforAppeal Thedecisionmadebyahearingbodymaybeappealedbythechargedstudent(s)orthecomplainant(s)forthefollowingreasons.Inorder 25

foranappealtobegrantedand/orfortheoutcometobeamended,oneormoreofthefollowinggroundsforappealmustbemet: 1.specifiedproceduralerrorsormisrepresentationofUniversityregulationsaresosubstantialthattheoutcomeofthehearingmayhave beenaffected;or 2.newandsignificantinformationhasbecomeavailablewhichwasnotreasonablydiscoverable/availablebeforetheoriginaldecisionwas renderedandwhichcouldhavereasonablyalteredtheresultsofthehearing;or 3.thedeterminationofresponsibilityand/orthesanctionsarearbitraryorunjustifiedbytheinformationpresentedatthehearing. When the grounds for appeal have been met, the appeals body has the option to make decisions that extend the full range of the student discipline process, from finding the charged student responsible or not responsible for the violation to assigning any sanction it deemsappropriatetotheviolation,includingmaintaining,decreasing,orincreasingthesanction. Section2:MethodforRequestinganAppeal Allappealsmustbesignedandfiledinwritingwithinfivebusinessdaysafterthedecisionofthehearingbodyismade.Electronicsubmissionsare notacceptableexceptinextremecircumstancesasdeterminedbythedeanofstudentsorhis/herdesignee.Theappealshouldclearlystatethe groundsoftheappealandshouldbesubmittedtotheofficeofthedeanofstudents. Section3:AppealsRelatedtoNonacademicViolations Duringtheacademicyear,theuniversityappealsboardwillhearappealsofcasesthatwereadjudicatedineitheranadministrativeor studentconductboardhearing.Appealsthatmustbeheardduringthesummer,orattimeswhenclassesarenotinsession,maybeheardby theDeanofStudentsorher/hisdesignee,inplaceoftheboard.Thedecisionofeitherappealsbodyisfinal. Ifadecisionisappealedbythechargedstudentorthecomplainant(s),allpartieswillhavetheopportunitytoactivelyparticipateinthe appealhearingasdescribedinArticleVII,Section5.Thishearingwillserveasthesoleappealforallparties. Theuniversityappealsboardiscomposedofastudentandafacultymemberfromthepoolofstudentconductboardmemberswhodid nothearthecaseoriginallyandthedeanofstudents.Ifthechargedstudentisagraduatestudent,atleastoneofthetwostudentconduct boardmemberswhositontheappealsboardforthecasewillbeagraduatestudentoragraduatefacultymember.Intheeventthatthe deanofstudentsmustexcuseher/himselforisunavailable,thedeanofstudentsmaydesignateastaffmembertofillher/hisplaceonthe board.Meetingsoftheuniversityappealsboardwillbecalledasnecessarybythedeanofstudents. Section4:AppealsRelatedtoAcademicViolations Duringtheacademicyear,acommitteeofstudentconductboardmembersconsistingofthreefacultymembersandtwostudent memberswillactastheappealsbodyforappealsofdecisionsreachedbyanacademicdishonestyhearingcommittee.Ifthechargedstudent isagraduatestudent,atleastoneofthestudentsonthefinalappealsboardwillbeagraduatestudentandatleastoneofthefaculty memberswillteachatthegraduatelevel.Appealsofdecisionsmadebyanacademicdishonestyhearingcommitteethatmustbeheard duringthesummer,orattimeswhenclassesarenotinsession,maybeheardbytheVicePresidentforAcademicAffairsorher/hisdesignee, inplaceofthecommittee.Thedecisionofeitherappealsbodyisfinal. Section5:ProceduresforAppeals Thepurposeofanappealshearingistoassesstheappropriatenessoftheoutcome(s)ofapriorhearingthatarebroughtintoquestion byanappeal.Thehearingwillbeconductedinaccordancewiththeproceduressetforthbythestudentdisciplinaryprocess,butshallnotbe boundbythetechnicalrulesofevidenceorotherformalrulesofprocessorprocedure,suchasareappliedincriminalorcivilproceedings. In the event that a student organization is involved in an appeals hearing, one member will represent the organization, while other members who want to present informationwillbeconsideredtobewitnessesandwillonlybepresentwhentheyareprovidingInformation. Asinglerecordingwillbemadeofeachappealshearing.Thedeliberationsoftheappealsbodywillnotberecorded.Therecordingshall bethepropertyoftheUniversity.Recordingsofallappealshearingswillbekeptonfileintheassociatedeanofstudentsoffice.Recordings willbeerasedthirtydaysaftertheappealshearing. Copiesofallwrittenmaterialsusedintheoriginalhearingshallbemadeavailabletoallmembersoftheappealsbody.Thesematerials shall include the charge letter, documentation reports, witness statements, disposition letter, and any other documents pertinent to the case.Inaddition,iftheoriginalhearingwasrecorded,theappealsbodymaychoosetolistentotherecording.Further,theappealsbody willreceivecopiesoftherequestforappealandanyadditionaldocumentationthatwillbepresentedattheappealshearing.Alldocuments 26

shallbeheldinconfidenceandwillbecollectedattheconclusionofthehearing. Acopyofallwrittenmaterialstobeconsideredintheappealhearingshallbeprovidedtothechargedstudentandtothecomplainant(s) (ifany)fortheiruseduringthehearing.Thesewrittenmaterialswillbecollectedattheendofthehearing.Ifrequestedbythecharged studentorthecomplainant(s),arrangementswillbemadeforthemtoreviewthewrittenmaterialspriortotheappealhearing. Theoriginaladministrativehearingofficerorarepresentativeoftheoriginalhearingbodywillpresentinformationtotheappealbody. Thisindividualmaybepresentatthehearing,makeastatementconcerningtheissuesraisedbytheappeal,beinformedofthecontentof writtenmaterialaboutthecase,callwitnessesifnecessarytosupporttheoutcomeoftheoriginalhearing,anddirectlyquestionwitnesses. WhiletheUniversitybringsallchargeswithinthestudentdisciplinaryprocess,thereareoccasionswhenamemberofthecampuscommunity believess/hehasbeenavictimoftheallegedviolationandmayalsobeconsideredtobeacomplainant.Inthiscase,thispersonmaybe directlyinvolvedinthecasebroughtbeforeanappealsbodyand,therefore,maybepresentatthehearing,provideinformationrelevantto the grounds of the appeal, call witnesses to speak on new and significant information which was not reasonably discoverable/available before the original decision was rendered, question witnesses in the manner described in Article VI, Section 8 of the student discipline process,andbeaccompaniedbyanadvisorwhomustbeaUniversityofMountUnionstudent,faculty,orstaffmemberandmaynotbean attorney.Advisorsmaynotspeakordirectlyparticipateinthehearing,unlessotherwiseapprovedbythemembersoftheappealsbody. Aftercompletionofthepresentationofinformation,theappealsbodywilldeliberateprivatelyandreachadecision.Theappealsbody willfirstconsiderifanyofthespecifiedgroundsforappealhavebeenmet.Ifthegroundsforappealhavebeenmetandthesegroundsrelate tothedeterminationofresponsibility,asustaineddecisionshallonlybereachedwhentheappealsbodyfindsthatthepreponderanceofthe informationthathasbeenpresentedsupportstheallegationthatthechargedstudenthasviolatedtheUniversityofMountUnionStudent CodeofConduct.Ifthegroundsforappealhavebeenmetandthesegroundsrelatetothesanctionsassignedbytheoriginalhearingbody, thentheappealsbodywillmakeadecisionregardingtheappropriatenessoftheassignedsanctions. Thedecisionoftheappealsbodyisfinalandwillbepresentedtothechargedstudentassoonaspossibleafterthehearingbythedean ofstudentsorher/hisdesignee. Allproceduralquestionsaresubjecttothefinaldecisionofthedeanofstudentsorher/hisdesignee.

AcademicDishonestyHearingProcess
ArticleI:AcademicHonesty
TheUniversityviewsthemoralandethicaleducationofitsstudentsasbeingequalinimportancetotheirintellectualdevelopment.The codesofconductandethicalhabitsindividualspracticeasstudentsarelikelytoguidethemfortheirentirelives.Asaconsequence,a significantpartoftheUniversitysmissionistosupportinitsstudentsabeliefintheimportanceofpersonalhonestyandintegrityanda strongcommitmenttohighstandardsinthoseareas.Inalloftheiracademicpursuits,MountUnionstudentsareexpectedtoberesponsible membersoftheacademiccommunity. Unlessclearlydocumentedwithcitationsindicatingotherwise,allacademicworkisexpectedtobethestudentsown.Plagiarismand/or any other form of cheating or dishonesty will subject the student involved to sanctions ranging from failure of an assignment to possible suspensionordismissalfromtheUniversity.WhenthelattersanctionsarerecommendedtheAssociateAcademicDeanforCurriculumand StudentIssuesmayconveneahearingcommitteetodetermineresponsibilityandappropriatesanctions.Specificproceduresforhearingsof thisnatureareoutlinedbelow.

ArticleII:HearingCommitteeMembership
TheacademicdishonestyhearingcommitteeshallconsistoftwofacultymembersfromtheAcademicPoliciesCommittee,onestudent tobeappointedbyVicePresidentforAcademicAffairsorher/hisdesignee,andtheAssociateAcademicDeanforCurriculumandStudent Issues,whoservesasconvenerwithoutvote. Anymemberoftheacademicdishonestyhearingcommitteewhoisconsideredtohaveaconflictofinterestintheparticularcasebeing heardshoulddiscusswiththeAssociateAcademicDeanthedesirabilityofbeingexcusedfromthathearing.TheAssociateAcademicDean willdecidetheappropriatenessofthatmembersinvolvementandselectareplacementforthehearingifneeded. Thechargedstudentshallhavetherighttoaskfortheremovalofanycommitteememberbyprovidingawrittenorverbalstatement regardingtheallegedconflictofinterestonthepartofthecommitteemember.TheAssociateAcademicDeanwilldetermineifthereisa potentialconflictofinterest.Ifapotentialconflictofinterestisshown,theAssociateAcademicDeanwillselectareplacementcommittee member.

The purpose of an academic dishonesty hearing is to provide an evaluation of a charged students responsibility for violating the UniversityofMountUnionsacademichonestypolicy.

ArticleIV:ProceduralProtections
Academicdishonestyhearingswillbeconductedinaccordancewiththeproceduressetforthbythisdocument,butshallnotbebound bythetechnicalrulesofevidenceorotherformalrulesofprocessorprocedure,suchasareappliedincriminalorcivilproceedings. Academicdishonestyhearingsshallbeclosedtoallpartiesotherthanthefollowing:thechargedstudent;thefacultymemberreporting thedishonesty(alsoknownasthecomplainant);themembersofthehearingcommitteeasdescribedabove;aUniversityofMountUnion student,facultyorstaffmemberwhoisactingasanadvisortothechargedstudent;andwitnesses(whoareonlypresentduringthetimethat theyareprovidinginformation.) Asinglerecordingshallbemadeofeachhearing.Thedeliberationsoftheacademicdishonestyhearingcommitteewillnotberecorded. TherecordingshallbethepropertyoftheUniversity.Recordingsofallacademicdishonestyhearingcommitteeproceedingswillbekepton fileintheassociateacademicdeansoffice.Recordingswillbeerased60daysafterthehearingunlessanappealisstillpending.Inthiscase, recordingswillbeerasedthirtydaysafterthefinalappealdecision. A written description of the charges shall be made available to the academic dishonesty hearing committee. This description shall includethenameofthechargedstudent,thetimeandplaceoftheallegedoffense,andthenatureoftheallegedoffense.Inaddition,other writtenmaterialsmaybeconsideredatthediscretionofthehearingcommittee.Thesewrittenmaterialsshallbeheldinconfidenceandwill becollectedattheconclusionofthehearing. A copy of all written materials to be considered in the hearing shall be provided to the charged student for her/his use during the hearing. These written materials will be collected at the end of the hearing. If requested by the charged student, arrangements will be madeforher/himtoreviewthewrittenmaterialspriortothehearing. Thecomplainant(s),thechargedstudentandtheAssociateAcademicDeanmayarrangeforwitnessestopresentpertinentinformation tothecommittee.Witnesseswillprovideinformationtoandanswerquestionsfromtheacademicdishonestyhearingcommittee. After completion of the presentation of information, the committee will deliberate privately and reach a decision. A finding of responsibility shall only be reached when a majority of the voting members of the committee finds that the preponderance of the informationthathasbeenpresentedsupportstheallegationthatthechargedstudenthasviolatedtheUniversityofMountUnionAcademic HonestyPolicy.Ifthechargedstudentisfoundresponsiblefortheviolation,thentheacademicdishonestyhearingcommitteewillmakea decisionregardingappropriatesanctionstobeassigned. ArticleVI:Appeals
AppealsshallbeconsideredunderthecircumstancesandproceduresdescribedinArticleVIIoftheStudentDisciplinaryProcess,which maybefoundintheStudentHandbook.

StudentCodeofConduct
ThefollowingconductisunacceptabletoUniversityofMountUnionandwillbeaddressedthroughthestudentdisciplinaryprocess.This listingisillustrativeofthekindsofbehaviorsprohibitedbytheUniversity,butisnotanexhaustivedefinitionofmisconduct.Althoughthe Universitywillmakeeveryreasonableefforttomaketherulesandregulationsavailable,studentsareresponsibleforbecomingfamiliarwith them.BeingundertheinfluenceofalcoholorotherdrugsdoesnotdiminishastudentsresponsibilityorexcuseaviolationoftheCodeof Conduct.Prohibitedbehaviorsinclude: 1. AcademicMisconductViolationsoftheAcademicHonestyPolicy.ThepolicycanbefoundinitsentiretyintheProgramhandbook. 2. DishonestyFurnishingfalseID;furnishingafalsewrittenororalstatement;falsification,alterationormisuseofUniversity,orother official,documentsorrecords;knowinglypassingaworthlesscheckormoneyorderinpaymentofafinancialobligationtotheUniversity ortoamemberoftheUniversitycommunity;falselyrepresentingtheworkofanotherasonesown. 3. MisuseofIdentificationTransferring,lending,borrowingoralteringUniversityidentificationorotherofficialformsofidentification (i.e.driverslicense);productionorpossessionofafakeoralteredID. 4. MisuseofTechnologyMisuseorabuseofanycomputer,computersystem,service,hardware,software,program,data,network,cable televisionnetworkorcommunicationnetwork,particularlyasdefinedbytheTechnologyResourcesAcceptableUsePolicy. 5. DisorderlyConductAbusive,obscene,violent,destructiveorexcessivelynoisybehavior,includingbehaviorsthatresultfrombeing undertheinfluenceofalcoholorotherdrugs. 6. CommunityDisruptionBehaviorsthatdisrupttheregularoperationoftheUniversityorinterferewiththeabilityofmembersofthe 28

MentalorBodilyHarm*Actscoveredbythispolicyinclude,butarenotlimitedto: a) intentionallyinflictingmentalorbodilyharmuponanyperson; b) takinganyactionforthepurposeofinflictingmentalorbodilyharmuponanyperson; c) takinganyreckless,butnotaccidental,actionfromwhichmentalorbodilyharmtoanypersoncouldresult; d) sexualassault; e) harassing,intimidatingorthreateningbehaviortowardanypersonincluding,butnotlimitedto,behaviorinviolationofthe UniversityofMountUnionStatementonHarassmentfoundintheStudentHandbook; f) anyactwhichdemeans,degradesordisgracesanyperson,e.g.hazing; g) useofalcoholorotherdrugsinamannerthatcontributesto,orplacestheindividualatriskfor,mentalorbodilyharm. *Anypersonasusedinthissectionmayincludeonesself. 8. Theft/UnauthorizedUseofPropertyTheftorunauthorizeduseofproperty,moneyorservicesfromtheUniversityoranyotherperson orbusiness.Thisincludestheunauthorizeduse,duplicationorpossession**ofanykeyissuedforanyUniversitybuilding,facilityor room. 9. MakingaFalseReportCausing,makingorcirculatingafalsereportorwarningoffire,explosion,crime,violationoftheStudentCode ofConduct,orothercrisisoremergency. 14. FailuretoEvacuateduringaFireAlarmFailuretoleaveabuildingquicklyandinanorderlymannerintheeventofafirealarm. 15. PossessionofDangerousWeaponsorMaterialsUnauthorizedpossession**,useorstorageofweaponsordangerousmaterialsofany typeordescription,including,butnotlimitedto,firearms,compressedairguns,pelletgunsofanynature,paintballguns,BBguns,illegal knives,swords,brassknucklesandotherfightingapparatus,explosivedevices,fireworks,ammunitionforanyprohibitedweapon,orany dangerousordnanceasdefinedbyOhiolaw.Inaddition,flammableliquidsorgases,suchasgasoline,kerosene,propane,lighterfluid, etc.maynotbeusedorstoredinanyresidentialfacility,orbystudentsinanyothercampusbuildingexceptasapprovedbyappropriate Universityofficials. 16. ViolationofUniversityDrugPoliciesThemanufacture,distribution,sale,offerforsale,use,orpossession**ofanyillegaldrugor narcotic.Inaddition,thepossession**oruseofdrugabuseinstrumentsorparaphernaliaisprohibited.(Additionaldetailscanbefound inthecompleteDrugPolicyintheStudentHandbook.) 17. ViolationofUniversityAlcoholPolicies(a)Possession**orconsumptionofalcoholicbeverages,exceptundercircumstances authorizedbytheUniversityofMountUnionAlcoholPolicy;(b)failuretocomplywithstateorUniversityregulationsregardingtheuse orsaleofalcoholicbeverages. 18. FailuretoComplyorIdentifyFailuretocomplywiththedirectionsofUniversityorpublicofficials,includingresidencelifestaffand securityofficers,actingintheperformanceoftheirdutiesortoidentifyonesselftothesepersonswhenrequestedtodoso.This includesfailuretocompleteassigneddisciplinarysanctions. 19. ViolationofRulesRegardingtheResidenceHallsViolationofanyoftherulesandregulationsoftheUniversityresidencehalls.(Alisting ofResidenceHallRegulationscanbefoundintheStudentHandbook.) 20. FacilitatingorEncouragingViolationsoftheCodeofConductHelping,procuringorencouraginganotherpersontoviolatetheStudent CodeofConduct. 21. ViolationofProbationViolationoftheStudentCodeofConductwhileonprobationorviolationofthetermsofthatprobation. 22. DisciplinarySanctions
1. UniversityofMountUnionsupportstheconceptofeducationaldiscipline.Therefore,whenagraduatestudentisnotadangertothe Universitycommunity,orwhenrepetitionofmisconductisunlikely,theUniversitywillmakeanefforttoeducatethestudentthrough disciplinarysanctions.However,shouldthestudentdemonstrateanunwillingnesstoadheretothebehavioralexpectationsofthe University,ortothegraduateprogram,heorshewillbetreatedinasimilarmannerasonewhohasfailedacademically,andmaybe separatedfromtheUniversity.Possibledisciplinarysanctionsinclude,butarenotlimitedto: a) WrittenWarningAwrittennoticetothestudentthatthestudenthasviolatedtheStudentCodeofConduct,thatsuchbehavioris 29

unacceptable,andthatfurtherviolationsmayresultinmoreseriousdisciplinarysanctions. b) DisciplinaryProbationAwrittenreprimandforviolationoftheStudentCodeofConduct.Disciplinaryprobationisforadesignated periodoftimeandincludestheprobabilityofmoreseveredisciplinarysanctionsifthestudentisfoundtobeviolatingtheStudent CodeofConductduringtheprobationaryperiod. c) LossofPrivilegesDenialofspecificprivilegesforadesignatedperiodoftime. d) FinesPreviouslyestablishedfinesmaybeimposed. e) RestitutionCompensationforloss,damage,orinjury.Thismaytaketheformofappropriateserviceand/ormonetaryormaterial replacement. f) EducationalSanctionsAssignmentsmadetoassistintheeducationaloutcomeofthedisciplinaryprocess(e.g.,meetingswiththe DirectorofAlcohol,DrugandWellnessEducation,attendanceatprograms,writingaresearchpaper,etc.)Theseassignmentsare designedtoaddressthespecificissuesthatariseineachdisciplinarycase. DisciplinarySuspensionSeparationofthestudentfromtheUniversityforadefiniteperiodoftime,afterwhichthestudentis eligibletoapplyforreadmission.Conditionsforreadmissionmaybespecified.

h) DisciplinaryExpulsionPermanentseparationofthestudentfromtheUniversity. 2. 3. Morethanoneofthesanctionslistedabovemaybeimposedforanysingleviolation. Disciplinarysanctionsdonotappearonastudentsacademictranscript,butdobecomeapartofthestudentsconfidentialeducational recordwiththeUniversity.Disciplinaryrecordsarekeptonfileforsixyearsfollowingastudentsgraduationorwithdrawalfromthe University. ThefollowingsanctionsmaybeimposedupongroupsororganizationsfoundtohaveviolatedtheStudentCodeofConduct: a) Thosesanctionslistedaboveinsection1,athroughf. b) DeactivationLossofallprivileges,includingUniversityrecognition,foraspecifiedperiodoftime.Conditionsforreactivationmay bespecified.

InterimSuspension
Incertaincircumstances,thevicepresidentofstudentaffairsanddeanofstudents,orhis/herdesignee,mayimposeadisciplinaryor residencehallsuspensionpriortoadisciplinaryhearing.Interimsuspensionmaybeimposed:a)toensurethesafetyandwellbeingof membersoftheUniversitycommunityorpreservationofUniversityproperty;b)toensurethestudentsownphysicaloremotionalsafety andwellbeing;orc)ifthestudentposesadefinitethreatofdisruptionoforinterferencewiththenormaloperationsoftheUniversity. Inadditiontotheabove,aninterimsuspensionwillbeimposediftheUniversitybecomesawarethatastudentattemptsorthreatens toattemptsuicide.Underthiscircumstance,theinterimsuspensionwillremainineffectuntilthestudenthasbeenassessedbya psychiatristandreceivesawrittenreleasefromthepsychiatristthatthestudentisabletosafelyreturntothecampusenvironment.This releasewouldincludeanyrecommendationsfromthepsychiatristregardingtreatmentwhilethestudentremainsenrolledand/orremains oncampus.IfthestudentisreleasedtoreturntotheUniversity,pursuanttothepsychiatristsrecommendations,thestudentwillbe requiredtocomplywithhisorherpsychiatristsrecommendationsinordertoremainattheUniversity. Duringaninterimsuspension,thestudentshallbedeniedaccesstothecampustotheextentdeemedappropriatebythedeanof studentsorhis/herdesignee.Thismayincluderestrictionfromresidencehalls,Universityactivities,campusbuildings,classes,etc.,ormay constituterestrictionfromthecampusentirely.

AlcoholandOtherDrugUse/AbusePoliciesandPrograms
MountUnionisconcernedaboutthehealthandwellbeingofitsstudents,facultyandstaffandrecognizesthehealthhazardsinvolved withtheuseofalcoholandotherdrugs.Thefollowingpoliciesareanattempttoinfluencestudentstomakelowriskdecisionsregarding alcoholandotherdrugs.InaccordancewiththeDrugFreeSchoolsActof1989,stateandlocallawspertainingtoalcoholanddruguseare alsodetailedinthissection,inadditionto,thehealthrisksofalcoholandotherdruguseandtreatmentopportunitiesavailableforstudents, facultyandstaffmemberswhoareinvolvedintheabuseofalcoholorotherdrugs.

AlcoholPolicy
MountUnionexpectsmembersofthecampuscommunitytoactinamaturemannerandtoacceptfullresponsibilityfortheir behavior.Violationofanylocal,stateorfederallawregardingtheuseofalcoholicbeveragesisconsideredtobeaviolationoftheUniversity ofMountUnionAlcoholPolicy,regardlessofwherethisviolationoccurs.Providingalcoholicbeveragestopersonsundertheageof21isan illegalactandwillbeaddressedseriouslybyMountUnion.Inaddition,itisaviolationoftheStudentCodeofConductforstudentstoallow alcoholicbeveragestobeconsumedattheirplaceofresidencebypersonsundertheageof21. WhiletheUniversitydoesnotencouragetheuseofthesebeverages,alcoholicbeverages,asallowedbyUniversitypolicyandstateand locallaws,arepermittedinindividualstudentroomsanduniversityapartments,infraternityandsororityhouses(asallowedbynational and/orlocalchapterguidelines)andatactivitiesheldoffcampusbystudentswhoare21yearsofageorolder.Thefollowingarespecific alcoholregulations. 1. Personswhoare21yearsofageoroldermaypossess*andconsumealcoholicbeveragesintheresidencehalls,universityapartments andcampushousesaccordingtothefollowingstandards: a) Studentswhoare21oroldermaypossess*orconsumealcoholicbeveragesintheprivacyoftheirindividualstudentroomsor 30

universityapartments.Room/apartmentdoorsmustbeshutwhenconsumptionisoccurring. b) Anindividualwhoisoflegaldrinkingagemaynotconsumealcoholinthepresenceofanyoneundertheageof21,withthe exceptionofher/hisroommate(s)/apartmentmate(s). c) Nooneshallconsumeorpossess*opencontainersofanyalcoholicbeverageinanyotherareaoftheresidencehalls,university apartmentsandcampushouses(e.g.,lounges,hallways,restrooms,laundryrooms,etc.) d) Kegsofbeer,taps,beerballsandbeerfunnelsarenotpermittedinoronUniversityofMountUnionproperty.Theseitemswillbe confiscatedbyUniversityofficialsifdiscoveredoncampus. e) DrinkinggamesorcontestsinvolvingalcoholicbeveragesmaynotbeplayedonUniversityofMountUnionproperty. 2. Personswhoareunder21yearsofagemaynotpossess*orconsumeanyalcoholicbeverageorpossess*alcoholicbeveragecontainers, fullorempty,anywhereoncampusoratanyUniversityrelatedfunctions.Individualswhoareunder21yearsofagewhoarediscovered inareaswheretherearealcoholicbeveragespresentorwhoarediscoveredpossessing*orconsumingalcoholwillbesubjectto disciplinaryaction.Theonlyexceptiontothispolicyisintheinstancewhereapersonwhoisoflegalageisconsuminginthepresenceof hisorherunderageroommate/apartmentmate. 3. AlcoholicbeveragesarenotpermittedtobesoldontheMountUnioncampus. 4. Alcoholicbeveragesarenotpermittedtobepossessed*,servedorconsumedinanypublicplaceontheMountUnioncampus. 5. Possession*orconsumptionofalcoholicbeveragesatMountUnionathleticeventsorintheUniversityathleticfacilitiesisprohibited. 6. IndividualsfoundinlocationswhereviolationsoftheAlcoholPolicyareoccurringwillbeaskedtodisposeofallalcoholicbeverages immediately. 7. Themanufacture,useorpossessionoffalsifiedoralteredidentificationwillbeconsideredaseriousviolationoftheStudentCodeof Conduct,particularlywhentheidentificationisusedtodeceiveofficialsastotheageoridentityofthebearer. 8. Advertisementsandpromotionalmaterialspostedordistributedoncampusmaynotmakeanydirectorimpliedreferencetoordepictin anymanneralcoholicbeverages,alcoholicbeveragecompanylogosorsymbols,theconsumptionofalcoholicbeverages,drugsordrug paraphernaliaortheuseofillicitdrugs.Exceptionstothispolicymaybemadeforadvertisementsforeducationalprogramsandevents; however,thesematerialsmustbeapprovedinadvancebytheassociatedeanofstudentsorthedirectorofalcohol,drugandwellness education. 9.Nocampusactivitymaybecosponsoredbyabar,liquorestablishmentorotheralcoholicbeveragemanufacturerordistributor. 10.Althoughtheconsumptionofalcoholicbeverageswithintheaforementionedguidelinesispermitted,inappropriateactionsandbehavior thatmayaccompanydrunkennesswillnotbetoleratedorexcusedandwillleadtodisciplinaryaction. *PLEASENOTE:Thepresenceofalcoholmaybeinterpretedaspossessionofthealcohol.Studentsencounteredinlocationswherealcohol ispresentmaybeconsideredtobeinviolationoftheAlcoholPolicy,eveniftheydonothavealcoholontheirpersonatthetimetheyare encountered.

DrugPolicy
Sincethemanufacture,distribution,sale,offerforsale,use,orpossession*ofillicitdrugsornarcoticsisanillegalact,whichisalso extremelyhazardoustothewellbeingoftheindividualinvolvedandnotcompatiblewithgoodcampuscitizenship,studentsinvolvedinthe aforementionedbehaviorswillbesubjecttodisciplinaryactionuptoandincludingsuspensionorexpulsionfromtheUniversity. Inaddition,thepossession*oruseofdrugabuseinstrumentsorparaphernaliaisaviolationoftheStudentCodeofConductandwill resultindisciplinaryaction.Prohibiteditemsinclude,butarenotlimitedto,bongs,hookahs,waterpipes,rollingpapers,etc.Drug paraphernaliaalsomayincludeitemsthatarenotinandofthemselvesagainstUniversityofMountUnionpolicies,ifsaiditemsareusedfor storing,preparing,consumingorinanyothermannercontributetotheuseorpossessionofillicitdrugs. *PLEASENOTE:Thepresenceofdrugsorparaphernaliamaybeinterpretedaspossessionofthosearticles.Studentsencounteredin locationswheredrugsorparaphernaliaareevidentwillnormallybeconsideredinviolationoftheCodeofConduct,eveniftheydonot havetheprohibiteditemsontheirpersonatthetimetheyareencountered.

AlcoholandOtherDrugProceduresforStudent Organizations
Studentorganizations,includingfraternitiesandsororities,mustabidebythefollowingguidelines: 1. Allstate,local,andUniversitylawsandpoliciesconcerningtheuseofalcoholandotherdrugsmustbeobserved.Inaddition,Greekletter organizationsmustabidebyInterfraternityandPanhellenicCouncilrulesandregulations,aswellas,policiessetforthbytheirnational organizations. 2. Inorderforalcoholicbeveragestobeallowedatastudentorganizationevent,organizationsmustcomplywiththeSocialEventRisk ManagementPolicies.CompliancewiththesepoliciesmustbecoordinatedwiththeOfficeofStudentInvolvementandLeadershipand approvalmustbegivenbythisofficebeforetheeventcanoccur. 3. Ifanoffcampusactivityincludesthesaleofalcoholicbeverages,organizationswillberequiredtousealicensedthirdpartyvendorto managethissale. 31

4. Promotionalmaterials(including,butnotlimitedto,advertisementsinanyform,tshirts,cupsoranyotheritemtobedisplayed,given awayorsoldbefore,duringorafteranevent)shallnotmakeanydirectorimpliedreferencetoordepictinanymanneralcoholic beverages,alcoholicbeveragecompanylogosorsymbols,theconsumptionofalcoholicbeverages,drugsordrugparaphernalia,orthe useofillicitdrugs. 5. Noactivitymaybecosponsoredbyabar,liquorestablishment,orotheralcoholicbeveragemanufacturerordistributor.Advertisement forsuchestablishments,manufacturersordistributersmaynotoccuratanyactivity. 6. Nostudentorganizationshallallowalcoholicbeveragesordrugstobepresentatitsmembershiprecruitmentactivitiesorinitiation activities. 7. Theofficersofthestudentorganizationsponsoringtheactivityareresponsibleforenforcingtheaboveguidelinesandforthebehaviorof theguestsattheirevents.

AlcoholorDrugPolicySanctions
1.Anindividualinvolvedinaviolationofalcoholordrugrelatedpolicieswillbereferredfordisciplinaryaction,andmayreceiveanyofthe sanctionsoutlinedinthestudentdisciplinaryprocess. 2. Ifarecognizedstudentorganizationviolatesthealcoholordrugpolicies,thegroupwillbereferredfordisciplinaryaction.Thefollowing minimumsanctionswillapply: a) Atwohundreddollarfineandaperiodofprobationforafirstoffense.Possibleconditionsofthisprobationinclude,butarenot limitedto,restrictionsonactivitiessuchasrecruitment,sponsoringsocialactivities,orparticipationincampusevents. b) Subsequentoffensesmayresultinsuspensionofthegroupfromcampus. c) Otherpenaltiesmaybeassesseddependinguponthenatureoftheviolation.

StateandFederalLawsPertainingtoAlcoholandOtherDrugs
Ohiolawprohibitsthepurchase,consumptionorpossessionofalcoholicbeveragesbypersonsunder21yearsofage,withafineupto $1,000and/orsixmonthsimprisonmentforthefirstoffense.Possessionordisplayofafictitiousoperatorslicenseisafirstdegree misdemeanor.Theoffenseincludesmerepossessionofafictitiouslicenseordisplayofsomeoneelsesvalidoperatorslicense.The maximumpenaltyforthisoffenseissixmonthsimprisonmentand/ora$1,000fine.Ifthefictitiousoperatorslicenseisusedtopurchase alcoholorenteranestablishmentthatservesalcoholtheminimumfineis$250andthepersondisplayingthefactitiousoperatorslicense mayhavehis/hervalidoperatorslicensesuspendedforthreeyears. Apersonwhofurnishesalcoholtoanunderagepersonisguiltyofafirstdegreemisdemeanor.Themaximumpenaltyassociatedwith thisoffenseissixmonthsimprisonmentand/ora$1,000fine.Therefore,asocialhostrisksbeingfinedandimprisoned.Itisillegaltopossess anopenalcoholiccontainerinpublic.Convictionofthisoffensecarriesamaximumpenaltyof$100fine. WeaponsPolicy

Thecampuslakesareforcampusbeautificationonly.Nooneispermittedtobeinoronthelake.Boating,swimming,iceskatingandall otheractivitiestakingplaceinoronthecampuslakesarestrictlyprohibited.

StudentHealthCarePrivacy
Duringtheacademicyear,astudentmaybetreatedattheStudentHealthCenteror,ifappropriate,intheDepartmentofHuman PerformanceandSportManagement,whileotherstudentsmayreceivecounselingbytheOfficeofCounselingServicesortheOfficeof Alcohol,DrugandWellnessEducation.Onoccasion,astudentmaybeseenatalocalhospitalorbyaprivatephysicianfortests,xrays,or treatment.ThehospitalorphysiciangenerallysendsacopyofthosetestresultsormedicalrecordstotheStudentHealthCenter,which maintainstheminthestudentshealthrecord. TheconfidentialityofastudentshealthcareinformationisimportanttotheUniversity.Studentsshouldknowwhatlawsapplyandhowthe Universityprotectstheprivacyofstudenthealthinformation.Thetwomainlawsgoverningtheconfidentialityofstudenthealthinformation aretheHIPAAPrivacyRuleandtheFamilyEducationalRightsandPrivacyAct(FERPA).

HIPAA
HospitalsandprivatephysiciansmustcomplywithHIPAAsPrivacyRule,whichcontrolstheuseanddisclosureofapatientsprotectedhealth information.Ifastudentgoestothehospitaloraprivatephysiciansoffice,itwillnotbenecessary,underHIPAA,forthestudent(orparent, ifthestudentisaminor)tosignanauthorizationinorderforthehospitalordoctortosendacopyofthatstudentstestresultsormedical recordtoanurse,physicianorotherhealthcareproviderattheStudentHealthCenter. Italsowillnotbenecessaryforthestudent(orparent)tosignanauthorizationforthehospitalorphysiciantosubmitaclaimforpaymentto thestudentsorparentshealthinsuranceplan.HIPAAdeferstoOhiolawindealingwiththerightsofparentsandchildren.Astudent,who hasreachedtheageof18,mayrequestthehospitalorprivatephysiciannottodisclosemedicalinformationtohisorherparents.That decisionisstrictlybetweenthestudentandphysicianinprivatepractice,whoisnotconnectedwithUniversityofMountUnion. InformalGrievanceProcedure

Oftenwhenpeoplehearaboutsexualassault,theyautomaticallythinkaboutrape.However,sexualassaultsoccuronacontinuumof intrusionandviolation.Ifpermissionhasnotbeengivenortheindividualdoesnotwanttoengageinthesexualactivityoristricked,coerced orpressuredintothebehavior,itissexualassault.Itisalsosexualassaultwhensexualbehavioroccurswhenapersonisunabletogive consentduetobeingundertheinfluenceofalcoholorotherdrugs. Receivingmedicalcareassoonaspossiblefollowingasexualassaultorattemptedsexualassaultisextremelyimportantfortworeasons. First,thesurvivormayhavesufferedinjuriesofwhichshe/heisunawareorunabletodetermine.Testing,treatmentandinformation regardingsexuallytransmitteddiseasesorpregnancymayalsobeneeded. Second,ifthesurvivorthinksthattheremaybeanypossibilitythatshe/hewillwishtopursueprosecutingtheoffender,amedical/legal examinationforthecollectionofevidenceisvital.Havingevidencecollecteddoesnotmeanprosecution.Theforensicevidencewillbestored untiltherehasbeenaninvestigation.Whilecertainmedicalassistancecanbereceivedfromanumberoflocations,AllianceCommunity 39

Hospitalistheonlylocalplacewhereevidencenecessaryformedicalandforensicevaluationcanbecollectedandsecuredforlegalpurposes. WithdrawalProcess

AstudentwhowantstowithdrawafterclasseshavestartedforthesemesterinitiatestheprocesswiththeProgramDirectortoindicate thathe/sheiswithdrawing.TheofficialdateofwithdrawalisthedatethestudentcontactedtheProgramDirectorORthemidpointofthe semesterifthestudentleaveswithoutnotifyingtheinstitutionORthestudentslastdayofattendanceatadocumentedacademicallyrelated activity.Thispolicyappliestostudentswhowithdrawfromalltheirclassesforthesemesteroraresuspended.
