5.10 Officers appointed on or after 1st January 2007 5.10.1All Officers who joined the Company on or after 1.1.07 would be deemed to have been appointed/ recruited directly in the revised Scales of Pay and no Fitment Benefit will be admissible to them. Their Pay shall be fixed in the revised Pay Scales as indicated in the following paragraphs.5.10.2.1 Pay of Officers who were appointed on or after 1.1.07 at the minimum of the pre-revised Scales of Pay or already issued with Offers of Appointment indicating the said Pay, will be fixed at the minimum of the corresponding revised Scales of Pay w.e.f. the date of appointment.

This is only an internal decision of HAL and is not at all of any significance in our case.... HAL has decided not to give fitment to anyone appointed after 1.1.2007. It is their own decision. No one has anything to say about that.... Similarly, BSNL management has already given fitment benefit to JTOs of 2k5 batch who joined after 1.1.2007.... Again, it is their decision... No other PSU can comment on that.. Every PSU has a governing body who are free to take independent decisions and they need not see what any other PSU is doing.... Since BSNL has already set a precedence for 2005 batch, we can always ask for that to be repeated.. If nobody had got fitment after 1.1.2007 then our case for 21620 would have been very weak..... But since it has been given to some people, not giving it to other similarly placed people is unconstitutional.... There can be no discrimination between 2 sets of equally qualified and similarly placed individuals in terms public employment as per Article 16 of Indian Constitution... We are just asking management to bring us at par with 2005 batch and that is 100% as per constitution of India.. If you read the document carefully you will find lots of other things too in this order. For example, HAL is giving 78.2% DA merger [point 5.1(c)of the HAL order] instead of 68.8% given by BSNL. If an order of HAL was to be followed by other PSUs then BSNL

employees would also have got 78.2% DA merger. But it has not happened. So unless it is a directive from Govt of India or Ministry of Telecom, it is of no significance to BSNL..... HAL given 78.2% DA merger. But does not give fitment to employees after 1.1.2007. BSNL gives only 68.8% DA merger. But it has given fitment benefit to 2005 batch JTOs appointed after 1.1.2007. Neither can HAL employees show BSNL order for 2k5 batch and get fitment, nor can BSNL employees show HAL order and get 78.2%. So don't worry. HAL deciding not to give fitment to employees after 1.1.2007 does not affect us in any way. It is purely an internal decision of HAL. In addition what u have to keep in mind that in HAL all officer(MT) who joined HAL on or after 2007 allready got 9 advance increments beyond their Basic Pay.That is why HAL mgmt introduce para 5.10.3.1. As a result, Officer who joined after 2007

suffered very less financial loss.
