Further to my previous email (reproduced below) I like to be advised what the Shrine of Remembrance has to do with essential services where it is or should be under federal control? Also what is deemed to be community facilities and what each of them are deemed to be essential services? Also, why is the zoo or/and/or any other Zoo regarded to be essential services Why is it that parks Victoria purchase multi million dollar buildings and then for example rent ed it out for a mere $1 a year to Scientology as was reported in the past? Also, what is there as to essential service regarding the Royal Botanic Gardens? What constitutes a definition of essential service . Also, why is it that charges have gone up? Usage block 1 from $1.5343 to $1.7756 = 15.7270416% Usage block 2 from $1.8000 to S2.0832 = 15.7333333% Usage block 3 from $2.6594 to $3.07768 = 15.7328721% Sewerage Disposal Charge from $1.7196 to 1.9548 = 13.66599688% Sewerage Service Charge from $277.80 to $321.50 = 15.7207415% Water Service Charge per annum from $104.85 to $120.26 = 14.6399619%. As the Commonwealth of Australia since 2009 has joined pensions and other welfare payments to the increase of the CPI (Consumer Price Index) then the States (so also the municipal/shire councils) are bound to limit any increases as such to maximum to the CPI. Why is this blatantly and so unconstitutionally ignored? . Why is it that the website http://www.esc.vic.gov.au/public/ refers to It is also responsible for

Where constitutionally the Federal government is the Central government and the State government is the Local government? . Is it just that those who are in the Essential Service Commission simply havent got a clue what they are doing and are vandalizing and indeed undermining the rights of Victorians because they cant control their urges to increase charges in an abnormal manner? As the Framers of the Constitution made clear municipal/shire councils were companies that were to look after the residents interest and as such the Essential Service Commission should not be in existence what should be done by the municipal/shire councils and charge for something that already is to be included in rates. . If for argument some park may desire to display some flag pole then this is not a essential service issue. It may be that some people may fancy to have a flagpole in a park but this doesnt and shouldnt mean it then can be funded by parks Victoria as some essential service as this would make a mockery of what constitute essential service:. The same with the building of barbeques or other facilities other then toilet facilities, they may be decorative and handy for some but cannot be regarded as being essential service issues. .

It is notable that some parks have expensive items where ratepayers are struggling to pay their bills let alone their rates and then to burden them further with all kind of charges and unreasonably increase them also may underline that the essential Service commission rather is out of this world and not relevant to todays society. You do not increase charges for the sake of it but only seek to act with responsible increases. . The former State Government was all on about saving water only then to increase water charges because the water companies were not making enough profits. That is not for an essential service to deal with. Also water companies are not t5o operate as tax collector or under the table tax collectors. The State can only levy charges for public purposes and not for purchasing multi-million-dollar building and then rent them out for $1.00 a year to a private organization. As the Framers of the constitution made clear no one own water unless it falls on his property but the moment it leaves the property is falls under riparian rights and so how can then the essential Service commission place a charge against property owners regarding the usage of water? Also, how can the sewerage disposal of water be measured? Rainwater is being recycled by many into their gardens and do not reach any storm water drains or sewerage as such and so why charges to this? As water companies are private corporations then the State government should have no business to increase prices or allow increase prices for the sake of those private companies to make a profit. Ow that water becomes plenty full the water price (unconstitutional) is not coming down but rather is increased by about 15% and this may underline, at least to me, that the Essential Service commission is totally incompetent to realistically deal with essential service issues and may just be by people who lack any proper training/understanding as to what is appropriate to be considered. Let make it very clear that the validity of the Essential Service Commission Act 2001 is questionable at the very least and on 19 July 2006 the County Court of Victoria then upheld my cases against the Commonwealth of Australia that compulsory registration and voting was unconstitutional! As such, the fact that something was enacted as legislation doesnt make it legally enforceable and I for one do not accept the crap and neither should others do so. As for drainage charges where is the evidence that our water disposal systems are kept up to date? After all no private company is going to fund repairs as preventive maintenance where they might just sell out before major repairs are due. As such people may be slugged for cost that never is realized as to for what it was paid for. As such what breakdown can the Essential Service Commission provide that monies so far collected have been put into the relevant JUSTIFIED expenditures? . Obviously if those in the Essential Service commission do not have a clue what the true meaning and application of the (federal) constitution is then how on earth can it then competently deal with matters subject to this constitution I may well ask? . If you think I am harsh upon the essential service commission then get a life because those people who due to the ever increasing bills are unable to pay their bills and end up with a life on the street are more my concern then those jokers who are totally ignorant to the hardship they are causing and so unconstitutionally to many . I now rep[eat (Email 4-9-2011 8.53PM 4-9-2011) As a CONSTITUTIONALIST I am appalled at the about 15% increases that were included in the most recent water bill and doubt the ESC has the competence to understand and let alone comprehend what can be constitutionally permitted to be done.

Hence, I request you to provide me an outline as to what the bill charges increases are about and what is the relevant allocation of Park charges to whom and in what amounts, etc. Also what each relevant charge is constitutionally deemed valid. with the constitution I refer that all states by s106 are created "subject to this constitution" and are therefore bound to respect the division of powers federal and State. .
