accomplished by a mere resolution - not "formal legislation" - thus avoiding the President's veto power.

This "resolution" may require a one-house veto or a concurrent resolution which requires ooth houses (House and Senate) approval. As you can readily see, this list includes topics that affect our lives in one way or another almost on a daily basis. It is therefore essential that we look into this matter of legislative veto more closely. Billsrequiring Congressional review and permitting rejection of all proposed Federal agency rules and regulations (and in some cases existing rules) have been introduced in increasing numbers during the past few years, but no such comprehensive measure has been passed. Regulations issued by a few federal agencies, however, are now subject by law to some type of Congressional approval or disapproval procedure. Historically, congressional veto provisions have tended to lack uniformity. Statutes either may require that Executive proposals be approved by Congress before they can be implemented or they may provide that any such proposals would become effective unless disapproved by Congress, usually within a specific period of time. Some authorize either the Senate or the House of Representatives, acting alone, to reject proposals. Others require that ooth Houses must grant approval or pass a disapproval measure. A number of statutes, however, allow affirmation or rejection merely by committee action in either one or in both Houses of Congress. Likewise, the kind of measure which must be used for congressional veto purposes may differ. Quite often a simple resolution of

either House is sufficient. However, many laws provide instead that a concurrent res0lution of approval or disapproval must be employed. A few congressional veto acts in recent years have required that ooth Houses must pass a joint resolution or, in a few instances, a bill must be sent to the President for approval. Therefore, some experts believe that this approach is not a "true congressional veto measure". Congress still, however, can make a final determination in at least two different situations in which either a joint resolution or biD must be used: First, if the statute requires advance approval by Congress, either one or ooth Houses may reject a proposal simply by not pas.'iingsuch a measure; Second, if the statute authorizes prior Congressional disapproval and if the President should veto a joint resolution or bill passed by Congress to reject a proposal, both Houses could subsequently override the President's objections by a two-thirds vote. Because these "technical" procedural features have been adopted in various combinations during the last half century, at least 16 different types can be distinguished. In addition, others have been proposed but not enacted. The most numerous congressional veto types and numbers of legislative vetoes introduced to date in the 98th Congress are: 1. cd by either the Senate or the House of Representatives (60 laws with 103 provisions); Disapproval by a concurrent resolution passed by ooth Houses (44 Jaws with 62 provisions); Approval given by committees in ooth Houses (58 laws with 86 provisions); Approval by concurrent resolution passed by ooth Houses (19 Jaws with 36 provisions).

Nevertheless, at least 50 or more provisions do not fall within these major types and are scattered among other less common procedures. Basic procedures are often modified in one or more of several different ways. A limit mayor may not be imposed on the time during which a proposal must be approved or may be rejected. The length of the period, if any, may vary from a few days to several months. Another method used provides that either one or both Houses, or a committee or committees ofooth Houses, may be authorized to waive or shorten the length of the deferral period during which a proposal otherwise could not become effective. In a few instances, statutes have provided for a specific kind or size of vote for the acceptance or rejection of a proposal. Finally, in recent years it has become quite common to set forth special rules of procedure to expedite consideration by the Senate and House of Representatives when acting upon approval and disapproval resolutions. To the extent one or more of these variations are incorporated in any basic congressional veto type, it tends to only complicate and disorganize an already complex and diverse system.

According to Eizenstat "... it was very useful because it would have given the President the authority he otherwise would not have." Eizenstat points out that in those cases in which a President sends legislation to Congress with a PresidentiaJ veto, it represents a courtesy between the two branches of government. But in those cases in which a veto is imposed on the President, it is viewed as an unwarranted legislative interference with the Executive branch of government. Many experts feel that the legislative veto has also helped Congress to "paper over" divisions in its own ranks. Instead of drafting specific, unambiguous legislation that could not have been approved by Congress, the lawmakers often delegated broad authority to regulatory agencies with the provision that it (Congress) could veto the resulting regulations. For example, Congress gave the Federal Trade Commission (FTC) broad authority to regulate in the area of consumer protection. However, the lawmakers then turned around and vetoed regu1ationsdeaJingwith the sale of used cars. Regulations concerning funerals and television commercials for children barely survived Congressional scrutiny and possible veto action.

Constitution (Article I, Section 7) and the separation of powers doctrine. Left uncertain was the Constitutionality of a legislative veto incorporated in a joint resolution of approvaJ or disapproval. A joint resolution would be sent to the President for his signature. The immigration legislation that figured in the Supreme Court decision provides a good example of why Congress chose to delegate authority to the Executive Branch, subject to a congressionaJ veto. Prior to the legislation, Congress was flooded with private immigration bills admitting specific people to the United States, with frequent suggestions that some members of Congress were receiving payments for sponsoring the private immigration bills. Under the new laws, Congress delegated authority to the Anorney General (Executive Branch) to permit aJiens to remain in the United States, subject to a veto by either the House or the Senate.

The Court's Impact

Congressional supporters and opponents of the legislative veto agree that the Supreme Court's decision will create conflict on Capitol Hill and signifiamtly aJter the way Congress conducts its business. Experts predict that, in place of the legislative veto, Congress will pass tighter restrictions on Presidential authority and rely more heavily on the power of the appropriations and overseeing authority Congress can muster. Grassley, Republican of Iowa, Chairman of the Senate Judiciary Committee's Administrative Practice and Procedure Subcommittee feels that " ... the President is the loser in the Court's ruling. It probably means that there's going to be a very narrow writing of legislation in the future." Similarly, Representative Andy Ireland, Democrat of Florida, has called for " ... renewed initiative on the part of Congress to control regulatory abuses." Ireland feels that "the Federal bureaucracy is still out of control. Congress created it, and it's up to us (Congress) to control it, or eliminate parts of it, if necessary." Representative Elliot H. Levitas, Democrat of Georgia, the chief Congressional champion of the legisIative veto points out that "the Court's decision is going to cripple the things that this President or any President will be able to do. Congress will have no choice but to severely circumscribe any delegation of authority to the President." Although in the minority, there are those experts who feel the Court's decision "... will almost certainly give Mr. Reagan and all succeeding Presidents more power in certain key areas." They noted that, "aJthough the Congress will stil1 be able to stymie a President with legislation, a President may himself veto such legisIation."
