Dear Sir/Madam:

This office represents MyGirlFund.com and its owners (hereinafter referred to as MGF). It has been brought to our attention that your website, www.extralunchmoney.com (hereinafter referred to as the Website), is using copyrighted content misappropriated from MGF. Specifically, there are images, visual content and text which have been copied from MGF and posted on your Website. Your use of this content is improper, unauthorized and contrary to copyright and other intellectual property law, as MGF clearly owns any and all rights to this content.

We require you to immediately CEASE AND DESIST from such unauthorized use of any and all content contained on the MGF website and remove any and all such content from your Website and anywhere else you may have posted and/or distributed this copyrighted content. Your use of MGFs content constitutes a violation of Federal and State copyright laws, anti-cybersquatting laws, unfair trade practices, misappropriation, conversion and theft, as well as a violation of various other Federal and State statutes, and will not go unchallenged. By virtue of this correspondence, you now officially have actual notice of the existence of MGFs copyright and the fact that your use of the content is unauthorized. Your failure to comply with the non-negotiable terms of this letter will entitle MGF to damages and lost profits, in addition to attorneys fees and other statutorily prescribed remedies, in any suit brought against you for copyright infringement.

Furthermore, the ExtraLunchMoney blog referencing MGF contains untrue, derogatory and defamatory statements regarding MGF and attempts to divert MGF clients, users and/or customers from MGF to your Website, thereby subjecting you to liability for libel, fraud, misrepresentation, tortious interference with contractual relations, intentional interference with prospective economic advantage, unfair trade practices, misappropriation and several other Federal and State causes of action.

If you fail to remove any and all content misappropriated from the MGF website including, but not limited to, all photos, images, visuals and/or text, from your Website within five (5) calendar days, a complaint will be filed seeking an immediate and permanent injunction against your use of such content, compensatory damages, lost profits, punitive damages and attorneys fees. We will prosecute our clients intellectual property and other rights to the fullest extent of the law and have a zero tolerance policy for any type of infringement of those rights and/or any defamatory statements contained on your website which misrepresent MGF and its business and attempt to steal MGF clients, customers and/or users. Please guide yourself accordingly.

Very truly yours,

Angela C. Vidal, Esq.

I was not aware that any part of the extralunchmoney.com was violating your client's copyrights. Before I consider removing any content you are going to have to specifically state which items are in supposed violation. We've received outrageous and unfounded claims before. If there is a violation than we will correct it. If not then we can both go on our merry way. Yours truly, Michelle
