Justice Weaver promotes reform, accepts the Don Jennings Award

ONEKAMA Elizabeth Weaver was hoping that her retirement from the Michigan Supreme Court would lead to more tennis, golf and other summertime activities. But, most of that is on hold as the Leelanau County resident presses her case that Michigans system for selecting Supreme Court justices is in critical need of reform. Weaver, who retired in August of 2010, spoke at the Manistee County Democratic Partys annual Don Jennings Award Dinner Saturday night at Portage Point Inn, and then became the eighth recipient of the award. Rick Schrock, chairperson of the Manistee Democrats, opened the evening saying, Were gathered here because we believe in justice. Don Jennings was a person who fought battles for justice both locally and in Mississippi during the civil rights struggles of the 60s. Tonight we will honor Justice Weaver with the Don Jennings award for her strong stands for justice on our Michigan Supreme Court. 19th Circuit Court Judge James Batzer first talked about Jennings as he introduced Weaver. Don utterly transformed the legal system in Manistee, Batzer said. He made the legal system do what it was supposed to do. The legal system is an adversary system and Manistee had a network of people who were quite comfortable and no one spoke up for the ordinary person. Well, Don did something about it, Batzer said. He took those peoples cases, took them to court, and fought for them. Since he was willing to fight, he just utterly transformed the legal system here in Manistee County and he made it work the way it is supposed to work. Of Justice Weaver Batzer said, This is a woman of real intellect, but heres the outstanding thing about Justice Weaver. She has been a legal scholar of uncommon common sense among legal scholars, and

Shes served in excess of 36 years as a judge and judges throughout the State of Michigan know theyve had a friend in Justice Weaver. But Ive reasoned that you, the good grassroots Democrats of Manistee County, appreciate and desire truly independent non-partisan Supreme Court justices, and perhaps when you considered my service record, you thought maybe I was one. So I very humbly accept your honor and I thank you very much. Weaver launched her discussion of the reform she believes needs to take place on the Michigan Supreme Court. Judy Cunningham, who invited Weaver to the event, presented her with several gifts. and confidence. Do we now have such a Supreme Court? From my almost 16 years experience, I say no. Can we ever have it? I believe yes, or I wouldnt be here tonight. She said such a court would require seven independent justices about whom the people have sufficient information to hold each accountable for his or her individual or collective performance. An independent justice is not agenda driven and does not hold to or promote political party lines or philosophies or ideologies. An independent justice is dedicated to the rule of law, is impartial and courageous, exercises judicial restraint and self discipline, applies common sense, and is wise, honest, fair, just, kind and charitable, orderly, civil and professional. Open, not secretive, and non-partisan. Weaver said the most important element in transforming the Michigan Supreme Court is to eliminate the unnecessary secrecy under which the court now operates. Unnecessary secrecy is the crux of the problem. It allows to take root and grow the worst propensities of human nature hatred, revenge, lust for power and deceit. She said the flawed selection system produces power blocks of justices joining together with the majority to promote agendas. Agendas of political parties and special interests, agendas of personal interest,

philosophies or ideologies, agendas of biases and prejudices. Further, at present seven justices live in only three counties Wayne, Ingham, and Oakland the Detroit-Lansing beltway. She gave what she called the unfair and unjust treatment of a Kent County Judge Steven Servaas as an example of the abuse and misuse of Supreme Court power. Every citizen should go to my website, justiceweaver.com, and listen to the unannounced ambush visit from the judicial tenure commission director and a state court police officer that Judge Servaas experienced as recorded by the state police officer. You can hear the JTC director threaten, and I quote, to drag Judge Servaass name through the mud unless he agreed to resign by 9 a.m. the next morning. It is an example of tyranny, a tyranny condoned by five of the seven Supreme Court justices when they refused to investigate or have investigated the egregious conduct of JTC director. Weaver discussed her

six proposals for reform, which can be found in their entirety on her website. Its time for every one of us to take individual responsibility to take the lead, to educate ourselves, our families, friends, neighbors, coworkers, local county, city, township, state officials, the press and the media to recognize the problems and the need for reform at and transparency in the Michigan Supreme Court and to join with others who have done the same, she said. She concluded with the phrase that appears at the top of her webpage: Its time now to do right and fear not.
