DECLARATION IN SUPPORT OF APPLICATION FOR DEFERRAL OR WAIVER OF COURT FEES AND/OR COSTS AND CONSENT TO ENTRY OF JUDGMENT

I, Roy Warden, Petitioner in the above captioned Declaration in Support of Application for Deferral or Waiver of Court Fees, do hereby request the assistance of this Court. I state that, because of my poverty, I am unable to pay the costs and fees associated with said proceedings for reasons set forth below: STATEMENT OF FACTS
1.

I am an unpaid political activist working on behalf of the people of Pima County, the publisher of Arizona Common Sense and the Director of the Tucson Weekly Public Forum.

Ive spent the last 6 years investigating allegations of malfeasance within the legal and political institutions of local government, and

specifically the malfeasance of local government officials who have used their public offices (1) to aid and abet, entice and invite, and otherwise encourage the unlawful entry of impoverished Mexican citizens to supply local contractors with low cost labor, (2) to advance the current policy of the Mexican Government to exclude their poor so they may come to America to earn and send home remittances, and (3) to expose the current activities of elected Tucson City Officials who now employ City Administrators on the basis of Cronyism and not on the basis of their fitness to hold public office.

As a result of my lawful political activities intended to protect the public interest, I have suffered numerous acts of retaliation from Tucson City Officials, including 13 arrests and 12 prosecutions, an unlawful eviction, the blocking of my former email publications Common Sense II and CSII Press, excoriation in the local media, etc., all of which have ruined my professional reputation as a Arizona State Certified Legal Document Preparer and depleted my savings.

As a result of my need to defend myself against (apparently) a never ending series of retaliatory criminal charges consequent to my lawful political speech, I am indigent, and, upon submission of a Tucson City Court Financial Statement on August 10, 2006, I was first declared to be indigent by Tucson Municipal Court Judge Eugene Hays.

Subsequently; I have been declared indigent in all Tucson Municipal Court prosecutions which have arisen consequent to my political activities.

Additionally; upon similar application in various actions before the U.S. District Court I have been granted in Forma Pauperis status by a series of U. S. District Court Judges. PRAYER I request the Court to grant me a Waiver of Fees for reasons set forth
