Writ Petition under Article 199 of

the Constitution of Islamic
Republic of Pakistan, 1973.

Respectfully Sheweth: -

1. That the names and addresses of the parties have correctly been
given for the purpose of their summons and citations.

2. That the petitioner established a workshop for the repair of

weights and scales at Tatey Pur, District Multan, and applied for
licence in this regard to respondent No. 2, as prescribed U/s-17
Weights & Measures (International System) Enforcement Act,
1975. Copy of application is Annex “A”.
3. That the said application was duly entrusted to the respondent
No. 3 for further verification. The respondent N. 3 visisted the
spot, inspected the workshop, and found everything in
accordance with law. Consequently, the respondent No. 3
returned back the application of the petitioner with the
recommendation for grant of licence along-with other documents.
Form “M” and other documents are Annexes “B, C, D & E”.

4. That on the completion of this process, the respondent No. 2

forwarded the application of the petitioner along-with other
documents to the respondent No. 1 vide letter No. DC/MR/305-
Multan dated 4.2.98. Copy of this letter is Annex “F”.

5. That since then, the application of the petitioner is pending in the

office of respondent No. 1. The petitioner visited the office of
respondent No. 1 time and again but could not succeed to get the
licence.

6. That the petitioner as a citizen of Pakistan has right to enter in

any lawful profession under Article 18 of Constitution of the
land, and no embargo can be placed upon such profession until
and unless that is injurious to the interest of the general public in
any manner. Such like matter was disposed off by His Lordship
Mr. Justice Bashir A. Mujahid through writ petition No.
7122/2000 vide order dated 18.9.2000. Copy of order is Annex
“G”.

7. That the matter in hand is directly connected with the bread and
butter of the petitioner and his family. The petitioner is facing
hardships to pull on the life, and left with no other alternate,
adequate, efficacious or speedy remedy except to invoke the
Constitutional jurisdiction of this Hon’ble Court, for the redressal
of his grievance.

In view of the above submissions, it is

respectfully prayed that the respondents may kindly be
directed to issue the licence to the petitioner, which is
the subject matter of this petition under the law.
 Any other writ, direction, order or relief which
this Hon’ble Court deems fit may graciously be
awarded in the interest of justice and equity.
