1. WHO ARE WE? The Fair Competition Tribunal is established by the Fair Competition Act NO.8 of 2003.

The Tribunal was established for the purposes of resolving disputes that arise from unfair business practices including consumer protection.

The Tribunal is chaired by the Chairman who is judge of the High court and six professional members appointed by the President. The Tribunal has the powers ordinarily exercisable by the High Court.

2. WHAT DO WE DO? The Fair Competition Tribunal is an appellate body with powers to hear and determine appeals from: The Fair Competition Commission (FCC), Energy and Water Utilities Regulatory Authority(EWURA) Surface and marine Transport Regulatory Authority (SUMATRA) Tanzania Communication Regulatory Authority (TCRA) Tanzania Civil Aviation Authority (TCAA) Any regulatory authority established by law

3. WHO CAN APPEAL TO THE TRIBUNAL? There are two categories of appeals that are heard by the Tribunal: (a)Appeals arising from unfair competition among supplies of goods or services such as water, power or telecommunication (phone) utilities. Disputes between the suppliers are decided, at first instance, by the respective regulatory authority such as TCRA, EWURA, etc. The party aggrieved by the decision has the right of appeal to the Tribunal.

(b) Consumer of services who have suffered damage as a result of poor services rendered by a service provider may complain to the regulatory authority of the respective services. The matter will be decided, at first instance, by the respective regulatory authority. The aggrieved party has the right of appeal to the Tribunal .For Example; a cell phone company may provide poor services to its customer. The customer can file his/her complaint with the TCRA. If he/she is aggrieved by the decision of the TCRA, he/she has the right of appeal to the Tribunal.

4. WHAT CAN THE TRIBUNAL ORDER? The Tribunal has judicial powers almost similar to those of the High Court of Tanzania .As such, The Tribunal can do the following: Order compensation for the loss suffered Grant prohibition orders Issue declaratory orders Issue punitive sanctions such as fines. Judgments and orders of the Tribunal are enforceable in the same manner as judgments and orders of the High Court of Tanzania.

5. HOW ARE THE PROCEEDINGS OF THE TRIBUNAL CONDUCTED? The Fair Competition Act governs the Tribunal. In addition, the Tribunal has promulgated its own Rules which have been published as Governments Notice No. 189 of 2006. The Tribunal may sit anywhere within Tanzania to hear and determine appeals. There is right of representation by an Advocate or agent in the proceeding of the Tribunal. The judgments of the Tribunal are available in the pub Lic registry maintained by the Registrar of the Tribunal who is its chief executive officer.

6. WHY IS THE TRIBUNAL IMPORTANT TO YOU? With the privatization of supply of goods and services, there is need for fair play among suppliers of goods and services and to protect consumers of such goods and services. The Tribunal is the final adjudication body that ensures fair play between competing service providers on one hand and between a service provider and its consumer on the other hand. 7.
