Asylum and Immigration Act (1996)

Approved Documents The requirements of the Asylum and Immigration Act (1996) include that at the time of recruitment an employer must be able to demonstrate that the person appointed a. has current and valid permission to be in the UK and that permission eos not prevent him or her from taking the work in question; or b. he/she comes into a category where such employment is otherwise allowed. This second category will include an asylum seeker who has been given written permission to work of is appealing against a refusal of an application for further permission ti stay and will therefore have letters from the Home Office confirming that he/she can be legally employed. For these reasons, as advised in the letter inviting you to interview, all external candidates for a post in the University must produce: a) b) List 1 Documents which provide the defence if produced alone A. A passport showing that the holder is a British citizen, or has a right of abode in the UK B. A national identity card or national passport showing that the holder is a national of a European Economic Area country (see Annexe 1) or Switzerland C. A residence permit issued by the UK to a national from a EEA Country or Switzerland D. A passport or other document issued by the Home Office which has an endorsement stating that the holder has a current right of residence in the UK as the family member of a national from a EEA country or Switzerland E. A passport or other travel document endorsed to show that the holder can stay indefinitely in the UK or has no time limit on their stay F. A passport or other travel document endorsed to show that the holder can stay in the UK, or has no time limit on their stay G. A passport or other travel document endorsed to show that the holder can stay in the UK, and that this endorsement allows the holder to do the type of work being offered if they do not have a work permit H. An Application Registration Card issued by the Home Office to an asylum seeker stating that the holder is permitted to take employment one of the original documents included in List 1 OR two original documents from List 2

LIST 2 Please note that you are not able to combine documents from the first and second combinations below. First Combination A. A document giving the persons permanent National Insurance Number and name .This could be a: P45, P60, National Insurance card, or a letter from a Government agency. Along with checking and copying a document giving the persons permanent National Insurance Number, only one of the following documents listed in sections B-H must also be checked and copied: B. A full birth certificate issued in the UK, which includes the names of the holders parents OR C. A birth certificate issued in the Channel Islands, the Isle of Man or Ireland OR D. A certificate of registration or naturalisation stating that the holder is a British citizen OR E. A letter issued by the Home Office which indicates that the person named in it can stay indefinitely in the UK, or has no time limit on their stay OR F. An immigration Status Document issued by the Home Office with an endorsement indicating that the person named in it can stay indefinitely in the UK, or has no time limit on their stay OR G. A letter issued by the Home Office which indicates that the person named in it can stay in the UK; and this allows them to do the type of work being offered OR H. An immigration Status Document issued by the Home Office with an endorsement indicating that the person named in it can stay in the UK and this allows them to do the type of work being offered Second Combination A. A work permit or other approval to take employment that has been issued by Work Permits UK Along with a document issued by Work Permits UK, one of the following documents listed at B-C should be seen, checked and copied: B. A passport or other travel document endorsed to show that the holder is able to stay in the UK and can take the work permit employment in question OR C. A letter issued by the Home Office confirming that the person named in it is able to stay in the UK and can take the work permit employment in question. Once a candidate is appointed, a copy of the document(s) supplied will be kept on their personnel file.
