CASIO and NERI JAVIER COLMENARES ________________________________________________________________ RESOLUTION DIRECTING THE COMMITTEES ON SUFFRAGE AND ELECTORAL REFORMS AND NATIONAL DEFENSE AND SECURITY, IN EXERCISE OF ITS OVERSIGHT FUNCTION AND IN AID OF LEGISLATION, TO IMMEDIATELY CONDUCT AN INQUIRY INTO THE MAYUGA REPORT THAT ALLEGEDLY COVERED UP THE INVOLVEMENT OF CERTAIN OFFICERS OF THE ARMED FORCES OF THE PHILIPPINES IN THE FRAUDULENT 2004 ELECTION VICTORY OF PRES. GLORIA MACAPAGAL-ARROYO WHEREAS, the first major sign that the 2004 presidential elections was rigged came out in a June 6, 2005 press conference, when then Press Secretary Ignacio Bunye showed two recordings of telephone conversations supposedly between then President Gloria Macapagal-Arroyo and COMELEC Commissioner Virgilio Garcillano. Arroyo denied cheating in the elections on June 9, and made her infamous I am sorry television broadcast admitting to speaking to an election official, but denying manipulating election results on June 29 that touched off a long political battle until the end of her term; WHEREAS, the involvement of at least four generals in the rigging of the 2004 presidential polls as mentioned in the Hello Garci conversations led to the formation of a five-member panel composed of senior military officers headed by Vice Adm. Mateo Mayuga, then inspector general of the Armed Forces of the Philippines (AFP). The other panel members were then Major Generals Raul Relano and Romulo Alamillo, Commodore Emilio Maragayag and then Colonel Caridad Aguilar. The panel interviewed 73 witnesses and wrapped up its inquiry in October 2005. It submitted its report to the military leadership in January 2006; WHEREAS, lawmakers demanded for a copy of the report but the AFP and defense officials said this required Malacaangs approval. On April 12, 2006, Mayuga disclosed a two-page summary of his report, which cleared then Army Chief Lt. Gen. Hermogenes Esperon, former Southern Command chief Maj. Gen. Gabriel Habacon, retired Lt. Gen. Roy Kyamko, and retired Brig. Gen. Francisco Gudani. Mayuga also said the board did not find any irregularities committed by about 300 officers and soldiers who were deputized as members of the board of election inspectors. But still the full report was never released until after Macagapal-Arroyo ended her term as president;

WHEREAS, in July 13, 2011, former governor and Maguindanao massacre suspect Zaldy Ampatuan released a two-page document declaring his willingness to testify that then First Gentleman Jose Miguel Arroyo directed his father Maguindanao Gov. AndalAmpatuan Sr. to rig the 2007 elections in the Autonomous Region in Muslim Mindanao. Then President Gloria Arroyo was not the only politician who benefited and manipulated this system of cheating in the ARMM, he wrote, adding that Ampatuan Sr. was specifically asked to ensure that three opposition senators should get zero votes. He also claimed that he has information that can pin Macapagal-Arroyo to the 2004 election cheating which will lead to the closure of the Hello, Garci scandal; WHEREAS, soon after, a group of police officers led by SSupt. Rafael Santiago came out in the open to announce that they broke into the House of Representatives in January 2006 to replace the electoral returns kept by Congress, which canvassed the results of the presidential and vice presidential elections, with fake returns to ensure the electoral victory of Arroyo should there be a recount adding more credence to the alleged intricate system of cheating employed in the 2004 elections; WHEREAS, succumbing to pressure from lawmakers and the public, the Department of National Defense, upon Pres. Benigno Aquino IIIs approval, released the entire declassified Mayuga report, including its annexes to Congress; WHEREAS, the annexes of the report reveal that the Mayuga panel covered up all the leads to the involvement of certain officers of the AFP in the intricate cheating operations that assailed the 2004 polls to ensure the victory of Macapagal-Arroyo and her favored national and local candidates; WHEREAS, the said annexes of more than 2,000 pages of military documents and testimonies of military officials and personnel mention not only generals, but high officials of the MacapagalArroyo administration. There is in fact a strong possibility that then Commander-in-Chief Macapagal-Arroyo ordered her favored generals to help in the rigging of the 2004 polls to ensure victory; WHEREAS, like pieces of a jigsaw puzzle of fraud, lies and deceit, the events that transpired after the controversial 2004 presidential elections have come to the fore and lead to the logical conclusion that the legislature must immediately act to uncover the truth; WHEREAS, Malacaang has recently advised high-ranking military officials allegedly involved in election fraud to attend upcoming congressional investigations regarding the matter; WHEREAS, Congress can pursue the leads that the Mayuga Report ignored and the raid on the Batasan premises by PNP officials to switch about 6,000 election ERs to ferret the whole truth on the alleged gigantic electoral fraud committed by President Arroyo and Garcillano, et. al.; WHEREAS, the coming out witnesses and evidence of the alleged electoral fraud committed in 2004 shows that 13th Congress might have committed grave error in the performance of its constitutional duty to canvass and proclaim the real and legitimate winner of the 2004 presidential elections;

WHEREAS, it is the House of Representatives duty to conduct a probe on the widespread fraud in 2004 polls - a criminal attack on the integrity of the electoral process in order to come up with the appropriate electoral law reform measures; WHEREAS, the Congress is duty bound, Constitutional and morally, to correct this grave historical error or fraud committed against the people; NOW THEREFORE BE IT RESOLVED, that the Committees on Suffrage and Electoral Reforms and National Defense and Security, in exercise of its oversight function and in aid of legislation, immediately conduct an inquiry into the Mayuga Report that allegedly covered up the involvement of certain officials of the Armed Forces of the Philippines in the fraudulent 2004 election victory of Pres. Gloria Macapagal-Arroyo.
