CHAPTER - I
THE RIGHT TO INFORMATION: FROM PEOPLES MOVEMENT TO LEGISLATION Democracy requires an informed citizenry and transparency of information which are vital to its functioning and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed
1. Introduction
1.1 The main objective of the Right to Information Act, 2005 is to promote
transparency and accountability in the working of every Public Authority in the country and eliminate the scourge of corruption. The Act mandates a legalinstitutional framework for setting out a practical regime of right to information for every citizen to secure access to information held by or under the control of Public Authorities. It prescribes mandatory disclosure of certain
information to citizens and designation of State Public Information Officers in all Public Authorities to attend to requests from citizens for information which will have to be supplied within the stipulated time. It provides for appeal to
designated appellate officers against the decisions of Public Information Officers in case the information sought for has not been supplied. It also
mandates the constitution of a Central Information Commission and State Information Commissions to enquire into complaints, hear second appeals, and be the watch dog on the implementation of the Act.

1.5 Most of the democratic societies all over the world have incorporated
Constitution of India guarantees to all its citizens, among other things Fundamental Right to Freedom of Speech and Expression. The Right to
Information as a Fundamental Right flowing out from Article 19(1)(a) of the Constitution, is now well settled and an accepted fact. Over the years, the
Supreme Court has constantly ruled in favour of the Citizens right to know.
Parliament on 22 December 2004. After intense debate, more than a hundred amendments to the draft Bill were made before the bill was finally passed. The Right to Information Act, 2005 received the assent of His Excellency President of India on the 15th June, 2005 and was published in the Official Gazette of India on 21st June, 2005. The Act covers the whole of India except Jammu and Kashmir. It is applicable to all Constitutional Authorities, including the Executive, Legislature and Judiciary and includes any institution or body established or constituted by an Act of Parliament or a State Legislature or by order or notification of appropriate Government. In special circumstances, bodies "owned, controlled or substantially financed" by Government and even non-Government organizations "substantially financed, directly or indirectly by funds" provided by the Government are also brought under its ambit.

G.O.Ms.No.504, dated 12.11.2005 Commissions address as Buddha Bhavan, Secunderabad. As Buddha Bhavan was not ideally suitable and due to various logistical and administrative constraints, Government in partial modification of earlier orders, issued a fresh G.O.Ms.No.63, dated 23.02.2006 which notified HACA Bhavan, Hyderabad as official address of Andhra Pradesh Information Commission. Pending the completion of renovation to the building in HACA Bhavan, Commission started functioning from a temporary and make shift accommodation from the Second floor of HACA Bhavan, Hyderabad. The present office of the Commission was inaugurated by the Honble Chief Minister of Andhra Pradesh on 4th August, 2006.

So far as suo-motu disclosure and capacity building is concerned, the Andhra Pradesh Information Commission held several meetings at various levels so as to operationalise these key provisions. 3.2
U/s 4(1)(b) of the RTI Act, 2005, all the Public Authorities shall publish
within 120 days from the enactment of the Right to Information Act, 2005 the templates showing the details of the 17 items to be prepared, which essentially are in respect of organization, functions, duties, powers etc. 3.3
U/s 5(1) Every Public Authority shall within 100 days from the
enactment of this Act designate the required number of officers in all administrative units under it as State Public Information Officers so as to provide information under the provisions of this Act. 3.4

Active role vis--vis the State Administration and is aggressively pursing the RTI Act implementation vis--vis the Government Agencies, be it at the Secretariat level, Heads of Department level or at the District level. Towards this pursuit, the Commission has visited all the Districts in the State and conducted review meetings with Collectors, Superintendents of Police and other District Officers and also with Assistant Public Information
Officers(APIOs),
conducted with the Commissioner of Police, Commissioner, Municipal Corporation of Hyderabad, Director General of Police and the major Govt. Hospitals as these Departments are prominently coming in to contact with the masses at a cutting edge. Keeping this in mind, Commission hosted a web

Sangam(APMAS) organized three regional workshops on RTI Act for Civil Society Organisations, where 90 to 120 representatives of different organizations participated. Some of the Information Commissioners also
implementation, as some of the States already had this sort of legislation operational in their respective areas, (e.g., Delhi, Maharastra, Rajasthan), the A.P.Information Commission adopted a very pro-active role vis--vis the Government Agencies. The basic aim was to sensitize the concerned functionaries on the importance of Sections 4 & 5 of the RTI Act and ensure its correct implementation at the earliest. initiatives were taken: Towards this end, the following

Mayors/Municipal
Chairpersons/Commissioners in a meeting held on 25.11.2005 and informed them on the objectives of the Act and the paramount need for its correct implementation.
b) Participated
in
the
meeting
organized
by
Working
Union
Journalists/NGOs/AP Press Academy (as they are the prime stakeholders in preparing ground for better implementation of the Act in the State) on 28.11.2005 and stressed the importance to create
awareness among the public on the provisions of RTI Act, 2005 and the role of media.
c) The State Information Commission held a meeting on 23.1.2006 with the Chief Secretary, Special Chief Secretaries, Principal
Secretareis and Secretaries to Government and discussed with them the various provisions of the RTI Act. Further meetings at the same level were held on 05.06.2006, 11.09.2006, 11.10.2006, 17.01.2007, 02.02.2007 and 24.02.2007. High Level Committee Meetings in the Chambers of Chief Secretary were also held on 11.10.2006 and 17.01.2007 to take stock of the implementation of the Act and identify such of the Departments where progress is unsatisfactory. It also
conducted a meeting with all the Heads of Departments at the Jubilee Hall on 12.02.2007 and sensitized them on the various aspects of RTI Act implementation.
d) On 30-1-2006 the
Commission
Conference where the Chief Minister, most of the Cabinet Ministers and all the Secretaries / Heads of Departments were present and
explained to them the importance and implications of the Act and the need to take time bound action under different sections of the Act.
e) Participated in the meeting of Federation of Andhra Pradesh Chamber of Commerce & Industry on 4.2.2006 and explained the provisions of RTI Act, 2005 and its benefits.
f) Participated in a meeting with the teaching staff and students of Osmania University, Hyderabad on 20.02.2006 and explained them the provisions of the RTI Act, 2005 and its usage.
g) The Commission has participated in the Conference of the State Chief Information Commissioners organized by YASHDA at Pune on 27.02.2006 and 28.02.2006.
h) At the request of APIC, the CGG organized one-day training programme on RTI Act for the Working Journalists in the State in coordination with A.P. Press Academy at different places covering different districts during March - April, 2006.
i) The Commission participated in the Seminar organized by Bharat Vikas Parishad on Common Man RTI Act on 18.06.2006
j) The Commission participated in the Interaction Session on the Right to Information with the Students of Journalism organized by the Eenadu School of Journalism on 22.06.2006.
k) The Commission visited the offices of Commissioner of Police on 24.6.2006 and Municipal Corporation of Hyderabad on 27.6.2006 and
addressed their officers and reviewed the progress on implementation of the Provisions of Sections 4(1)(b) and 5(1) & (2) of RTI Act, 2005.
l) The Commission participated in the workshop for media personnel on 18.07.2006 organized by the Directorate of Field Publicity, Ministry of Information and Broadcasting, Andhra Pradesh Region, Hyderabad so as to further disseminate the various provisions of the Act.
m) The Commission participated in a workshop on RTI Act held at Central University Campus, Hyderabad on 24.7.2006.
n) The Commission organized a Work Shop on implementation of RTI Act, 2005 at Dr.Marri Chenna Reddy Human Resources Development Institute of Andhra Pradesh on 25.7.2006.
o) The Commission participated in the one day workshop for the journalists of Urdu Newspapers on RTI Act organized by Press Academy of Andhra Pradesh on 29.07.2006.
p) The Commission participated in the workshop on RTI Act organized by the Industrial Management Academy of SCOPE on 29.07.2006 at Hyderabad on the importance of RTI implementation vis-a-vis Public Sector Undertakings . q) The State Information Commissioners collectively and individually have visited all the 23 Districts and held review meetings with the District
officials (in some Districts more than once). At these meetings not only all the District Level Officers were present but also all the Information Annual Report of APIC
Officers / Asst. Information Officers / Appellate Authorities were also in attendance. These have gone a long way to sensitize the
administration at grass root level about Right to Information and its implementation. All these meetings were open for the media, both i.e., visual and print. As these meetings were also followed by Press
Conferences with the local Journalists, it has greatly helped in the creation of an Awareness Campaign.
r) The Commission during its visit to various Districts also conducted inspection of Public Authorities and gave suitable spot instructions wherever required.
s) To ensure proper implementation of Sections 4(1)(b), 5(1) & (2) of the Act, Commission carried out several field visits. During these visits, offices of several Public Authorities at different levels, were inspected and appropriate spot instructions were given. t) To create awareness among the general public on the provisions of the RTI Act, Commission has been taking part in several programmes organized by the various Social Groups viz., Lions Clubs, Rotary

Taking due cognizance of the fact that this is a new legislation and there will always be teething problems at a nascent stage, and a certain period had to be provided for the learning curve, in the first instance,

CHAPTER - V RECOMMENDATIONS

Further, it has also come to notice of the Commission that several Public Authorities have not prominently displayed the names, telephone numbers and addresses of APIOs, PIOs and First Appellate Authorities on their Notice Boards and this lacuna is causing a genuine hardship to the people who do not know as to whom to apply. Thus, it should be mandatory that the details as mentioned above are prominently displayed on the Notice Board, which itself should be located at the point of ingress and egress. This will enable the people to immediately know as to whom to

While carrying out this amendment, the Government may also take into
consideration the felt difficulties of such of the Public Authorities, who are operating at a grass root level and do not have adequate budgetary allocation. The weakness in the current scheme is that, while all the collections are credited to the Government through a challan in a given head of the account, there is no reciprocal allocation to the Public Authorities for meeting the expenses associated with photo copying etc. The problem gets worse when dealing with those requests which require copies of voluminous records and lack of budgetary availability greatly impairs their ability to prompt supply of the data requested. Awareness 5.5 Section 26 of the Act mandates the Government to:(a) develop and organize educational programmes to advance the understanding of the public, in particular of disadvantaged communities as to how to exercise the rights contemplated under this Act;
(b) encourage Public Authorities to participate in the development and organization of programmes referred to in clause (a) and to undertake such programmes themselves;
(c) promote timely and effective dissemination of accurate information by Public Authorities about their activities; and
(d) training State Public Information Officers, as the case may be of Public Authorities and produce relevant training materials for use by the public authorities themselves. 5.6

From the above, it is clear that it is the duty and obligation of the
Government to create the necessary awareness both on the supply as well as the demand side. For this, it is essential that adequate budgetary allocations are made for conducting seminars, symposiums, workshops as also for the printing of guides and pamphlets. As visual media has expanded rapidly, The Commission has
noticed that of all the complaints and appeals received, those obtaining from rural areas are a meagre 11%. lacking in the rural areas. This fact in itself indicates that awareness is
the mindset, attitudes and value systems have not yet percolated to large section of the Public Authorities and an application under the RTI Act is at times perceived with hostility. This is clearly unacceptable and has to change. The Act which has been passed by the Parliament, assented to by the President, and notified has become the law of the land. It is a major step forward in heralding transparency, accountability, openness and Good Governance, and, denotes a paradigm shift to demystify the Government functioning and bring out all the processes involved into the public domain. Thus, it is mandatory for this important item of work that adequate resources are deployed and sufficient funds are made available to inculcate greater awareness, both in the supply as well as the demand side.
Performance of the Officers 5.8 In view of the high profile of the legislation and its crucial role in
achieving transparency, accountability, Good Governance and eliminating corruption, it is absolutely important that while apprising the performance of Annual Report of APIC
the officers, a specific column is incorporated into the forms of Annual Confidential Reports / Self Assessment Reports prescribed, which should specifically refer to the officers attitude towards the implementation of Right to Information Act. This will go a long way in conveying a message to the
functionaries manning the Public Authorities that the Government are very serious about it in its implementation and a negative approach to the Act can jeopardize the careers and promotional avenues of the officers concerned.
Remuneration to APIOs and PIOs 5.9 RTI Act is a legislation which has very strict time limits for execution
and for delays caused, there is a personal liability on the information officer concerned. As the Act gets more acceptances, there will be significant
increase in the number of applications received which will have to be processed within the time limit prescribed. This implies a significant increase in the work load on the officers dealing with the subject. Often they have to
pursue matters coming in the jurisidiction of their seniors and this may also invite incurring their displeasure / annoyance. As the 2nd appeal with the
Commission is concerned, the culpability of the information officer is very clearily defined. Thus, it is clear, that the job of the Information Officer will
become a high risk assignment which causes a heavy additional burden and exposes the officers to punitive action while at the same time there is no compensatory monitory relief. In view of the above, it will be in the fitness of the things, if some token honorarium is given to all such officers who are designated as the APIO or PIO.

As per the practices in vogue, whenever the need arises, all those
associated with the election work come under the administrative control of the Election Commission of India. Similarily, all such officers who are designated as Vigilance Officers come under the administrative control of the Vigilance Commissioner. This ensures a certain degree of unified command structure and insulates the field level functionaries from extraneous influences. On
similar lines, it is suggested, that all the Information Officers must come under the administrative control of the Information Commission and once designated, they cannot be transferred, changed or altered without the prior permission of the Information Commission.
Allotment of Budget 5.11 Earmarking of funds from the existing budgetary allocations, so as to
minimize the budgetary pressures solely falling on the Finance Department, and keeping in view the critical importance of the legislation which aims to create an open, transparent and accountable administration, it is
recommended that each department must earmark atleast one percent of its budgetary allocation towards meeting its obligations under this Act. -:o0o:-
