REVISED ASSENTED-TO MOTION FOR ENTRY OF TEMPORARY RESTRAINING ORDER The plaintiff hereby moves this Court to enter the attached Proposed Temporary Restraining Order. (Attached at Ex. A). As grounds for this Motion the plaintiff states: 1. The plaintiff filed its Complaint in this matter on December 20, 2011, alleging, among other claims, infringement of Plaintiffs trademarks and copyrights. 2. Through their respective counsel, the parties have had several discussions and are pursuing settlement negotiations. The parties believe that such negotiations would be facilitated by the entry of the requested order.

Plaintiff, Wimpy Kid, Inc., and Defendant Antarctic Press Inc.s Assented-to Motion for Temporary Restraining Order was filed with this Court on December 30, 2011. Having read its contents, and in light of Defendants assent thereto, Plaintiffs Assented-to Motion for Temporary Restraining Order is GRANTED.

IT IS HEREBY ORDERED THAT: 1. Defendant Antarctic Press, Inc. (Antarctic), together with its officers, agents, servants, affiliates, employees, and attorneys, and those other persons who are in active concert or participation with any of them, shall not sell, publish, or otherwise distribute Antarctics books entitled Diary of a Zombie Kid (ISBN-10: 0983182337/ISBN-13:978-0983182337) (Zombie Kid) Diary of a Zombie Kid: Rotten Rules (ISBN-10: 0983793425/ISBN-13: 978-0983793427), which is currently scheduled for release to the public on January 10, 2012 (Rotten Rules). 2. Within three (3) days of the entry of this Temporary Restraining Order, Antarctic shall provide a copy of this Temporary Restraining Order to each book printer, distributor, and retailer who is, or may reasonably become, involved in the publication, distribution, or sale of Zombie Kid and/or Rotten Rules. 3. Antarctic shall file with the Court and serve on Plaintiff, within ten (10) days of the entry of this Temporary Restraining Order, a report in writing and under oath, setting forth in detail the manner and form in which Antarctic has complied with the Temporary Restraining Order. 4. This Temporary Restraining Order shall stay in effect for a period of thirty (30) days from the date of its entry. Provided, however, if Plaintiff files a motion for preliminary

injunction during the pendency of this Temporary Restraining Order, this Temporary Restraining Order shall automatically extend until final adjudication of the motion for preliminary injunction.
