NEW EmPLOymENT
LAWS TAKE EFFECT
The California Chamber of Commerce
has released a list of new employment laws
scheduled to take effect in 2012 or earlier
that will have an impact on businesses in
California.
In addition to the new employment
laws, an order by the National Labor
Relations Board (NLRB) is also impacting
businesses in California. By January 31,
2012, most private-sector employers must
begin displaying an 11x17 poster that
provides information to their employees
about unionizing and their right to
strike. For more information, watch the

New Laws:
Unless specifed, the following is a
list of all new legislation goes into effect
on January 1, 2012. The entire list can

Pacifc Gas and Electric Company (PG&E)
recently launched a new online tool to enhance
its 2011-2012 Winter Gas Savings program.
The PG&E Winter Gas Savings Progress
Tracker app is the frst Facebook-enabled, web-
based tracking tool to help customers measure
their progress toward meeting their energy
saving goals.
The annual PG&E Winter Gas Savings
program gives eligible residential and business
customers an automatic bill credit of up to
20 percent when they reduce their natural
gas usage in December 2011 and January
2012 compared to the previous three winters,
adjusted for weather. During the 2011 program,
some 2.7 million customers earned bill credits
totaling $70 million.

Always keeping innovation front of mind,
QVMC was the frst medical facility in Napa
County to purchase a linear accelerator,
and was also the frst to offer magnetic-
resonance imaging (MRI), lithotripsy and
stereotactic breast biopsy. More recently,
QVMC is the frst and only facility in the
area to offer robotic surgery options with
the Da Vinci Surgical System. As a model
for health and wellness QVMC became one
of the frst hospitals in the nation and the
frst in Northern California to take health
and wellness to a new level by opening a
medical ftness center. The Synergy Medical
Fitness Center integrates exercise and ftness
with disease prevention, disease management
and rehabilitation services including weight
management, diabetes wellness, nutrition/
stress counseling, arthritis management, and
complementary medicine.
When asked about his reaction to the award
notifcation, President and CEO Walt Mickens
said, I am proud to be part of an organization
that is committed to its mission to continually
improve the health and quality of life of
people in the communities we serve. Being a
part of and caring for the Napa community is
at the heart of who we are as individuals and
as an organization. Its an honor to accept this
award on behalf of the amazing physicians,
medical professionals, staff, volunteers and
donors whose hard work, dedication and
support make the Queen a great hospital.
Ambassador of the Year Award:
Nancy Pridmore
Nancy, who is a real estate broker with
Davidson & Bennett Realtors, is a shining
example of a community-involved participant
who routinely goes above and beyond in her
efforts to support a strong local economy.
Always recognizing the value of Chambers
of Commerce, Nancy was a founding Board
Member of the Berryessa Chamber in the
early 1960s. She has been a Napa Chamber
Ambassador for over 25 years and served on
the Napa Chamber Board for several years.
When asked what her reaction was to hearing
the news she said, I was absolutely shocked!
I didnt know what to say I was completely
speechless which is rare for me!
Nancy loves serving as an Ambassador as
it gives her the opportunity to welcome new
businesses and support existing ones. Beyond
Ambassador duties, Nancy sees the Chamber
of Commerce as critical to the areas business
success; The value of a Chamber lies in
the legislative action support to the business
community. We give businesses a voice at the
table, and not just for members, we advocate
for business in general. We operate as a
consensus builder that brings together all the
interested parties in the Napa Valley whether
its agriculture, business, non-profts, or even
religious groups, we fnd we can be a help
to one another. We try to keep everybody
apprised of what is going on at the local, state
and federal levels. If you are in business here
you need to be a Napa Chamber member.
The Progress Tracker app lets customers
who have gas SmartMeters graphically
compare their current estimated average
daily usage to their three-year daily average,
so they can see if they are on track to
earn full or partial bill credits. Through
Facebook, customers can conveniently view
their savings performance and write posts
about it on their Wall. The app is available at
www.pge.com/wintergassavings and www.
facebook.com/pacifcgasandelectric.
According to the utility, this new Progress
Tracker app will let customers see how
their conservation efforts are creating extra
savings opportunities this winter. By making
the tracker available within Facebook,
the company is bringing personal energy
consumption data to customers in a friendly
environment, helping to make energy
management a part of everyday life.

Customers can take simple steps to
reduce their gas consumption this winter:
Lower the thermostat to 68 degrees
during the daytime (health permitting)
Set the water heater to 120 degrees or the
normal setting
Wash clothes in cold water instead of hot
Open blinds and drapes on sunny days
Microwave small amounts of food
instead of heating them up in the oven.

getting this article onto that medium. Look at
each component of the process, recognizing
each stakeholder past, present, and future.
Amazing how many relationships each
business process has, isnt it? How these
relationships develop is largely up to the leader
of the business.
Unfortunately, many business leaders
harbor the misconception that becoming a
sustainable or green business is expensive.
Sure, like anything else, it could be. But it
doesnt have to be. There are many things that
you can do right now today to improve
your TBL that dont cost a dime but have the
potential to save you a substantial amount of
cash.
An easy place to start is right-sizing.
What equipment does your business really
need? Could you achieve the same outcome
without all the bells and whistles? Are you
paying for more than you need? Or could you
allocate your budget more wisely? Look at
every aspect of your business with a show
me the money attitude. The money you save
will help you better weather economic storms
Despite differences about what it
takes to be sustainable, nearly everyone
acknowledges that three infuential, and
often competing factors social, economic,
and environmental demands require
serious attention. In a small community
like the Napa Valley (where everything and
everyone is connected) creating unbalanced,
and, therefore, unhealthy relationships
among these three responsibilities can
cause irreversible damage, especially for
businesses.
How does a business leader avoid that?
By embracing a principle called the triple
bottom line (coined in 1997 and also known
as TBL or 3BL). TBL focuses on the benefts
of protecting people, planet, and profts. No
matter how large or small a business, the
crux of TBL is responsibility to stakeholders,
not just shareholders.
One way to fgure out who your
stakeholders are is to perform a life
cycle analysis. For example, consider the
newspaper or computer screen you are
reading. Now think of everything it took
from educating and paying the labor force
and it will help you
create a thriving
business or
household.

proactive in their sustainable practices.

Pregnancy Disability Leave
SB 299 requires all employers with fve
or more employees to continue to maintain and
pay for health coverage under a group health
plan for an eligible female employee who takes
Pregnancy Disability Leave (PDL) up to a
maximum of four months in a 12-month period.
Willful Misclassifcation of Independent
Contractors
SB 459 provides new penalties of
between $5,000 to $25,000 for the willful
misclassifcation of independent contractors.
Written Commission Agreement
AB 1396 requires employers who have
commission pay arrangements to put those
agreements into a signed written contract. The
written contract must set forth the method by
which the commissions will be computed and
paid. The bill is effective January 1, 2013.
Employers have the entirety of 2012 to bring
their commission agreements into compliance.
Notice of Pay Details
AB 469 requires employers to
provide nonexempt employees, at the
time of hire, a notice that specifes:
The rate of pay and the basis,
whether hourly, salary, piece
commission or otherwise, including
any overtime rate.
Allowances, if any, claimed as part
of the minimum wage, including meal
and lodging allowances.
The regular pay day designated by
the employer as required under the
Labor Code.
The name of the employer, including
any doing business as names.
The physical address of the
employers main offce or principal
place of business and any mailing
address, if different.
The telephone of the employer.
The name, address and telephone
number of the employers workers
compensation carrier.
Gender Expression
AB 887 amends the Fair Employment
and Housing Act to further defne gender
to include both gender identity and
gender expression and to make clear that
discrimination on either basis is prohibited. AB
887 also amends Government Code relating to
dress codes to include that an employee must
be allowed to dress consistently with both
the employees gender identity and gender
expression.
E-Verify
AB 1236 allows employers to continue to
choose to use E-Verify, but prohibits California
state agencies and local governments from
passing mandates that require employers to use
E-Verify.
Several cities in California passed local
ordinances requiring the use of E-Verify in
certain circumstances. This new law prohibits
such state or local mandates, unless required by
federal law or as a condition of receiving federal
funds.
Interference With Rights Under Leave Laws
AB 592 adds language to the California
Family Rights Act (CFRA) and the Pregnancy
Disability Leave law (PDL) that makes it
unlawful to interfere with or in any way restrain
the exercise of rights under these laws.
Administrative Penalties
AB 240 allows an employee that
alleges a minimum wage violation to
recover liquidated damages pursuant
to any complaint brought before the
Division of Labor Standards Enforcement
(DLSE). This new law would allow the
Labor Commissioner to also award such
damages. Under the new liquidated damages
provision, the employee would be entitled
to recover an amount equal to the wages
unlawfully unpaid, plus interest.
Wage Penalties
AB 551 increases the maximum penalty
from $50 to $200 per calendar day for
each worker paid less than the determined
prevailing wage and increases the minimum
penalty from $10 to $40 per day for
violations of prevailing wage obligations.
It also increases the penalty from $25 to
$100 per calendar day, per worker, against
contractors and subcontractors that fail to
respond to a written request for payroll
records within 10 days.
Farm Labor Contractors Wage Notices
AB 243 amends the Labor Code
to expand the information that must be
included on pay statements, but only for
farm labor contractors. Employers that are
farm labor contractors must now disclose on
the itemized payroll statement furnished to
their employees, the name and address of all
legal entities (for example other growers or
other farm labor contractors) that secured the
employers services.
Agricultural Labor Relations
SB 126 affects certifcation of
bargaining representatives for agricultural
employees. The new law, SB 126, provides
that if the Agriculture Labor Relations Board
(ALRB) fnds employer misconduct that
in addition to affecting the outcome of the
election, would render slight the chances
of a new election refecting the free and
fair choice of employees, then the ALRB
can certify the labor union as the exclusive
bargaining agent for employees.
Insurance Non-Discrimination Act
SB 757 closes an existing loophole and
prevents employers that operate in multiple
states from discriminating against same-sex
couples by not providing the same insurance

spouses.
State Contracts Gender or Sexual
Orientation Discrimination
SB 117 outlaws the state of California
from entering into contracts of more than
$100,000 with companies that discriminate
against the employees on the basis of gender
or sexual orientation with regard to benefts.
The new law makes it clear that companies
doing business with the state of California
cannot deny equal benefts to same-sex
spouses.
Workers Compensation Legislation
The governor signed these fve workers
compensation bills that were all supported by
CalChamber.
AB 335 Requires the workers
compensation administrative director (AD)
to work with the Commission on Health
and Safety and Workers Compensation
(CHSWC) to develop regulations regarding
notices to injured workers; requires AD
and CHSWC to develop and make
accessible a booklet written in plain
language about the workers comp
claims process; streamlines and
simplifes other notices to employees.
AB 378 Lowers workers
compensation costs by establishing
guidelines for dispensing compound
drugs, the circumstances under which
those drugs would be covered and the
reimbursement amount, and removes
the incentives for physicians to refer
patients to pharmacies in which the
physician or physicians family has a
fnancial interest.
AB 397 Seeks to address the
underground economy problem by
singling out contractors that do not
have workers compensation coverage
but requiring contractors that are
exempt from having coverage at the
time they are licensed to certify they
are still exempt or have gotten coverage
at the time of their license renewal.
AB 1168 Lowers costs for
employers and insurers by establishing
a fee schedule for vocational experts
services.
AB 1426 Streamlines the workers
comp process and eliminates duplicative
bureaucracy and inconsistency by eliminating
the court administrator position.
The governor also signed a Workers
Compensation related bill that CalChamber
took no position on:
AB 228 Amends California Insurance
Code to authorize the State Compensation
Insurance Fund (SCIF) to provide workers
compensation coverage to a California
employer whose California employees
temporarily work outside the state and whose
injuries while performing out-of-state work
might lead to workers compensation liability
in some other state.
DFEH Procedural Regulations
Effective October 7, 2011, the
Department of Fair Employment and Housing
(DFEH) has instituted new regulations
relating to procedures for fling, investigating
and processing discrimination and harassment
claims. Overall, the regulations make it easier
for claimants to fle their complaints and
initiate a DFEH investigation.
